Key facts of the case:
The applicant, the State Border Guard Service under the Republic of Lithuania Ministry of Internal Affairs, submitted a request to the court asking to quash the decision of defendant, the National officers trade union association, refusing to impose the disciplinary sanction (notification), to the senior specialist V.B. Appeal to the Supreme Administrative Court of Lithuania was submitted by the defendant.
Meanwhile, the European Union Charter of Fundamental Rights refer to the universal principle and establishes that everyone has the freedom of association with others at all levels, in particular in political, professional and civil society areas, including the right to form and join trade unions for the protection of their interests (Article 12 (1) of the Charter).
