Článok 3 - Právo na nedotknuteľnosť osoby

1. Každý má právo na rešpektovanie svojej telesnej a duševnej nedotknuteľnosti.

2. V oblastiach medicíny a biológie sa musí rešpektovať najmä:

a) slobodný a informovaný súhlas dotknutej osoby za podmienok vymedzených zákonom;

b) zákaz eugenických praktík, najmä tých, ktoré sú zamerané na selekciu osôb;

c) zákaz využívania ľudského tela a jeho častí ako takých na dosiahnutie zisku;

d) zákaz reprodukčného klonovania ľudských bytostí.

    1. Vo svojom rozsudku z 9. októbra 2001 vo veci C-377/98 Holandsko/Európsky parlament a Rada, Zb. 2001, s. I-7079, body 70, 78, 79 a 80, potvrdil Súdny dvor, že základné právo na nedotknuteľnosť osoby je súčasťou práva Únie a v súvislosti s medicínou a biológiou zahŕňa slobodný a vedomý súhlas darcu a príjemcu.
    2. Zásady obsiahnuté v článku 3 charty sú už uvedené v Dohovore o ľudských právach a biomedicíne, ktorý prijala Rada Európy (ETS 164 a dodatkový protokol ETS 168). Charta sa neusiluje odchýliť od týchto zásad, a preto zakazuje iba reprodukčné klonovanie. Nepovoľuje ani nezakazuje iné formy klonovania. Nijakým spôsobom však nebráni zákonodarcovi zakázať iné formy klonovania.
    3. Odkaz na eugenické praktiky, najmä tie, ktoré sú zamerané na selekciu osôb, sa týka možných situácií, v ktorých sa organizujú a vykonávajú selekčné programy, okrem iného napríklad kampane zamerané na sterilizáciu, nútené tehotenstvo a povinné uzatváranie etnických manželstiev, všetky akty, ktoré sa považujú za medzinárodné zločiny podľa Štatútu Medzinárodného trestného súdu prijatého v Ríme 17. júla 1998 [pozri jeho článok 7 ods. 1 písm. g)].

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Ďalej uvedené vysvetlivky boli pôvodne pripravené pod vedením predsedníctva konventu, ktorý vypracoval návrh Charty základných práv Európskej únie. Boli aktualizované pod vedením predsedníctva Európskeho konventu so zreteľom na úpravy, ktoré urobil tento konvent k textu charty (najmä k článkom 51 a 52), a vývoj práva Únie. Hoci tieto vysvetlivky nie sú ako také právne záväzné, predstavujú cenný nástroj výkladu, ktorý je určený na objasnenie ustanovení charty.
