Facial recognition technology (FRT) makes it possible to compare digital facial images to determine whether they are of the same person. Comparing footage obtained from video cameras (CCTV) with images in databases is referred to as ‘live facial recognition technology’. Examples of national law enforcement authorities in the EU using such technology are sparse – but several are testing its potential. This paper therefore looks at the fundamental rights implications of relying on live FRT, focusing on its use for law enforcement and border-management purposes.
As part of the background research for the Agency’s project on ‘Artificial intelligence (AI), Big Data and Fundamental Rights’, FRA has collected information on AI-related policy initiatives in EU Member States and beyond in the period 2016-2020. The collection currently includes about 350 initiatives.
Fundamental Rights Report 2019: 2018 was a landmark year for data protection. New EU rules took effect and complaints of breaches increased significantly.

This Opinion by the European Union Agency for Fundamental Rights (FRA) aims to inform the European Parliament’s position concerning the legislative proposal for a Regulation on strengthening the security of identity cards of European Union (EU) citizens and of residence documents issued to EU citizens and their family members exercising their right of free movement. It focuses on the processing of biometric data and complements the opinion published by the European Data Protection Supervisor (EDPS).

In November 2017, the European Commission requested FRA’s support in evaluating the impact on fundamental rights of the European Border Surveillance System (Eurosur) Regulation. Further to this request, FRA reviewed the work of the European Border and Coast Guard Agency (Frontex) and analysed cooperation agreements concluded by EU Member States with third countries which are relevant for the exchange of information for the purposes of Eurosur. This report presents the main findings of such review.

European Commission presented the proposal on 16 May 2018 and EU legislators are
currently discussing it.

The year 2017 brought both progress and setbacks in terms of rights protection. The European Pillar of Social Rights marked an important move towards a more ‘social Europe’. But, as experiences with the EU Charter of Fundamental Rights underscore, agreement on a text is merely a first step. Even in its eighth year as the EU's binding bill of rights, the Charter's potential was not fully exploited, highlighting the need to more actively promote its use.

A technológiai fejlesztések kiterjesztik például a felügyelet, a beszélgetések lehallgatása és az adatok tárolása határait, ami új és hatalmas kihívásokat állít e jog biztosítása elé. Ez a kézikönyv azon gyakorló jogászok számára készült, akiknek a jog e fejlődő területe nem a szakterülete.

Az Európai Unióban a civil társadalmi szervezetek alapvető szerepet játszanak az alapvető jogok előmozdításában, ez ugyanakkor egyre nehezebb számukra a különböző jogi és gyakorlati korlátozások miatt. Jóllehet valamennyi uniós tagállamban léteznek kihívások, azok konkrét természete és mértéke eltérő. Az ezzel kapcsolatos adatok és kutatások – összehasonlító kutatást is ideértve – gyakran hiányoznak.
Az FRA jelentése ezért áttekinti az EU-ban emberi jogi területen működő, civil társadalmi szervezetek előtt álló kihívások különböző típusait és tendenciáit. Kiemeli továbbá azokat
az ígéretes gyakorlatokat, amelyek képesek ezeket az aggasztó tendenciákat ellensúlyozni.

Azzal, hogy a terrorizmus, a kibertámadások és a határokon átnyúló kifinomult bűnözői hálózatok egyre növekvő veszélyt jelentenek az EU-ban, a hírszerző szolgálatok munkája sürgetőbbé, összetettebbé és nemzetközibbé vált. Egy ilyen munka komolyan sértheti az alapvető jogokat, különösen a magánélethez és a személyes adatok védelméhez fűződő jogokat. Míg a folyamatos technológiai fejlődés súlyosbíthatja e jogsértések veszélyét, a hatékony felügyelet és jogorvoslat korlátozhatja a visszaélések lehetőségét.
