Key findings

In its 2015 report on Estonia, ECRI recommended that the authorities introduce an amendment to Article 151 of the Criminal Code (incitement to hatred). However, Article 151 has not been amended. In ECRI’s view, Article 151 cannot be applied in line with its recommendation by way of interpretation, therefore this recommendation has not been implemented. ECRI also recommended that the authorities put in place a system to collect data and produce statistics on racist and homo/transphobic hate speech and violence. ECRI takes positive note that significant steps have been taken for that and considers the recommendation partially implemented.
