Artikel 23 - Jämställdhet mellan kvinnor och män

Jämställdhet mellan kvinnor och män ska säkerställas på alla områden, inbegripet i fråga om anställning, arbete och lön.
Principen om jämställdhet utgör inget hinder för att behålla eller besluta om åtgärder som innebär särskilda förmåner för det underrepresenterade könet.

    Första stycket i denna artikel har grundats på artikel 2 och artikel 3.2 i EG-fördraget, vilka nu har ersatts av artikel 3 i fördraget om Europeiska unionen och artikel 8 i fördraget om Europeiska unionens funktionssätt, enligt vilka det hör till unionens mål att främja jämställdhet mellan kvinnor och män, samt på artikel 157.1 i fördraget om Europeiska unionens funktionssätt. Det har även inspirerats av artikel 20 i europeiska sociala stadgan i dess reviderade lydelse av den 3 maj 1996 samt på punkt 16 i gemenskapsstadgan om arbetstagares rättigheter.
    Det grundas också på artikel 157.3 i fördraget om Europeiska unionens funktionssätt och artikel 2.4 i rådets direktiv 76/207/EEG om genomförandet av principen om likabehandling av kvinnor och män i fråga om tillgång till anställning, yrkesutbildning och befordran samt arbetsvillkor.
    I andra stycket återges med en kortare formulering artikel 157.4 i fördraget om Europeiska unionens funktionssätt om att principen om likabehandling inte hindrar att man behåller eller beslutar om åtgärder som rör särskilda förmåner för att göra det lättare för det underrepresenterade könet att bedriva en yrkesverksamhet eller för att förebygga eller kompensera nackdelar i yrkeskarriären. I enlighet med artikel 52.2 ändrar detta stycke inte artikel 157.4.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Förklaringarna utarbetades ursprungligen på initiativ av presidiet för det konvent som utarbetade Europeiska unionens stadga om de grundläggande rättigheterna. De har uppdaterats på initiativ av Europeiska konventets presidium mot bakgrund av de justeringar av stadgetexten som gjorts av det senare konventet (särskilt artiklarna 51 och 52) samt unionsrättens vidare utveckling. Även om förklaringarna inte i sig har rättslig status, utgör de ett värdefullt tolkningsverktyg avsett att klargöra stadgans bestämmelser.

    (1) The purpose of this Act is to ensure equal treatment of men and women as provided for in the Constitution of the Republic of Estonia and to promote equality of men and women as a fundamental human right and for the public good in all areas of social life.
    (2) To achieve this purpose, this Act provides for:
    1) the prohibition of discrimination on the grounds of sex in the private and public sectors;
    2) the obligation of state and local government authorities, educational and research institutions and employers to promote equality between men and women;
    3) the right to claim compensation for damage.
    § 2. Scope of application of Act
    (1) This Act applies to all areas of social life.
    (2) The requirements of this Act do not apply to:
    1) professing and practising faith or working as a minister of a religion in a registered religious association;

  • Soolise võrdõiguslikkuse seadus

    § 1. Seaduse eesmärk ja reguleerimisala
    (1) Seaduse eesmärk on tagada Eesti Vabariigi põhiseadusest tulenev sooline võrdne kohtlemine ning edendada naiste ja meeste võrdõiguslikkust kui üht põhilist inimõigust ja üldist hüve kõigis ühiskonnaelu valdkondades.
    (2) Eesmärgi saavutamiseks sätestab seadus:
    1) soolise kuuluvuse alusel diskrimineerimise keelu era- ja avalikus sektoris;
    2) riigi- ja kohalike omavalitsusüksuste asutuste, haridus- ja teadusinstitutsioonide ning tööandjate kohustuse edendada naiste ja meeste võrdõiguslikkust;
    3) kahju hüvitamise nõudeõiguse tekkimise.
    § 2. Seaduse kohaldamisala
    (1) Seadust kohaldatakse kõigis ühiskonnaelu valdkondades.
    (2) Seaduse nõudeid ei kohaldata:
    1) registrisse kantud usuühendustes usu tunnistamisele ja viljelemisele või vaimulikuna töötamisele;
    2) perekonna- või eraelu suhetes.
    (3) Seaduses ettenähtud haldusmenetlusele kohaldatakse haldusmenetluse seadust, arvestades käesoleva seaduse erisusi.

    3) kutseõppes, karjäärinõustamisel, ümber- või täiendusõppe võimaldamisel, praktiliste töökogemuste omandamisel;
    4) töötajate või tööandjate ühingusse, sealhulgas kutseühendusse kuulumisel ning nende organisatsioonide poolt soodustuste andmisel.
