    FRA analysed 31 digital tools and systems across seven EU Member States, exploring potential positive and negative effects on victims, claimants and defendants. By identifying risks early, investing in skills and training, and embedding protections from the outset, policymakers and practitioners can build effective and inclusive justice systems. This report provides practical suggestions to help ensure that digitalised justice systems are accessible and deliver fair outcomes for all.

    Tackling greenwashing is an issue where human rights, consumer rights and climate goals align. Companies use greenwashing to convince people to buy products that are not always as environmentally friendly as they claim to be. They mislead consumers and harm the environment. This report shows how a human rights approach can combat greenwashing. It is based on consultations with experts in 10 Member States. The report identifies gaps in existing laws and enforcement. It includes case studies of consumers seeking remedies for misleading environmental claims. The EU and Member States should enforce rules that make it harder for companies to make misleading environmental claims. They should strengthen rules that make it easier for consumers to prove that companies are greenwashing. Consumer and environmental organisations already hold governments and business to account. Governments should make it easier to use collective action for the protection of consumer rights and the environment.

    The European Arrest Warrant (EAW) allows Member States to implement judicial decisions issued in another Member State. It applies to decisions such as arrests for the purpose of criminal prosecutions or the execution of custodial sentences. After being in force for over 20 years, FRA’s findings provide evidence for an assessment of the legislation in practice. This report looks at the fundamental rights challenges that people face who are requested through an EAW. It provides a unique insight into their experiences and those of the professionals involved. FRA’s findings indicate that shared challenges exist across EU Member States. They must increase efforts to ensure that people are able to take part in criminal proceedings and receive a fair trial.

But children face specific obstacles during criminal proceedings, such as a lack of understandable information about their rights, limited legal support and poor treatment. The report looks at the practical implementation of Directive (EU) 2016/800 on procedural safeguards for children who are suspects or accused persons in criminal proceedings in nine Member States – Austria, Belgium, Bulgaria, Germany, Estonia, Italy, Malta, Poland and Portugal.

    Kinderen hebben net als ieder ander rechten. Zij genieten alle mensen- en grondrechten en vallen onder speciale regelgeving in verband met hun specifieke kenmerken. Dit handboek wil illustreren hoe de Europese wetgeving en jurisprudentie voorzien in de specifieke belangen en behoeften van kinderen, maar laat ook zien hoe belangrijk ouders en voogden en andere wettelijke vertegenwoordigers zijn. Het geeft in voorkomend geval aan op welke gebieden de rechten en verantwoordelijkheden voornamelijk bij de verzorgers van kinderen liggen. Dit handboek beoogt om de bekendheid met en de kennis van de rechtsnormen die de rechten van het kind in Europa beschermen en bevorderen, te vergroten. Het is een naslagwerk over het recht van de Europese Unie (EU) en de Raad van Europa (RvE) met betrekking tot deze onderwerpen en licht toe hoe elk onderwerp is geregeld in het EU-recht, met inbegrip van het Handvest van de grondrechten van de Europese Unie, en in het Europees Verdrag voor de Rechten van de Mens (EVRM), het Europees Sociaal Handvest (ESH) en andere RvE-instrumenten.

    This report looks at the practical implementation of the presumption of innocence in criminal proceedings, and related rights, in 9 EU Member States (Austria, Belgium, Bulgaria, Cyprus, Germany, Italy, Lithuania, Poland and Portugal). Article 48 of the EU Charter of Fundamental Rights guarantees the presumption of innocence – but, as FRA’s research underscores, it can be undermined in many ways.

    Crime can touch any of us – as witnesses or as victims. But no matter who you are, we all have rights when it comes to justice. These three short clips show some aspects of working together for justice, rights of victims of crime and rights of witnesses of crime.
    We don’t all experience crime in the same way, and we might deal with it differently. But it’s vital – as victims or witnesses – that our rights are guaranteed, because access to justice is our fundamental right. Watch FRA Director Michael O’Flaherty speaking on the Fundamental Rights Survey report on crime, safety and victims’ rights.
    Crime can touch any of us – as witnesses or as victims. But no matter who you are, we all have rights when it comes to justice. It is for this reason that the European Union Agency for Fundamental Rights asked 35,000 people across Europe about their experiences of crime in its Fundamental Rights Survey, and the results are in.

This report focuses on respondents’ experiences as victims of selected types of crime, including violence, harassment, and property crime. The report also examines how often these crimes are reported to the police, and presents further details relating to harassment and violence, such as the perpetrators and where the incidents took place.

This makes it vital that every business complies with human rights. This comparative report looks at the realities victims face when they seek redress for business-related human rights abuses. It presents the findings of fieldwork research on the views of professionals regarding the different ways people can pursue complaints. The findings highlight that obstacles to achieving justice are often multi-layered.

    As we enter the second half of 2020, the constraints on our daily lives brought about by the Coronavirus pandemic have become a firm reality. New local lockdowns and the reintroduction of restrictive measures prompted by fresh outbreaks of the virus are a stark reminder that COVID-19 continues to shape our lives – and our enjoyment of fundamental rights – in profound ways. There is compelling evidence of how the pandemic has exacerbated existing challenges in our societies. This FRA Bulletin outlines some of the measures EU Member States adopted to safely reopen their societies and economies while continuing to mitigate the spread of COVID-19. It highlights the impact these measures may have on civil, political and socioeconomic rights.
