The European Union Agency for Fundamental Rights (FRA) is looking to contract the services of a natural or legal person to conduct in-depth analysis of deliverables submitted in the frame of the FRA project Child Participation in Civil and Criminal Justice.

The treatment of children in the justice systems of the European Union is an important issue of concern for European Institutions and for all Member States. The European Commission highlights in the EU Agenda for the Rights of the Child (2011) that promoting child-friendly justice is at the centre of its actions and identifies five key areas concerning children’s involvement in judicial proceedings:

  • Access to information in a way suitable to age and maturity
  • Access to legal representation and advice
  • Participation
  • Appropriate representation
  • Adequate training of professionals dealing with children

In 2012 the FRA commissioned the FRANET contractors to conduct fieldwork research via interviews and focus groups with legal and social professionals working with children who are involved in justice proceedings in ten European countries (Bulgaria, Croatia, Estonia, Finland, France, Germany, Poland, Romania, Spain and United Kingdom). The aim of this research was to identify practices and procedures of child participation in judicial proceedings for cases of domestic violence, sexual abuse, custody and visiting rights.

In 2014 the FRA will conduct interviews with children directly involved in judicial proceedings either as party to proceedings, for example in civil law proceedings in the context of divorce cases or for decisions of placement of children in alternative care, or as witnesses or as victims of crimes in criminal law proceedings. This research will be conducted in nine (9) countries (Bulgaria, Croatia, Estonia, France, Germany, Poland, Romania, Spain and United Kingdom) and potentially one additional (Finland).  

Indicative main tasks of the selected candidate:

  • Kick-off meeting at FRA premises.
  • Evaluation and analysis of deliverables submitted by the FRANET framework contractors under the 2014 Children and Justice project where a total of 360 children will be interviewed.
  • Support in drafting comparative reports relating to the Child Participation in Civil and Criminal Justice projects.
  • 2 meetings at FRA premises (in addition to the kick off meeting).
  • Bi-weekly progress report via email and phone.

Technical and professional capacity

Candidates must be able to meet the following minimum selection criteria:

  • University degree followed by at least three (3) years of professional experience
  • Experience of having worked on at least two (2) completed qualitative interview research projects with at least one involving data from more than one country. At least one of these projects should address children rights. Tenderers are asked to provide the final report or a hyperlink to the final report.
  • Experience of having undertaken data quality checks and analysis, in English, in at least one project.
  • Very good knowledge of English (level C1).

No documents proving the fulfillment of these criteria are requested at this stage.

Participation in this negotiated procedure for a low value contract is open to natural and legal persons falling within the scope of the EU Treaties (this includes all economic operators registered in the European Union and all European Union citizens) and to all natural and legal persons in a third country which has a special agreement with the Union in the field of public procurement on the conditions laid down in that agreement. The FRA is not part of the Agreement on Government Procurement (GPA) concluded within the World Trade Organisation. Therefore, FRA’s procurement procedures are not open to tenderers from GPA countries.
