Artikel 41 - Recht op behoorlijk bestuur

1. Eenieder heeft er recht op dat zijn zaken onpartijdig, billijk en binnen een redelijke termijn door de instellingen, organen en instanties van de Unie worden behandeld. 2. Dit recht behelst met name: a) het recht van eenieder te worden gehoord voordat jegens hem een voor hem nadelige individuele maatregel wordt genomen; b) het recht van eenieder om inzage te krijgen in het hem betreffende dossier, met inachtneming van het gerechtvaardigde belang van de vertrouwelijkheid en het beroeps- en het zakengeheim; c) de plicht van de betrokken diensten, hun beslissingen met redenen te omkleden. 3. Eenieder heeft recht op vergoeding door de Unie van de schade die door haar instellingen of door haar personeelsleden in de uitoefening van hun functies is veroorzaakt, overeenkomstig de algemene beginselen die de rechtsstelsels der lidstaten gemeen hebben. 4. Eenieder kan zich in een van de talen van de Verdragen tot de instellingen van de Unie wenden en moet ook in die taal antwoord krijgen.

    Artikel 41 is gebaseerd op het bestaan van de Unie als een rechtsgemeenschap waarvan de kenmerken zijn ontwikkeld door de jurisprudentie, die met name behoorlijk bestuur heeft erkend als algemeen rechtsbeginsel (zie onder meer het arrest van het Hof van 31 maart 1992 in zaak C-255/90 P, Burban, Jurispr. 1992, blz. I-2253, en de arresten van het Gerecht van eerste aanleg van 18 september 1995 in zaak T-167/94, Nölle, Jurispr. 1995, blz. II-2589, en van 9 juli 1999 in zaak T-231/97, New Europe Consulting e.a., Jurispr. 1999, blz. II-2403). De formulering van dit recht in de eerste twee leden vloeit voort uit de jurisprudentie (arresten van het Hof van 15 oktober 1987 in zaak 222/86, Heylens, Jurispr. 1987, blz. 4097, punt 15, van 18 oktober 1989 in zaak 374/87, Orkem, Jurispr. 1989, blz. 3283, van 21 november 1991 in zaak C-269/90, TU München, Jurispr. 1991, blz. I-5469; en de arresten van het Gerecht van eerste aanleg van 6 december 1994 in zaak T-450/93, Lisrestal, Jurispr. 1994, blz. II-1177, van 18 september 1995 in zaak T-167/94, Nölle, Jurispr. 1995, blz. II-2589) en, wat de motiveringsplicht betreft, uit artikel 296 van het Verdrag betreffende de werking van de Europese Unie (zie tevens de rechtsgrondslag in artikel 298 van het Verdrag betreffende de werking van de Europese Unie voor de aanneming van wetgeving in het belang van een open, doeltreffend en onafhankelijk Europees ambtenarenapparaat).

    Lid 3 behelst het recht dat nu door artikel 340 van het Verdrag betreffende de werking van de Europese Unie gewaarborgd is. Lid 4 geeft het recht weer dat nu door de artikelen 20, lid 2, onder d), en 25 van het Verdrag betreffende de werking van de Europese Unie gewaarborgd is. Overeenkomstig artikel 52, lid 2, van het Handvest vinden deze rechten toepassing onder de voorwaarden en binnen de grenzen die in de Verdragen zijn gesteld.

    Het recht op een doeltreffende voorziening in rechte, dat een belangrijk aspect van deze kwestie is, wordt gewaarborgd in artikel 47 van het Handvest.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.

    Article 46. Everyone has the right to address informational letters and petitions to government agencies, local authorities, and their officials. The procedure for responding to such letters and petitions is provided by law.

Εφ’ όσον ο ενδιαφερόμενος δεν ικανοποιείται εκ της αποφάσεως ή οσάκις ουδεμία απόφασις γνωστοποιήται προς αυτόν εντός της καθοριζομένης εν τη πρώτη παραγράφω του παρόντος άρθρου προθεσμίας δύναται ο ενδιαφερόμενος ν’ αγάγη ενώπιον αρμοδίου δικαστηρίου διά προσφυγής την υπόθεσιν, εις ην αφορά η αίτησις ή το παράπονον αυτού.
