Artikolu 11 - Il-libertà ta' l-espressjoni u ta' l-informazzjoni

1. Kull persuna għandha d-dritt għal-libertà ta' l-espressjoni. Dan id-dritt jinkludi l-libertà ta' opinjoni u l-libertà li tirċievi jew tagħti informazzjoni u ideat mingħajr indħil mill-awtorità pubblika u indipendentement mill-fruntieri.

2. Il-libertà u l-pluraliżmu tal-mezzi tal-komunikazzjoni għandhom ikunu rrispettati.

  • Text:

    1. L-Artikolu 11 jikkorrispondi għall-Artikolu 10 tal-KEDB li jinqara kif ġej:
    `1. Kulħadd għandu d-dritt għal-libertà ta' espressjoni. Dan id-dritt jinkludi l-libertà li jkollu opinjoni u li jirċievi u jagħti informazzjoni u ideat mingħajr indħil mill-awtorità pubblika u mingħajr ma jittieħed kont ta' fruntieri. Dan l-Artikolu ma għandux jimpedixxi Stati milli jeħtieġu liċenzi għax-xandir, televiżjoni jew impriżi ċinematografiċi.
    2. L-eżerċizzju ta' dawn il-libertajiet, billi jġib miegħu dmirijiet u responsabbiltajiet, jista' jkun suġġett għal dawk il-formalitajiet, kundizzjonijiet, restrizzjonijiet jew penali kif preskritti b'liġi u li jkunu meħtieġa f'soċjetà demokratika, fl-interessi tas-sigurtà nazzjonali, integrità territorjali jew sigurtà pubblika, biex jiġi evitat id-diżordni jew l-egħmil ta' delitti, għall-protezzjoni tas-saħħa jew tal-morali, għall-protezzjoni tar-reputazzjoni jew drittijiet ta' ħaddieħor, biex jiġi evitat il-kxif ta' informazzjoni riċevuta b'sigriet, jew biex tiġi miżmuma l-awtorità u l-imparzjalità tal-ġudikatura.`
    Skond l-Artikolu 52(3) tal-Karta, is-sens u l-ambitu ta' dan id-dritt huma l-istess bħal dawk garantiti mill-KEDB. Il-limitazzjonijiet li jistgħu jiġu imposti fuqu, għalhekk, ma jistgħux jeċċedu dawk previsti fl-Artikolu 10(2) tal-Konvenzjoni, mingħajr preġudizzju għal kwalunkwe restrizzjoni li tista' tiġi imposta mil-liġi tal-kompetizzjoni ta' l-Unjoni fuq id-dritt ta' l-Istati Membri li jintroduċu l-arranġamenti dwar l-għoti ta' liċenzji imsemmija fit-tielet sentenza ta' l-Artikolu 10(1) tal-KEDB.
    2. Il-paragrafu 2 ta' dan l-Artikolu jgħid b'mod ċar liema huma l-konsegwenzi ta' paragrafu 1 fir-rigward tal-libertà tax-xandir. Hu bbażat b'mod partikolari fuq il-każistika tal-Qorti tal-Ġustizzja dwar it-televiżjoni, b'mod partikolari fis-sentenza tagħha tal- 25 ta' Lulju 1991, Stichting Collectieve Antennevoorziening Gouda u oħrajn (C-288/89, Ġabra p. I-4007), u fuq il-Protokoll dwar is-sistema tax-xandir pubbliku fl-Istati Membri anness mat-Trattat KE u issa mat-Trattati, u fuq id-Direttiva tal-Kunsill 89/552/KEE (ara partikolarment is-sbatax-il premessa tagħha).

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Dawn l-ispjegazzjonijiet ġew imħejjija oriġinarjament taħt ir-responsabbiltà tal-Praesidium tal-Konvenzjoni li abbozza l-Karta tad-Drittijiet Fundamentali ta' l-Unjoni Ewropea. Huma ġew aġġornati taħt ir-responsabbiltà tal-Praesidium tal-Konvenzjoni Ewropea, fid-dawl ta' l-aġġustamenti li saru għat-test tal-Karta minn dik il-Konvenzjoni (partikolarment fl-Artikoli (51 U 52) u ta' l-evoluzzjoni fil-liġi ta' l-Unjoni. Għalkemm dawn l-ispjegazzjonijiet m'għandhomx fihom infushom l-istatus ta' liġi, huma mezz siewi ta' interpretazzjoni intiż sabiex ikunu ċċarati d-dispożizzjonijiet tal-Karta.

    Članak 38.
    Jamči se sloboda mišljenja i izražavanja misli.
    Sloboda izražavanja misli obuhvaća osobito slobodu tiska i drugih sredstava priopćavanja, slobodu govora i javnog nastupa i slobodno osnivanje svih ustanova javnog priopćavanja.
    Zabranjuje se cenzura. Novinari imaju pravo na slobodu izvještavanja i pristupa informaciji.
    Jamči se pravo na pristup informacijama koje posjeduju tijela javne vlasti. Ograničenja prava na pristup informacijama moraju biti razmjerna naravi potrebe za ograničenjem u svakom pojedinom slučaju te nužna u slobodnom i demokratskom društvu, a propisuju se zakonom.
    Jamči se pravo na ispravak svakomu komu je javnom viješću povrijeđeno Ustavom i zakonom utvrđeno pravo.

An injunction suspension shall lose force if not followed by a confiscation within 24 hours.Art. 41. (1) Everyone shall be entitled to seek, obtain and disseminate information.     Präambel/Promulgationsklausel Auf Grund des § 7 des Beschlusses der Provisorischen Nationalversammlung vom 30. Oktober 1918 über die grundlegenden Einrichtungen der Staatsgewalt wird beurkundet, daß der obenstehende Beschluß von der Provisorischen Nationalversammlung am 30. Oktober 1918 gefaßt worden ist. 1. Die Einstellung von Druckschriften und die Erlassung eines Postverbotes gegen solche findet nicht mehr statt. Die bisher verfügten Einstellungen und Postverbote sind aufgehoben. Die volle Freiheit der Presse ist hergestellt. 3. Die Ausnahmsverfügungen betreffs des Vereins- und Versammlungsrechtes sind aufgehoben. Die volle Vereins- und Versammlungsfreiheit ohne Unterschied des Geschlechts ist hergestellt.
