    This report provides a partial update on the findings of the 2017 European Union Agency for Fundamental Rights (FRA) report Surveillance by intelligence services: Fundamental rights safeguards and remedies in the EU. It was prepared at the request of the European Parliament, which asked FRA to update its 2017 findings to support the work of its committee of inquiry to investigate the use of Pegasus and equivalent surveillance spyware (PEGA).

    Η ραγδαία ανάπτυξη της τεχνολογίας των πληροφοριών έχει επιτείνει την ανάγκη για ισχυρή προστασία των δεδομένων προσωπικού χαρακτήρα. Το δικαίωμα στην εν λόγω προστασία διασφαλίζεται μέσω νομικών πράξεων τόσο της Ευρωπαϊκής Ένωσης (ΕΕ), όσο και του Συμβουλίου της Ευρώπης. Η διασφάλιση του σημαντικού αυτού δικαιώματος συνεπάγεται νέες και σημαντικές προκλήσεις, καθώς οι τεχνολογικές εξελίξεις επεκτείνουν τα όρια πεδίων όπως η παρακολούθηση, η υποκλοπή επικοινωνιών και η αποθήκευση δεδομένων. Το παρόν εγχειρίδιο έχει σχεδιαστεί κατά τέτοιον τρόπο ώστε να βοηθήσει τους επαγγελματίες του νομικού κλάδου που δεν είναι ειδικευμένοι στον τομέα της προστασίας δεδομένων να εξοικειωθούν με το αναδυόμενο αυτό πεδίο του δικαίου.

The EU plays a pioneering role in the protection of personal data. The Charter of Fundamental Rights of the EU enshrines the right to data protection as an autonomous fundamental right. Despite the underlying importance and centrality of the right to data protection in the EU, many deficiencies are present in the data protection system. Upon request of the European Parliament, the FRA presented an expert opinion on the fundamental rights compliance of a proposal for a Directive on the use of Passenger Name Record (PNR) data for the prevention, detection, investigation and prosecution of terrorist offences and serious crime (COM(2011) 32 final). This was a follow-up request to the opinion of the FRA related to PNR from October 2008.

When used as an investigation technique in the context of law enforcement, ethnic profiling is often referred to as “criminal profiling”. This type of profiling uses indicators such as physical features, appearance or behaviour to give a “suspect description”. Profiling becomes unlawful when it is discriminatory.

The FRA opinion paper presents a selection primarily based on the current thematic priorities of the Agency and are inspired by the factual evidence the Agency's own research has so far produced. This contribution is therefore just a first step in a long term approach of the Agency to follow and address the issues in the Stockholm Programme.
