The applicant, Ms. S.T., sued Česká spořitelna and requested that the bank fees she had paid are returned to her. The bank fees were related to a credit contract between the applicant and the bank (Česká spořitelna). On the basis of this contract, the bank charged the applicant 150 CZK per month as an administration fee relating to the credit, without persuasively explanaining the purpose of this monthly fee. The applicant claimed that the bank fee agreement is invalid because it is vague and is a contradiction of good morals. The District Court in Prague 4 dismissed the action. The applicant filed a constitutional complaint against this decision.
