Artículo 11 - Libertad de expresión y de información

1. Toda persona tiene derecho a la libertad de expresión. Este derecho comprende la libertad de opinión y la libertad de recibir o comunicar informaciones o ideas sin que pueda haber injerencia de autoridades públicas y sin consideración de fronteras.

2. Se respetan la libertad de los medios de comunicación y su pluralismo.

      1. El artículo 11 corresponde al artículo 10 del CEDH, que dice lo siguiente:
      `1. Toda persona tiene derecho a la libertad de expresión. Este derecho comprende la libertad de opinión y la libertad de recibir o de comunicar informaciones o ideas sin que pueda haber injerencia de autoridades públicas y sin consideración de fronteras. El presente artículo no impide que los Estados sometan las empresas de radiodifusión, de cinematografía o de televisión a un régimen de autorización previa.
      2. El ejercicio de estas libertades, que entrañan deberes y responsabilidades, podrá ser sometido a ciertas formalidades, condiciones, restricciones o sanciones previstas por la ley, que constituyan medidas necesarias, en una sociedad democrática, para la seguridad nacional, la integridad territorial o la seguridad pública, la defensa del orden y la prevención del delito, la protección de la salud o de la moral, la protección de la reputación o de los derechos ajenos, para impedir la divulgación de informaciones confidenciales o para garantizar la autoridad y la imparcialidad del poder judicial.`
      En virtud del apartado 3 del artículo 52 de la Carta, este derecho tiene el mismo sentido y alcance que el garantizado por el CEDH y las limitaciones de que puede ser objeto este derecho no pueden por lo tanto sobrepasar las establecidas en el apartado 2 de su artículo 10, sin perjuicio de las restricciones que puede imponer el Derecho de la competencia de la Unión a la potestad de los Estados miembros de establecer los regímenes de autorización mencionados en la tercera frase del apartado 1 del artículo 10 del CEDH.
      2. El apartado 2 del presente artículo precisa las consecuencias del apartado 1 con respecto a la libertad de los medios de comunicación. Se basa en particular en la jurisprudencia del Tribunal de Justicia relativa a la televisión, especialmente en el asunto C-288/89 (sentencia de 25 de julio de 1991, Stichting Collectieve Antennevoorziening Gouda y otros, Rec. 1991, p. I-4007) y en el Protocolo sobre el sistema de radiodifusión pública de los Estados miembros, anejo al Tratado CE y ahora a los Tratados, así como en la Directiva 89/552/CEE del Consejo (véase en particular su considerando n.o 17).

Freedom of expression entails the right to express, disseminate and receive information, opinions and other communications without prior prevention by anyone. More detailed provisions on the exercise of the freedom of expression are laid down by an Act. Provisions on restrictions relating to pictorial programmes that are necessary for the protection of children may be laid down by an Act. Documents and recordings in the possession of the authorities are public, unless their publication has for compelling reasons been specifically restricted by an Act. Everyone has the right of access to public documents and recordings.

      Article 41. Everyone has the right to abide by his or her opinions and beliefs. No one may be compelled to change his or her opinions or beliefs.
      Beliefs are no defence for violating the law.
      No one may be held legally liable for his or her beliefs.
      Article 42. Government agencies, local authorities, and their officials may not gather or store information about the beliefs of a citizen of Estonia against the citizen’s free will.
      Article 44. Everyone is entitled to free access to information disseminated for public use.
      Pursuant to a procedure provided by law, all government agencies, local authorities, and their officials have a duty to provide information about their activities to any citizen of Estonia at his or her request, except for information whose disclosure is prohibited by law and information intended exclusively for internal use.
      Pursuant to a procedure provided by law, any citizen of Estonia is entitled to access information about himself or herself held by government agencies and local authorities and in government and local authority archives. This right may be circumscribed pursuant to law to protect the rights and freedoms of others, to protect the confidentiality of a child’s filiation, and in the interests of preventing a criminal offence, apprehending the offender, or of ascertaining the truth in a criminal case.
      Unless otherwise provided by law, citizens of foreign states and stateless persons in Estonia enjoy the rights specified in paragraphs two and three of this section equally with citizens of Estonia.
      Article 45. Everyone has the right to freely disseminate ideas, opinions, beliefs and other information by word, print, picture or other means. This right may be circumscribed by law to protect public order, public morality, and the rights and freedoms, health, honour and good name of others. This right may also be circumscribed by law in respect of public servants employed by the national government and local authorities, or in order to protect a state secret, trade secret or information received in confidence which has become known to the public servant by reason of his or her office, and to protect the family and private life of others, as well as in the interests of the administration of justice.
      There is no censorship.

