    Key facts of the case:

    The case concerns a petition lodged before the Council of State for the annulment of a Decision by the Special Secretariat of the Ministry of Defence on the appointment of the Staff Council members for the General Headquarters of Aviation. The petitioner was appointed an alternate member of the Council and did not have voting rights. She was the only woman appointed to the Council, while all regular members were men. She filed her petition on the basis of art. 161 of the Code of Civil Servants, which stipulates that each sex must be represented in the Council at minimum 1/3 of its members. She complained that her appointment as an alternate member without voting rights violates the spirit and aims of this provision as an instrument promoting gender equality.

    Key legal question raised by the Court:

    The key legal question brought forth for the Court’s consideration concerns the interpretation of the aforementioned provision of the Code of Civil Servants, in light of the obligation to promote substantive equality between men and women in the field of employment, stemming from Constitutional provisions and EU law, including article 23 of the Charter. Specifically, the question is whether the provision must be interpreted as mandating that the members appointed to satisfy the requirements set therein should be able to actively participate in decision-making, or if it is sufficient for its purposes that they are appointed as alternate members without voting rights

    Outcome of the case:

    The Court ruled in favour of the petitioner. Specifically, it found that in order to achieve the goal of effective participation of women in the decision-making process each sex must be represented as a regular member with a right to vote at least at the rate stipulated in the provision in question. If this is not feasible, the only member of the underrepresented sex (as is the case here) must be appointed a regular member with full voting rights. Only if none of the above options are feasible is it acceptable to have a Staff Council comprising members of only one sex. The Court reached its decision citing, among others, articles 153 (1)(i) and 157 TFEU, article 23 of the Charter, Directive 2006/54/EU, and Council Recommendation 96/694/EC.

    Article 161 of the Code of Civil Servants aims to achieve balanced participation of men and women in the Staff councils as a measure aimed at promoting effective gender equality in the field of employment as enshrined at national level (see Articles 4par. 1 and 2 and 116 par.2 of the Constitution) and Union law (See Articles 153 (1) and 157 TEU, Article 23 of the Charter of Fundamental Rights, Directive 2006/54 / EC of the European Parliament and of the Council the application of the principle of equal opportunities and equal treatment of men and women in matters of employment, Council and Commission Recommendation 96/694 / EC on the balanced participation of women and men in the decision-making process, OJ L 319) and international levels (see United Nations Convention on the Elimination of All Forms of forms of discrimination against women, ratified by Law No 1342/1983, A 39, International Labor Convention 111 on Discrimination in Employment and Occupation, ratified by Law No 1423/1984, A 29, as well as Recommendation of the Committee of Ministers of the Council of Europe Rec (2003) 3 / 12.5.2003 on the balanced participation of women and men political and public decision-making). In order to achieve this objective and to allow the participation of both sexes in the decision-making process of Staff Councils , each gender must be represented through regular members with a vote at the specified rate (1/3 of the total members of the Council). That is, in the five-member boards provided for in the transitional provisions of article 30 par. 3 law 4369/2016 and falling within the scope of article 161 of theCode of Civil Servants,, two members must belong to one sex and three to the other (5x1 / 3 = 1.66). If this is not feasible, at least one regular member with a vote should belong to the under-represented sex and only if this is not feasible would it be legal for this collective body to comprise regular members of only one sex(see 4400/2011, see Council of Ministers 2977/2014, 1721/2009 on the similar provision of article 6, paragraph 1, paragraph 2839/2000, A 196, as well as the circulars of the Ministry of Interior, DIDAF .35.14 / 916 /  4084 / 15.2.2007 and DIDAD / Φ.37.19 / 1152 / οικ.18242 / 5.7.2016).

    Επειδή, με την αναφερθείσα διάταξη του άρθρου 161 του Υπαλληλικού Κώδικα επιδιώκεται η ισόρροπη συμμετοχή ανδρών και γυναικών στα υπηρεσιακά συμβούλια ως μέτρο που αποσκοπεί στην προώθηση της πραγματικής ισότητας των φύλων στον χώρο της απασχόλησης, όπως αυτή κατοχυρώνεται σε επίπεδο εθνικό (βλ. άρθρα 4 παρ. 1 και 2 και 116 παρ. 2 του Συντάγματος), ενωσιακό (βλ. άρθρα 153 παρ. 1 εδαφ. θ` και 157 Σ.Λ.Ε.Ε., άρθρο 23 Χάρτη Θεμελιωδών Δικαιωμάτων, οδηγία 2006/54/ΕΚ για την εφαρμογή της αρχής των ίσων ευκαιριών και ίσης μεταχείρισης ανδρών και γυναικών σε θέματα εργασίας και απασχόλησης, ΕΕ L 204, όπως επίσης και την σύσταση του Συμβουλίου 96/694/ΕΚ για την ισόρροπη συμμετοχή γυναικών και ανδρών στη διαδικασία λήψης αποφάσεων, ΕΕ L 319) και διεθνές (βλ. Σύμβαση των Ηνωμένων Εθνών για την εξάλειψη όλων των μορφών διακρίσεων κατά των γυναικών, κυρωθείσα με τον ν. 1342/1983, Α΄ 39, Διεθνή Σύμβαση Εργασίας 111 για τη διάκριση στην απασχόληση και στο επάγγελμα, κυρωθείσα με τον ν. 1423/1984, Α΄ 29, όπως επίσης και την σύσταση της Επιτροπής των Υπουργών του Συμβουλίου της Ευρώπης Rec(2003)3/12.5.2003 για την ισόρροπη συμμετοχή γυναικών και ανδρών στη λήψη πολιτικών και δημόσιων αποφάσεων). Προκειμένου να επιτευχθεί ο σκοπός αυτός και να δοθεί η δυνατότητα έμπρακτης συμμετοχής και των δύο φύλων στην διαδικασία λήψης αποφάσεων από τα υπηρεσιακά συμβούλια, το κάθε φύλο πρέπει να εκπροσωπείται σε επίπεδο τακτικού μέλους με ψήφο κατά το οριζόμενο ποσοστό (1/3 επί του συνόλου των μελών του Συμβουλίου). Δηλαδή, στα πενταμελή υπηρεσιακά συμβούλια που προβλέπονται στις μεταβατικές διατάξεις του άρθρου 30 παρ. 3 ν. 4369/2016 και υπάγονται στο πεδίο εφαρμογής του άρθρο 161 του Υπαλληλικού Κώδικα, δύο μέλη πρέπει να ανήκουν στο ένα φύλο και τρία στο άλλο (5Χ1/3=1,66). Εάν αυτό δεν είναι εφικτό, θα πρέπει το ένα τουλάχιστον από τα τακτικά μέλη με ψήφο να ανήκει στο υποεκπροσωπούμενο φύλο και μόνο εάν ούτε αυτό είναι εφικτό, είναι νόμιμη η συγκρότηση του συλλογικού αυτού οργάνου μόνο με τακτικά μέλη που ανήκουν όλα στο ίδιο φύλο (βλ. ΣτΕ 4400/2011, πρβλ. ΣτΕ 2977/2014, 1721/2009 επί της παρόμοιας διάταξης του άρθρου 6 παρ. 1 εδ. α΄ ν. 2839/2000, Α΄ 196, καθώς και τις εγκυκλίους του Υπουργείου Εσωτερικών ΔΙΔΑΔ/Φ.35.14/916/οικ. 4084/15.2.2007 και ΔΙΔΑΔ/Φ.37.19/ 1152/οικ.18242/5.7.2016).
