Článek 54 - Zákaz zneužití práv

Žádné ustanovení této listiny nesmí být vykládáno tak, jako by dávalo jakékoli právo vyvíjet činnost nebo dopustit se činu zaměřeného na zmaření kteréhokoli z práv a svobod uznaných v této listině nebo na jejich omezení ve větším rozsahu, než tato listina stanoví.

    Tento článek odpovídá článku 17 EÚLP:

    „Nic v této Úmluvě nemůže být vykládáno tak, jako by dávalo státu, skupině nebo jednotlivci jakékoliv právo vyvíjet činnost nebo dopouštět se činů zaměřených na zničení kteréhokoli ze zde přiznaných práv a svobod nebo na omezování těchto práv a svobod ve větším rozsahu, než to Úmluva stanoví.“

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Tato vysvětlení byla původně vyhotovena pod vedením prezídia Konventu, který vypracoval Listinu základních práv Evropské unie. Byla aktualizována pod vedením prezídia Evropského konventu s ohledem na změny návrhu znění Listiny provedené Konventem (zejména článků 51 a 52) a na vývoj práva Unie. Ačkoliv sama nemají právní závaznost, jsou cenným výkladovým nástrojem pro vyjasnění ustanovení Listiny.
