Key facts of the case:
Both individuals were held responsible to have occupied, in their function as managing directors of an Austrian limited liability company, 99 Hungarian nationals without the necessary labour law related permits and were thus convicted to 99 fines in an amount of EUR 2,000 to EUR 4,000 each. Both individuals appealed against this decision.
It is out of the question that the individual fines are disproportionate (unverhältnismäßig) pursuant to Article 49 of the Charter as argued by the appealing parties.
