According to section 19 of the TCN Act recognised refugees are entitled to reunite with their family members abroad with preferential condition six months from their recognition by Hungarian authorities. A former unaccompanied minor refugee's family reunification was denied due to the omission of the consular staff to properly register the application of the family members. The Curia found that in case it is not due to the applicant's fault to miss the six months deadline for the preferential treatment of the request for family reunification (e.g the privilege not to certify that the applicants have the financial means to stay in the receiving country) the applicants are entitled to exculpate themselves and benefit from the preferential conditions applicable for refugees.
