Artikel 3 - Ret til respekt for menneskets integritet

  1. Enhver har ret til respekt for sin fysiske og mentale integritet.
  2. I forbindelse med lægevidenskab og biologi skal især følgende respekteres:

a) frit og informeret samtykke fra den berørte person i overensstemmelse med lovens bestemmelser
b) forbud mod racehygiejnisk praksis, navnlig praksis, der har til formål at udvælge mennesker
c) forbud mod kommercialisering af menneskekroppen og dele heraf som sådan
d) forbud mod reproduktiv kloning af mennesker.

    1. I dom af 9. oktober 2001, sag C-377/98, Kongeriget Nederlandene mod Europa-Parlamentet og Rådet for Den Europæiske Union, Sml. I, s. 7079, præmis nr. 70 og 78, 79 og 80, stadfæstede Domstolen, at en grundlæggende ret til menneskelig værdighed er et element i EU-retten, og at den inden for lægevidenskab og biologi omfatter donors og modtagerens frie og informerede samtykke.
    2. Principperne i chartrets artikel 3 findes allerede i konventionen om menneskerettigheder og biomedicin, der blev vedtaget inden for rammerne af Europarådet (STE 164 og tillægsprotokol STE 168). Chartret skal ikke fravige disse principper og forbyder altså kun reproduktiv kloning. Den hverken tillader eller forbyder andre former for kloning. Den forhindrer altså ikke lovgiverne i at forbyde de øvrige former for kloning.
    3. Omtalen af racehygiejnisk praksis, navnlig praksis, der har til formål at udvælge mennesker, tager sigte på situationer, hvor der tilrettelægges og gennemføres udvælgelsesprogrammer, der bl.a. indebærer steriliseringer, tvangsgraviditeter og etniske tvangsægteskaber, alt sammen handlinger, der betragtes som internationale forbrydelser i henhold til Romstatutten for Den Internationale Straffedomstol, der blev vedtaget den 17. juli 1998 i Rom (jf. dennes artikel 7, stk. 1, litra g).

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Disse forklaringer blev oprindelig udarbejdet under præsidiet for den forsamling, der udarbejdede chartret om grundlæggende rettigheder. De er blevet ajourført under Det Europæiske Konvents præsidiums ansvar i lyset af de udkast til tilpasninger, som konventet har foretaget i charterteksten (især i artikel 51 og 52) og videreudviklingen af EU-retten. Selv om forklaringerne ikke i sig selv har retskraft, udgør de et værdifuldt fortolkningsinstrument beregnet til nærmere præcisering af chartrets bestemmelser.
