Artículo 34 - Seguridad social y ayuda social

1. La Unión reconoce y respeta el derecho de acceso a las prestaciones de seguridad social y a los servicios sociales que garantizan una protección en casos como la maternidad, la enfermedad, los accidentes laborales, la dependencia o la vejez, así como en caso de pérdida de empleo, según las modalidades establecidas por el Derecho de la Unión y las legislaciones y prácticas nacionales.
2. Toda persona que resida y se desplace legalmente dentro de la Unión tiene derecho a las prestaciones de seguridad social y a las ventajas sociales de conformidad con el Derecho de la Unión y con las legislaciones y prácticas nacionales.
3. Con el fin de combatir la exclusión social y la pobreza, la Unión reconoce y respeta el derecho a una ayuda social y a una ayuda de vivienda para garantizar una existencia digna a todos aquellos que no dispongan de recursos suficientes, según las modalidades establecidas por el Derecho de la Unión y por las legislaciones y prácticas nacionales.

    El principio enunciado en el apartado 1 del artículo 34 se basa en los artículos 153 y 156 del Tratado de Funcionamiento de la Unión Europea, así como en el artículo 12 de la Carta Social Europea y en el punto 10 de la Carta Comunitaria de los Derechos Sociales Fundamentales de los Trabajadores. La Unión debe respetarlo en el ejercicio de las competencias que le confieren los artículos 153 y 156 del Tratado de Funcionamiento de la Unión Europea. La referencia a servicios sociales se refiere a los casos en que dichos servicios se han establecido para garantizar determinadas prestaciones pero de ninguna manera implica que dichos servicios deban ser creados cuando no existen. La expresión `maternidad` debe entenderse en el mismo sentido que en el artículo precedente.
    El apartado 2 se basa en el apartado 4 del artículo 12 y en el apartado 4 del artículo 13 de la Carta Social Europea y en el punto 2 de la Carta Comunitaria de los Derechos Sociales Fundamentales de los Trabajadores y refleja las normas dimanantes del Reglamento (CEE) n.o 1408/71 y del Reglamento (CEE) n.o 1612/68.

    El apartado 3 se inspira en el artículo 13 de la Carta Social Europea y en los artículos 30 y 31 de la Carta Social revisada, así como en el punto 10 de la Carta Comunitaria. La Unión debe respetar tal derecho en el marco de las políticas basadas en el artículo 153 del Tratado de Funcionamiento de la Unión Europea.
