The applicant, Mr. M.A.A. applied for asylum in the Czech Republic. The Interior Ministry rejected the application on the grounds of the Dublin Regulation (the Czech Republic is not responsible as he entered the EU in Malta). The applicant challenged the decision in the Regional Court in Brno. At the same time, he applied at the Regional Court for a suspensive effect to be granted to the legal action. The suspensive effect application was dismissed by the Regional Court. This decision was quashed by the Constitutional Court on the grounds of a lack of justification.
