    Key facts of the case: 

    The Law of 28 April 2015 reforms the court office fees. Instead of being fixed, those fees are set in proportion to the value of the claim. Furthermore, a court office fee is added for labour and fiscal cases for requests of relatively high value. The parties argue that those added fees violate the right to access to a judge, because they would make it harder for poorer citizens to access a judge. They put forward alleged violation of Articles 10, 11 and 13 of the Consitution combined with Articles 6 and 13 of the European Convention on Human Rights and Article 47 of the Charter of Fundamental Rights of the European Union. 

    Outcome of the case:

    The Court annulled the contested dispositions based on discrimination between litigants on the basis of the claim’s value, which is not pertinent to achieving the goal pursued by the legislator.

The requesting party’s argument is mainly, but not exclusively, related to the alleged violation of Articles 10, 11 and 13 of the Constitution, combined or not with Articles 6 and 13 of the European Convention on Human Rights and with Article 47 of the Charter of Fundamental Rights of the European Union. To increase registry costs would considerably limit the right of access to a judge, particularly for litigants with limited financial resources, even more so because such an increase is added to other measures that have a financial impact, such as the lawyer’s fees to be paid by the losing party, the imposition of VAT on lawyer’s fees and an increase of registry costs (the latter were already increased in 2012). The legislator wrongly bases itself on the premise that there is a link between the value of the claim and the amount of work required by the judicial system so that the distinguishing criterion cannot be considered pertinent to achieving the goals pursued.     B.11.1 The right of access to a judge constitutes a general principle of law which must be guaranteed for everyone with due respect for Articles 10, 11 and 13 of the Constitution, Articles 6 and 13 of the European Convention on Human Rights and Article 47 of the Charter of Fundamental Rights of the European Union. It constitutes an essential aspect of the right to a fair trial and it is fundamental in a State subject to the rule of law. Furthermore, the right of access to a judge concerns both the freedom to take legal action and the freedom to defend oneself.

Les moyens que les parties requérantes allèguent à cet égard sont principalement, mais pas exclusivement, pris de la violation des articles 10, 11 et 13 de la Constitution, combinés ou non avec les articles 6 et 13 de la Convention européenne des droits de l’homme et avec l’article 47 de la Charte des droits fondamentaux de l’Union européenne. De middelen die de verzoekende partijen daaromtrent aanvoeren zijn in hoofdzaak, zij het niet uitsluitend, afgeleid uit de schending van de artikelen 10, 11 en 13 van de Grondwet, al dan niet in samenhang gelezen met de artikelen 6 en 13 van het Europees Verdrag voor de rechten van de mens en met artikel 47 van het Handvest van de grondrechten van de Europese Unie. Door de verhoging van de rolrechten zou het recht op toegang tot de rechter aanzienlijk worden beperkt, inzonderheid ten aanzien van rechtzoekenden met beperkte financiële middelen, temeer nu die verhoging bovenop een aantal andere maatregelen komt, zoals de verhaalbaarheid van de erelonen van de advocaat, de onderwerping van die erelonen aan de btw en een eerdere verhoging van de rolrechten in 2012. De wetgever zou onterecht ervan uitgaan dat er een verband bestaat tussen de waarde van de vordering en de werklast voor het gerechtelijk apparaat, zodat het aangewende criterium van onderscheid niet pertinent zou zijn om de nagestreefde doelstellingen te bereiken. Bovendien zouden de bestreden maatregelen onevenredig zijn met die doelstellingen. […]

    B.11.1  Le droit d’accès au juge constitue un principe général de droit qui doit être garanti à chacun dans le respect des articles 10, 11 et 13 de la Constitution, des articles 6 et 13 de la Convention européenne des droits de l’homme, et de l’article 47 de la Charte des droits fondamentaux de l’Union européenne. Il constitue un aspect essentiel du droit à un procès équitable et est fondamental dans un Etat de droit. De plus, le droit de s’adresser à un juge concerne tout autant la liberté d’agir en justice que celle de se défendre. /B.11.1. Het recht op toegang tot een rechter is een algemeen rechtsbeginsel dat met inachtneming van de artikelen 10, 11 en 13 van de Grondwet, van de artikelen 6 en 13 van het Europees Verdrag voor de rechten van de mens en van artikel 47 van het Handvest van de grondrechten van de Europese Unie aan eenieder moet worden gewaarborgd. Het vormt een wezenlijk aspect van het recht op een eerlijk proces en is fundamenteel in een rechtsstaat. Het recht om zich tot een rechter te wenden, heeft bovendien zowel betrekking op de vrijheid om in rechte op te treden als op de vrijheid om zich te verdedigen.
