    Key facts of the case:

    The case concerned the description of the search result displayed after entering the name of a businessman X in the Google search engine (a so called ‘snippet’). The search result referred to the article in one of the weeklies about a certain crime group. The description included the name of the businessman and the title of the article: ‘Very poor criminal’. According to the businessman the snippet was misleading as it suggested that he had some links to criminal activity which was not true. In fact, the businessman was one of the positive characters of the article who contributed to breaking up the criminal group. However, the article itself was behind the pay wall so its content – allowing to verify the actual role of the businessman in it - was available only to the subscribers of the online edition of the weekly.

    Outcome of the case:

    The court ordered Google to remove the link from the search results and to pay 10 000 PLN (5 000 Euros) compensation to the businessman. The judgment is final, however, in theory it can be questioned before the Supreme Court. The case was appealed on 13.12.2018 referred to Appeal Court for re-axmination.

    However, in reference to the right to delete or block certain data guaranteed by the Directive, the Court of Justice indicated that in order to assess whether the requirements set in Articles 12 b and 14 par. 1a it should in particular be examined whether the data subject has a right that the information relating to him personally should, at this point in time, no longer be linked to his name by a list of results displayed following a search made on the basis of his name. As the data subject may, in the light of his fundamental rights under Articles 7 and 8 of the Charter, request that the information in question no longer be made available to the general public by its inclusion in such a list of results, those rights override, as a rule, not only the economic interest of the operator of the search engine, but also the interest of the general public in finding that information upon a search relating to the data subject’s name.

    Natomiast w zakresie prawa do usunięcia lub zablokowania danych gwarantowanego przez dyrektywę TSUE wskazał, że w ramach oceny tego, czy spełnione zostały warunki zastosowania przepisów art. 12 lit. b) i art. 14 ust. 1 lit a), <<…należy w szczególności przeanalizować kwestię, czy osoba, której dotyczą dane, ma prawo do tego, aby dana dotycząca jej informacja nie była już, w aktualnym stanie rzeczy, powiązana z jej imieniem i nazwiskiem poprzez listę wyświetlającą wyniki wyszukiwania mającego za punkt wyjścia to imię i nazwisko, przy czym stwierdzenie, iż takie prawo przysługuje, pozostaje bez związku z tym, czy zawarcie na tej liście wyników wyszukiwania danej informacji wyrządza szkodę tej osobie. Ponieważ osoba ta może, ze względu na przysługujące jej i przewidziane w art. 7 i 8 Karty prawa podstawowe, zażądać, aby dana informacja nie była już podawana do wiadomości szerokiego kręgu odbiorców poprzez zawarcie jej na takiej liście wyników wyszukiwania, prawa te są co do zasady nadrzędne nie tylko wobec interesu gospodarczego operatora wyszukiwarki internetowej, lecz również wobec interesu, jaki ten krąg odbiorców może mieć w znalezieniu rzeczonej informacji w ramach wyszukiwania prowadzonego w przedmiocie imienia i nazwiska tej osoby… .
