Austria / Constitutional Court / B166/2013 Claim according to Art. 144 Constitutional Act because of violation of constitutionally guaranteed rights

Key facts of the case:

Two married Dutch men, living in Tyrol, wanted to repeat their marriage in Austria. This was repealed, stating that marriage cannot be achieved by homosexual couples, but only registered partnership. Marriage is Austria is assessed using Austrian law. The couple filed a claim to the constitutional court according to Art. 144 of the Constitution, stating that they were violated in their constitutional rights, namely also Art. 8 and 14 of the ECHR and Art. 21 CFR.

3.2. The claimants invoke Art. 21 (1) CFR. Insofar the CFR enshrines rights, which correlate with rights of the ECHR (in this case Art. 14), they have the same meaning and scope, as they are given in the convention (Art. 52 (3) sentence 1 CFR). Art. 52 (3) second sentence CFR furthermore states that this provision “shall not prevent Union law providing more extensive protection”.

3.2. Die Beschwerdeführer berufen sich auch auf Art21 Abs1 GRC. Soweit die GRC Rechte enthält, die den durch die EMRK garantierten Rechten – im vorliegenden Fall kommt insbesondere Art14 EMRK in Frage – entsprechen, haben sie die gleiche Bedeutung und Tragweite, wie sie ihnen in der genannten Konvention verliehen wird (Art52 Abs3 Satz 1 GRC). Art52 Abs3 Satz 2 GRC sagt darüber hinaus aber auch, dass diese Bestimmung "dem nicht entgegen[steht], dass das Recht der Union einen weitergehenden Schutz gewährt."
