Key facts of the case:

Claimant (a company) submitted a cassation complain to the Latvian Supreme Court complaining about the lower instance Latvian courts which recognized the judgement by default by the Supreme Court of the of the United Kingdom. The complaining company insisted it did not receive the notification of the litigation process in the United Kingdom, thus there was a violation of the right to fair trial and, hence, the judgement was not recognizable under the Latvian public order clause. The Senate of the Supreme Court in Latvia referred questions to the Court of Justice of the European Union (CJEU) for preliminary ruling asking if the Latvian court had a competence to review the evidence before recognizing the judgement under the Regulation No.44/2001 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters.
