Artikel 11 - Yttrandefrihet och informationsfrihet

1. Var och en har rätt till yttrandefrihet. Denna rätt innefattar åsiktsfrihet samt frihet att ta emot och sprida uppgifter och tankar utan offentlig myndighets inblandning och oberoende av territoriella gränser.

2. Mediernas frihet och mångfald ska respekteras.

    1. Artikel 11 motsvarar artikel 10 i Europakonventionen, vilken har följande lydelse:
    `1. Var och en har rätt till yttrandefrihet. Denna rätt innefattar åsiktsfrihet samt frihet att ta emot och sprida uppgifter och tankar utan offentlig myndighets inblandning och oberoende av territoriella gränser. Denna artikel hindrar inte en stat att kräva tillstånd för radio-, televisions- eller biografföretag.
    2. Eftersom utövandet av de nämnda friheterna medför ansvar och skyldigheter, får det underkastas sådana formföreskrifter, villkor, inskränkningar eller straffpåföljder som är föreskrivna i lag och som i ett demokratiskt samhälle är nödvändiga med hänsyn till den nationella säkerheten, den territoriella integriteten eller den allmänna säkerheten, till förebyggande av oordning eller brott, till skydd för hälsa eller moral, till skydd för annans goda namn och rykte eller rättigheter, för att förhindra att förtroliga underrättelser sprids eller för att upprätthålla domstolarnas auktoritet och opartiskhet.`
    I enlighet med artikel 52.3 i stadgan har denna rättighet samma innebörd och räckvidd som den rättighet som garanteras i Europakonventionen. Begränsningarna av denna rättighet får följaktligen inte vara mer omfattande än de som anges i artikel 10.2 i Europakonventionen, utan att det påverkar de inskränkningar som unionens konkurrensrätt kan innebära för medlemsstaternas möjlighet att införa sådana tillståndskrav som avses i artikel 10.1 tredje meningen i Europakonventionen.
    2. I punkt 2 i denna artikel utvecklas följderna av punkt 1 i fråga om mediefrihet. Den bygger bland annat på domstolens rättspraxis för television, särskilt i mål C-288/89 (dom av den 25 juli 1991, Stichting Collectieve Antennevoorziening Gouda m.fl.; Rec. 1991, s. I-4007), och på det protokoll om systemet för radio och TV i allmänhetens tjänst i medlemsstaterna som fogats till EG-fördraget och nu till fördragen samt på rådets direktiv 89/552/EEG (se särskilt skäl 17).

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

Die volle Freiheit der Presse ist hergestellt. 3. Die Ausnahmsverfügungen betreffs des Vereins- und Versammlungsrechtes sind aufgehoben. Die volle Vereins- und Versammlungsfreiheit ohne Unterschied des Geschlechts ist hergestellt.
