    Key facts of the case:

    The applicants sought to challenge an amendment to the electoral law, adopted in 2015, which increased the electoral measure for parties to enter the parliament from 1.8% to 3.6% at second allocation of seats and from 3.6% to 7.2% at third allocation. To this effect, the applicants applied for an order of referral of a preliminary question to the CJEU on whether the failure to foresee a procedure for challenging the legality or the constitutionality of the electoral law prior to the elections and the restriction of the right to challenge to natural persons only and not to political parties were contrary to articles 6, 13, 14 and 18 of the ECHR. In addition, the applicants requested a referral to the CJEU to decide on whether the relevant provisions of the electoral law, being articles 33 and 57, infringed Union law and in particular the Charter.

    Outcome of the case:

    The Charter cannot be applied in order to check the legality of laws regulating national elections. Relying on the CJEU ruling in the case of  Alkagaren v. Hans Akerberg Fransson, the Court concluded that fundamental rights guaranteed by Union law can be applied in all cases regulated by Union law but not beyond those; in the present case the national elections did not involve any issue of Union law and the Charter could therefore  not be applied. Given that there is CJEU case law on this point the issue was clear (acte éclairé) and there was no need for a referral to the CJEU.

    Union law, where applicable, takes precedence over even the Constitution of the Republic of Cyprus. But EU law, and in particular the Charter of Fundamental Rights, which was enacted through the Treaty of Lisbon, is primary EU law, which is applicable, subject to the principle of subsidiarity, only if the Member States are implementing Union law (see Article 51 (1) of the Charter). Therefore, the application of the Charter is limited to the implementation of Union law and does not extend to the regulation of national elections, as is the case of the upcoming parliamentary elections on 22/05/2016.
    In the case of Alkagaren v. Hans Akerberg Fransson, C-617/10, dated 26.2.2013, the CJEU confirmed that the fundamental rights enshrined in the legal order of the Union may apply to all situations governed by European Union law, but not beyond those. The CJEU cannot assess national legislation which does not form part of Union law in the light of the Charter.

    In this case, which concerns the upcoming national elections on 22.05.2016, there is no issue governed by Union law and therefore the relevant national legislation cannot be checked on the basis of the principles of EU law and particularly the Charter. This position has been clarified by the CJEU and therefore does not require need any further clarification (acte éclairé).

    The decision of the German Constitutional Court of 2011, to which counsel for the applicants referred to without giving us the text, did not concern national parliamentary elections but elections for members of the European Parliament and was apparently an application for annulment of specific German legislative provision before the country’s Constitutional Court, which was contrary to the German Constitution or to the principles of EU law.

    Το Ενωσιακό Δίκαιο, εκεί όπου εφαρμόζεται, έχει υπέρτερη ισχύ έναντι ακόμη και του Συντάγματος της Κυπριακής Δημοκρατίας.  Το Ενωσιακό Δίκαιο όμως, και συγκεκριμένα, στην προκείμενη περίπτωση, ο Χάρτης Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης, ο οποίος έλαβε ισχύ με τη Συνθήκη της Λισαβώνας, αποτελεί πρωτογενές Ενωσιακό Δίκαιο, το οποίο εφαρμόζεται, τηρουμένης της αρχής της επικουρικότητας, μόνον όταν τα Κράτη Μέλη εφαρμόζουν το Δίκαιο της Ευρωπαϊκής Ένωσης (Δέστε άρθρο 51(1) του Χάρτη).  Επομένως η εφαρμογή του Xάρτη περιορίζεται στην εφαρμογή του Ενωσιακού Δικαίου και δεν επεκτείνεται στη ρύθμιση εθνικών εκλογών, όπως είναι  η περίπτωση των επερχόμενων Βουλευτικών Εκλογών της 22.5.2016. 

    Στην υπόθεση Alkagaren v. Hans Akerberg Fransson, C-617/10, ημερ. 26.2.2013, το ΔΕΕ  επιβεβαίωσε ότι τα θεμελιώδη δικαιώματα που κατοχυρώνονται στη έννομη τάξη της Ένωσης μπορούν να εφαρμόζονται σε όλες τις καταστάσεις που διέπονται από το Δίκαιο της Ένωσης, αλλά όχι πέραν των καταστάσεων αυτών.  Το ΔΕΕ δεν μπορεί να εκτιμήσει εθνική κανονιστική ρύθμιση, που δεν εντάσσεται στο πλαίσιο του Δικαίου της Ένωσης, με γνώμονα τον Xάρτη.

    Στην προκείμενη περίπτωση, που αφορά τις επικείμενες εθνικές βουλευτικές εκλογές της 22.5.2016, δεν εμπλέκεται οποιοδήποτε ζήτημα εφαρμογής του Δικαίου της Ένωσης και επομένως η σχετική Εθνική Νομοθεσία δεν μπορεί να ελεγχθεί με βάση τις αρχές του Ενωσιακού Δικαίου και συγκεκριμένα του Xάρτη.    Αυτή η θέση είναι διασαφηνισθείσα από τη νομολογία του ΔΕΕ και επομένως δεν χρήζει οποιασδήποτε περαιτέρω διευκρινίσεως από το ΔΕΕ (acte éclairé). 

    Η απόφαση του Γερμανικού Συνταγματικού Δικαστηρίου του 2011, στην οποία έκαμε αναφορά, από ενημερωτικό δελτίο και χωρίς να μας δώσει το κείμενο, ο ευπαίδευτος συνήγορος των αιτητών, δεν αφορούσε σε Εθνικές Βουλευτικές Εκλογές αλλά σε εκλογές στο Ευρωπαϊκό Κοινοβούλιο και επρόκειτο προφανώς περί Αιτήσεως Ακυρώσεως συγκεκριμένης Γερμανικής Νομοθετικής Πρόνοιας, ενώπιον του Συνταγματικού Δικαστηρίου της χώρας, η οποία ερχόταν σε αντίθεση με το Γερμανικό Σύνταγμα ή αρχές του Ενωσιακού Δικαίου.
