The applicant, as a Deputy Director of the Sofia Directorate of the Interior (SDI) (Столична дирекция на вътрешните работи, СДВР), issued an order for enforcing coercive administrative measures according to Article 76, Paragraph 9 of the Bulgarian Identity Documents Act (Закон за българските документи за самоличност) prohibiting a child from travelling abroad without the parents’ written consent. This order was held illegal by the Sofia Administrative Court (Софийски административен съд). The deputy director requested cassation of this decision by the Supreme Administrative Court. He claims that the best interest of the child had not been taken into account, since the mother and the child had not been duly summoned and therefore represented during the trial at the Sofia Administrative Court.
