Artykuł 49 - Zasady legalności oraz proporcjonalności kar do czynów zabronionych pod groźbą kary

1. Nikt nie może zostać skazany za popełnienie czynu polegającego na działaniu lub zaniechaniu, który według prawa krajowego lub prawa międzynarodowego nie stanowił czynu zabronionego pod groźbą kary w czasie jego popełnienia. Nie wymierza się również kary surowszej od tej, którą można było wymierzyć w czasie, gdy czyn zabroniony pod groźbą kary został popełniony. Jeśli ustawa, która weszła w życie po popełnieniu czynu zabronionego pod groźbą kary, przewiduje karę łagodniejszą, ta właśnie kara ma zastosowanie. 2. Niniejszy artykuł nie stanowi przeszkody w sądzeniu i karaniu osoby za działanie lub zaniechanie, które w czasie, gdy miało miejsce, stanowiło czyn zabroniony pod groźbą kary, zgodnie z ogólnymi zasadami uznanymi przez wspólnotę narodów. 3. Kary nie mogą być nieproporcjonalnie surowe w stosunku do czynu zabronionego pod groźbą kary.

    Artykuł ten odtwarza klasyczną regułę dotyczącą niedziałania wstecz przepisów prawnych i kar. Do artykułu dodano zasadę o działaniu wstecz prawa karnego o łagodniejszym charakterze, która istnieje w wielu Państwach Członkowskich i która jest zawarta w artykule 15 Paktu Praw Obywatelskich i Politycznych.

    Artykuł 7 europejskiej Konwencji o ochronie praw człowieka i podstawowych wolności brzmi: `

    1. Nikt nie może być uznany za winnego popełnienia czynu polegającego na działaniu lub zaniechaniu działania, który według prawa wewnętrznego lub międzynarodowego nie stanowił czynu zagrożonego karą w czasie jego popełnienia. Nie będzie również wymierzona kara surowsza od tej, którą można było wymierzyć w czasie, gdy czyn zagrożony karą został popełniony.

    2. Niniejszy artykuł nie stanowi przeszkody w sądzeniu i karaniu osoby winnej działania lub zaniechania, które w czasie popełnienia stanowiły czyn zagrożony karą według ogólnych zasad uznanych przez narody cywilizowane`.

    W ustępie 2 odniesienie do narodów `cywilizowanych` zostało skreślone; nie zmienia to znaczenia tego ustępu, który odnosi się w szczególności do zbrodni przeciwko ludzkości. Zgodnie z artykułem 52 ustęp 3 zagwarantowane prawo ma zatem takie samo znaczenie i zakres jak prawo zagwarantowane przez europejską Konwencję o ochronie praw człowieka i podstawowych wolności.

    Ustęp 3 przejmuje ogólną zasadę proporcjonalności kar do przestępstw, która jest zawarta we wspólnych tradycjach konstytucyjnych Państw Członkowskich i w orzecznictwie Trybunału Sprawiedliwości Wspólnot.

    Poniższe wyjaśnienia zostały pierwotnie sporządzone w ramach uprawnień Prezydium Konwentu, który opracował Kartę praw podstawowych Unii Europejskiej. Zostały uaktualnione pod kierunkiem Prezydium Konwentu Europejskiego z uwzględnieniem dostosowań dokonanych w tekście Karty przez ten Konwent (w szczególności w artykułach 51 i 52) oraz ewolucji prawa Unii. Mimo, że wyjaśnienia te nie posiadają wartości prawnej, są one cennym narzędziem wykładni przeznaczonym do wyjaśnienia postanowień Karty.

    Judgments are pronounced publicly, except in cases where the interests of a minor, a spouse, or a victim require otherwise.
    In accordance with the procedure provided by law, everyone is entitled to appeal a judgment rendered in his or her case to a higher court.