      § 40. Igaühel on südametunnistuse-, usu- ja mõttevabadus. Kuulumine kirikutesse ja usuühingutesse on vaba. Riigikirikut ei ole. Igaühel on vabadus nii üksinda kui ka koos teistega, avalikult või eraviisiliselt täita usutalitusi, kui see ei kahjusta avalikku korda, tervist ega kõlblust.
      § 41. Igaühel on õigus jääda truuks oma arvamustele ja veendumustele. Kedagi ei tohi sundida neid muutma. Veendumustega ei saa vabandada õiguserikkumist. Kedagi ei saa veendumuste pärast võtta õiguslikule vastutusele.
      § 42. Riigiasutused, kohalikud omavalitsused ja nende ametiisikud ei tohi Eesti kodaniku vaba tahte vastaselt koguda ega talletada andmeid tema veendumuste kohta.
      § 44. Igaühel on õigus vabalt saada üldiseks kasutamiseks levitatavat informatsiooni. Kõik riigiasutused, kohalikud omavalitsused ja nende ametiisikud on kohustatud seaduses sätestatud korras andma Eesti kodanikule tema nõudel informatsiooni oma tegevuse kohta, välja arvatud andmed, mille väljaandmine on seadusega keelatud, ja eranditult asutusesiseseks kasutamiseks mõeldud andmed. Eesti kodanikul on õigus seaduses sätestatud korras tutvuda tema kohta riigiasutustes ja kohalikes omavalitsustes ning riigi ja kohalike omavalitsuste arhiivides hoitavate andmetega. Seaduse alusel võib seda õigust piirata teiste inimeste õiguste ja vabaduste ning lapse põlvnemise saladuse kaitseks, samuti kuriteo tõkestamise, kurjategija tabamise või kriminaalmenetluses tõe väljaselgitamise huvides. Kui seadus ei sätesta teisiti, siis on käesoleva paragrahvi lõigetes kaks ja kolm nimetatud õigused võrdselt Eesti kodanikuga ka Eestis viibival välisriigi kodanikul ja kodakondsuseta isikul.
      § 45. Igaühel on õigus vabalt levitada ideid, arvamusi, veendumusi ja muud informatsiooni sõnas, trükis, pildis või muul viisil. Seda õigust võib seadus piirata avaliku korra, kõlbluse, teiste inimeste õiguste ja vabaduste, tervise, au ning hea nime kaitseks. Seadus võib seda õigust piirata ka riigi ja kohalike omavalitsuste teenistujatel neile ameti tõttu teatavaks saanud riigi- või ärisaladuse või konfidentsiaalsena saadud informatsiooni ning teiste inimeste perekonna- ja eraelu kaitseks, samuti õigusemõistmise huvides. Tsensuuri ei ole.

      4. Seizure of newspapers or other printed matter is not allowed without the written permission of the Attorney-General of the Republic, which must be confirmed by the decision of a competent court within a period not exceeding seventy-two hours, failing which the seizure shall be lifted.
      5. Nothing in this Article contained shall prevent the Republic from requiring the licensing of sound and vision broadcasting or cinema enterprises.

      5. Ουδέν εκ των διαλαμβανομένων εις το παρόν άρθρον εμποδίζει την Δημοκρατίαν ν’ απαιτή την έκδοσιν αδείας ή λειτουργίας επιχειρήσεων ραδιοφωνικών ή κινηματογραφικών ή τηλεοράσεως.

      Freedom of thought and expression shall be guaranteed.
      Freedom of expression shall particularly encompass freedom of the press and other media, freedom of speech and public opinion, and free establishment of all institutions of public communication.
      Censorship shall be forbidden. Journalists shall have the right to freedom of reporting and access to information.
      The right to access to information held by any public authority shall be guaranteed.
      Restrictions on the right to access to information must be proportionate to the nature of the need for such restriction in each individual case and necessary in a free and democratic society, as stipulated by law.
      The right to correction is guaranteed to anyone whose constitutionally and legally established rights have been violated by public communication.

      Članak 38.
      Jamči se sloboda mišljenja i izražavanja misli.
      Sloboda izražavanja misli obuhvaća osobito slobodu tiska i drugih sredstava priopćavanja, slobodu govora i javnog nastupa i slobodno osnivanje svih ustanova javnog priopćavanja.
      Zabranjuje se cenzura. Novinari imaju pravo na slobodu izvještavanja i pristupa informaciji.
      Jamči se pravo na pristup informacijama koje posjeduju tijela javne vlasti. Ograničenja prava na pristup informacijama moraju biti razmjerna naravi potrebe za ograničenjem u svakom pojedinom slučaju te nužna u slobodnom i demokratskom društvu, a propisuju se zakonom.
      Jamči se pravo na ispravak svakomu komu je javnom viješću povrijeđeno Ustavom i zakonom utvrđeno pravo.

Die Einstellung von Druckschriften und die Erlassung eines Postverbotes gegen solche findet nicht mehr statt. Die bisher verfügten Einstellungen und Postverbote sind aufgehoben. Die volle Freiheit der Presse ist hergestellt. 3. Die Ausnahmsverfügungen betreffs des Vereins- und Versammlungsrechtes sind aufgehoben. Die volle Vereins- und Versammlungsfreiheit ohne Unterschied des Geschlechts ist hergestellt.
