Artikel 27 - Het recht op informatie en raadpleging van de werknemers binnen de onderneming

Werknemers en hun vertegenwoordigers moeten in de gevallen en onder de voorwaarden waarin het recht van de Unie en de nationale wetgevingen en praktijken voorzien, de zekerheid hebben, dat zij op passende niveaus tijdig worden geïnformeerd en geraadpleegd.

    p align="justify"> Dit artikel staat in het herzien Europees Sociaal Handvest (artikel 21) en het Gemeenschapshandvest van de sociale grondrechten van de werknemers (punten 17 en 18). Het is van toepassing onder de voorwaarden waarin het recht van de Unie en de nationale wetgevingen voorzien. De verwijzing naar de passende niveaus heeft betrekking op de niveaus waarin wordt voorzien door het recht van de Unie of door de nationale wetgevingen en praktijken. Het Europees niveau kan daaronder begrepen zijn wanneer het recht van de Unie daarin voorziet. Het `acquis van de Unie` op dit gebied is belangrijk: de artikelen 154 en 155 van het Verdrag betreffende de werking van de Europese Unie en de Richtlijnen 2002/14/EG (algemeen kader betreffende de informatie en de raadpleging van de werknemers in de Europese Gemeenschap), 98/59/EG (collectief ontslag), 2001/23/EG (overgang van ondernemingen) en 94/45/EG (Europese ondernemingsraden).

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.
