Articolul 4 - Interzicerea torturii și a pedepselor sau tratamentelor inumane sau degradante

Nimeni nu poate fi supus torturii și nici pedepselor sau tratamentelor inumane sau degradante.

    Dreptul prevăzut la articolul 4 corespunde dreptului garantat la articolul 3 din CEDO, a cărui formulare este identică: `Nimeni nu poate fi supus torturii, nici pedepselor sau tratamentelor inumane ori degradante`. În conformitate cu articolul 52 alineatul (3) din cartă, acest articol are acelaşi înţeles şi acelaşi domeniu de aplicare ca şi articolul din CEDO.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Explicaţiile redate în continuare au fost redactate iniţial sub autoritatea prezidiului Convenţiei care a elaborat Carta drepturilor fundamentale a Uniunii Europene. Acestea au fost actualizate sub autoritatea prezidiului Convenţiei Europene, având în vedere adaptarea de către respectiva Convenţie a textului cartei (în special la articolele 51 şi 52), precum şi evoluţia dreptului Uniunii. Cu toate că aceste explicaţii nu au valoare juridică în sine, acestea constituie un preţios instrument de interpretare destinat clarificării dispoziţiilor cartei.

    2° traitement inhumain : tout traitement par lequel de graves souffrances mentales ou physiques sont intentionnellement infligées à une personne, notamment dans le but d'obtenir d'elle des renseignements ou des aveux, de la punir, de faire pression sur elle ou d'intimider cette personne ou des tiers;
    3° traitement dégradant : tout traitement qui cause à celui qui y est soumis, aux yeux d'autrui ou aux siens, une humiliation ou un avilissement graves. Art. 417ter.<inséré par L 2002-06-14/42, art. 5; En vigueur : 24-08-2002> Quiconque soumettra une personne à la torture sera puni de la réclusion de dix ans à quinze ans. (...)     Article 417bis (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). For the purpose of this section, the following definitions are used:
    1° Torture : every intentional inhuman treatment that causes agonising pain or serious and terrible physical or mental suffering;
    2° Inhuman treatment : every treatment that will cause a person severe intentional physical or mental pain with the aim to receive intelligence, confessions, punish, exert pressure on that person or on a third party, or to intimidate him or a third party ;
    3° Degrading treatment : every treatment that in the eyes of the victim or of a third party, a serious injury or impairment to the human dignity. Article 417ter (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). He who subjects a person to torture, will be punished with a confinement of ten to fifteen year. (...). Article 417quater (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). He who subjects a person to inhuman treatment, will be punished with a confinement of ten to fifteen year. (...). Article 417quinquies (inserted by article 5 of the law of 14 June 2002; in force 24/08/2002). He who subjects a person to degrading treatment, will be punished with a sentence of fifteen days to five year or with a fine of 50 EUR to 300 EUR or with one of these punishments individually.
