    L’évolution rapide des technologies de l’information souligne la nécessité d’une protection
    solide des données à caractère personnel, un droit qui est garanti à la fois par les instruments de
    l’Union européenne (UE) et du Conseil de l’Europe (CdE). Les avancées technologiques repoussent
    notamment les frontières de la surveillance, de l’interception des communications et de la
    conservation des données, ce qui met le droit à la protection des données face à des défis
    majeurs. Le présent manuel est conçu de façon à permettre aux praticiens du droit qui ne sont pas
    spécialisés dans la protection des données de se familiariser avec ce nouveau domaine du droit.
    Il présente un aperçu des cadres légaux applicables de l’UE et du CdE. Il explique la jurisprudence
    essentielle et résume les principaux arrêts de la Cour de justice de l’Union européenne et de
    la Cour européenne des droits de l’homme. Il propose, en outre, des illustrations pratiques
    basées sur des scénarios hypothétiques des divers problèmes rencontrés dans ce domaine en
    évolution constante.

This second volume, ‘Surveillance by intelligence services: fundamental rights safeguards and remedies in the EU’, explores legal changes since the first volume in 2015 and how these laws are applied in practice. It is based on data from all EU Member States on the legal framework governing surveillance and complemented by field research in seven Member States: Belgium, France, Germany, Italy, the Netherlands, Sweden and the UK. This involved more than 70 interviews with a range of stakeholders related to surveillance. These included overseers and controllers from the executive, indedepent expert bodies, parliamentary committees, the judiciary and actors from the civil society. This report is FRA’s second publication addressing a European Parliament request for in-depth research on the impact of surveillance on fundamental rights. It updates FRA’s 2015 legal analysis on the topic, and supplements that analysis with field-based insights gained from extensive interviews with diverse experts in intelligence and related fields, including its oversight.

In 2006 the EU issued its Data Retention Directive. According to the Directive, EU Member States had to store electronic telecommunications data for at least six months and at most 24 months for investigating, detecting and prosecuting serious crime. In 2016, with an EU legal framework on data retention still lacking, the CJEU further clarified what safeguards are required for data retention to be lawful.This paper looks at amendments to national data retention laws in 2016 after the Digital Rights Ireland judgment.

EU Member States are increasingly involved in border management activities on the high seas, within – or i cooperation with – third countries, and at the EU’s borders. Such activities entail risks of violating the principle of non-refoulement, the cornerstone of the international legal regime for the protection of refugees, which prohibits returning individuals to a risk of persecution. This report aims to encourage fundamental-rights compliant approaches to border management, including by highlighting potential grey areas.

Les États membres de l’UE participent de plus en plus à des activités de gestion des frontières en haute mer, sur le territoire de pays tiers, ou en coopération avec ces derniers, ainsi qu’aux frontières de l’UE. Ces activités peuvent comporter des risques de violation du principe de non-refoulement, la pierre angulaire du régime international juridique assurant la protection des réfugiés, qui interdit le retour d’individus vers une situation de risque de persécution. Ces orientations présentent des suggestions spécifiques sur les moyens de réduire les risques de refoulement dans ces situations. Elles constituent un outil pratique élaboré à l’aide de contributions d’experts réunis à Vienne en mars 2016.
