Praktične smjernice. Uspostava nacionalnih neovisnih mehanizama praćenja poštovanja temeljnih prava na vanjskim granicama EU‑a
Praćenje poštovanja temeljnih prava na vanjskim granicama EU‑a trebalo bi se sustavno i redovno provoditi za široki raspon aktivnosti upravljanja granicama. Te aktivnosti obuhvaćaju nadzor granica, uhićenja na kopnenim, morskim i zračnim granicama te rad mehanizama za upućivanje, uključujući u slučaju masovnih dolazaka. Ovim općim smjernicama pruža se pomoć državama članicama EU‑a u uspostavi nacionalnih neovisnih mehanizama praćenja poštovanja temeljnih prava na vanjskim granicama EU‑a, u skladu s uredbom o dubinskoj provjeri koju je Europska komisija predložila 23. rujna 2020. Agencija Europske unije za temeljna prava izradila je ove smjernice na zahtjev Komisije.

June 2022 Update – Search and Rescue (SAR) operations in the Mediterranean and fundamental rights
The EU Agency for Fundamental Rights (FRA) regularly collects data on the operations of NGO vessels involved in search and rescue in the Mediterranean. This includes any legal proceedings against them, as well as on any difficulties in disembarking migrants in safe ports. The International Organization for Migration estimates that from January to 15 June 2022 about 842 people died or went missing while crossing the Mediterranean Sea to reach Europe to escape war or persecution, or to pursue a better life. This is an average of five people per day.

Migration: Fundamental rights issues at land borders
This report looks at fundamental rights compliance at the European Union (EU)’s external land borders, including rivers and lakes. On 30 January 2020, the European Parliament requested the EU Agency for Fundamental Rights (FRA) to prepare a report on these borders. It noted that the report should focus on the correct application of the safeguards in the European asylum acquis and the provisions of the Schengen Borders Code (Regulation (EU) 2016/399).

Fundamental rights considerations: NGO ships involved in search and rescue in the Mediterranean and criminal investigations - 2018
This note draws attention to the recent trend of criminalising search and rescue operations (SAR) in the Mediterranean Sea carried out by non-governmental organisations (NGOs) or other private entities. This includes seizing rescue vessels, as well as arrests for crew members, in some EU Member States. Most of such incidents concerned NGOs operating in the Central Mediterranean Sea.

EU Member States are increasingly involved in border management activities on the high seas, within – or i cooperation with – third countries, and at the EU’s borders. Such activities entail risks of violating the principle of non-refoulement, the cornerstone of the international legal regime for the protection of refugees, which prohibits returning individuals to a risk of persecution. Guidance on how to reduce the risk of refoulement in external border management when working in or together with third countries
EU Member States are increasingly involved in border management activities on the high seas, within – or in cooperation with – third countries, and at the EU’s borders. Such activities entail risks of violating the principle of non-refoulement, the cornerstone of the international legal regime for the protection of refugees, which prohibits returning individuals to a risk of persecution. This guidance outlines specific suggestions on how to reduce the risk of refoulement in these situations – a practical tool developed with the input of experts during a meeting held in Vienna in March of 2016.

Fundamental rights considerations for law enforcement when processing Passenger Name Record data
FRA was requested by the European Commission (EC) in January 2014 to provide practical guidance on the processing of Passenger Name Record (PNR) data for law enforcement purposes, in light of efforts by Member States to establish national PNR systems. As a result, in informal consultation with EC services and the European Data Protection Supervisor (EDPS) and building on opinions FRA, the EDPS and the Article 29 Working Party on PNR, FRA presented twelve fundamental rights considerations to EU Member States experts at technical level.

Fundamental rights at land borders: findings from selected European Union border crossing points
Together with two FRA sister reports on the
EU’s air and southern sea borders, this report’s findings serve to inform EU and Member State practitioners and
policy makers of fundamental rights challenges that can emerge at land borders. Increased awareness should
also help to create a shared understanding among border guards of what fundamental obligations mean for
their daily work, ultimately enhancing fundamental rights compliance at the EU’s external borders.

EU solidarity and Frontex: fundamental rights challenges
The majority of irregular arrivals by sea to the European Union (EU) occur in the Mediterranean. Although the phenomenon is not widespread throughout the EU, it affects the EU as a whole. This publication reviews the solidarity measures the EU has established to support those countries most affected by irregular arrivals by sea. It will focus on the fundamental rights challenges raised by such measures but will not discuss whether these measures are sufficient and adequate for genuinely sharing the costs associated with the arrivals. This publication will also touch upon EU funding instruments and intra-EU relocation from Malta and more thoroughly describe the operational cooperation with Frontex.

Coping with a fundamental rights emergency - The situation of persons crossing the Greek land border in an irregular manner

Fundamental rights at Europe’s southern sea borders
This FRA report examines the conditions at Europe’s southern sea borders with respect to the most fundamental rights of a person, the right to life and the right not to be sent back to torture, persecution or inhuman treatment. It looks at sea border surveillance and disembarkation procedures, as well as training and Frontex-coordinated operations. FRA opinion on the proposal for a Passenger Name Record (PNR) Directive
Upon request of the European Parliament, the FRA presented an expert opinion on the fundamental rights compliance of a proposal for a Directive on the use of Passenger Name Record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crime (COM(2011) 32 final). This was a follow-up request to the opinion of the FRA related to PNR from October 2008.
