Key facts of the case:
The applicant, who had previously been charged with the offence of sending threatening messages via his mobile phone, applied to the Supreme Court for a certiorari order in order to cancel two orders issued by the district court two months earlier for the disclosure of his telephone data. The applicant argued that the two orders of disclosure issued by the district court violated articles 7 and 8 of the EU Charter of Fundamental Rights.

Fundamental Rights and in the light of the relevant European Court of Justice reports in Digital Rights Ireland Ltd v. . C293 / 12 and C594 / 12 dated 8.4.14 - by which the WEU completely repealed Directive 2006/24 / EC for failure to comply with the principles of proportionality and clarity in preservation of telecommunications data - and the harmonizing substantive nature of the present Law 183 (1) / 2007.
On the substance, i.e. on the existence of a debatable case, the court is satisfied that this element has been established under Articles 7 and 8 of the Charter of Fundamental Rights and in accordance with the relevant findings of the Court of the Justice of the EU in the case of Digital Rights Ireland Ltd v. Minister for Communications, Marine and Natural Resources and others, C293 / 12 and C594 / 12 dated 04.08.14 - by which the CJEU invalidated entirely Directive 2006/24/EC, for failure to comply with the principles of proportionality and clarity in retention of telecommunications data - and the harmonizing essential nature of the legislation under consideration, Law 183 (1) / 2007.
Ως προς την ουσία, της ύπαρξης δηλαδή συζητήσιμης υπόθεσης, το δικαστήριο έχει ικανοποιηθεί ότι το στοιχείο αυτό έχει τεκμηριωθεί με βάση τα άρθρα 7 και 8 του Χάρτη των Θεμελιωδών Δικαιωμάτων και σε συνάρτηση με τις σχετικές αναφορές του Ευρωπαϊκού Δικαστηρίου στην υπόθεση Digital Rights Ireland Ltd v. Minister for Communications Marine and Natural Resources and others, C293/12 και C594/12 ημερομηνίας 8.4.14 - με την οποία το ΔΕΕ ακύρωσε εξ ολοκλήρου την Οδηγία 2006/24/ΕΚ, λόγω μη τήρησης των αρχών της αναλογικότητας και της σαφήνειας στη διατήρηση των τηλεπικοινωνιακών δεδομένων - και την εναρμονιστική ουσιαστικά φύση του υπό κρίση Νόμου 183(1)/2007.
