3. pants- Tiesības uz personas neaizskaramību

1. Ikvienai personai ir tiesības uz fiziskās un garīgās neaizskaramības ievērošanu.

2. Medicīnas un bioloģijas jomā jo īpaši jāievēro:

a) attiecīgās personas apzināta un brīva piekrišana saskaņā ar tiesību aktos noteiktām procedūrām;

b) eigēniskās prakses aizliegums, jo īpaši, ja tās mērķis ir cilvēku selekcija;

c) aizliegums izmantot cilvēka ķermeni un tā daļas kā peļņas avotu;

d) cilvēku reproduktīvās klonēšanas aizliegums.

    1. Tiesa 2001. gada 9. oktobra spriedumā lietā C-377/98 98 Nīderlande/Eiropas Parlaments un Padome, Recueil, 2001., 7079. lpp., 70. un 78. līdz 80. punktā apstiprināja, ka cilvēka pamattiesības uz cieņu pieder pie Savienības tiesībām un medicīnas un bioloģijas sakarā pie tām pieder arī orgānu donora un saņēmēja apzināta un brīva piekrišana.
    2. Hartas 3. panta principi jau ir ietverti Eiropas Padomes pieņemtajā Cilvēktiesību un biomedicīnas konvencijā (ETS 164 un papildu protokols ETS 168). Harta neparedz atkāpšanos no šiem principiem un tādēļ aizliedz vienīgi reproduktīvo klonēšanu. Tā nedz atļauj, nedz aizliedz klonēšanu citās formās. Tādējādi tā nekādi neliedz likumdevējiem aizliegt klonēšanu citās formās.
    3. Atsauces uz eigēnisko praksi, jo īpaši uz tādu, kuras mērķis ir veikt cilvēku selekciju, attiecas uz iespējamām situācijām, kad inter alia tiek organizētas un īstenotas selekcijas programmas ar sterilizācijas kampaņām, piespiedu grūtniecību, obligātas etniskas laulības, uz visām darbībām, kas tiek atzītas par starptautiskiem noziegumiem Starptautiskās krimināltiesas statūtos, kas pieņemti 1998. gada 17. jūlijā Romā (sk. minēto statūtu 7. panta 1. punkta g) apakšpunktu).

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Šie paskaidrojumi ir sagatavoti Eiropas Savienības Pamattiesību hartu izstrādājušā Konventa prezidija vadībā. Tie ir atjaunināti Eiropas Konventa prezidija vadībā, ņemot vērā Konventa izdarītos Hartas teksta (jo īpaši 51. un 52. panta) precizējumus un Savienības tiesību turpmāku attīstību. Kaut arī šiem paskaidrojumiem nav juridiska spēka, tie ir vērtīgi interpretācijas līdzekļi, kas paredzēti Hartas noteikumu izskaidrošanai.
