Law No. 354/1975' (Legge 26 luglio 1975, n. 354, Norme sull’ordinamento penitenziario e sulla esecuzione delle misure privative e limitative della libertà)The use of basic sanitary facilities (including showers, toilets, washbasins, and all the necessary equipment to ensure personal hygiene) must be guaranteed to all detainees. Such facilities shall be located in a separate area annexed to the jail cell. These areas must be equipped with: sanitary facilities providing (hot and cold) tap water, a toilet, a washbasin, a shower, and – especially in the female wings of prisons – a bidet.

2019The Italian NPM stressed its recommendation in this field to the Italian authorities – and namely that it is necessary “To equip all sleeping quarters with showers annexed to detention rooms, ensuring the best hygienic conditions and overcoming the widespread criticalities of common showers, often situated in degraded premises” – and also reported that this recommendation was included in Legislative Decree No. 124 of 2 October 2018, Reform of the prison system concerning detention life and work, implementing the provisions foreseen in Article 1, paragraphs 82, 83 and 85, letters g), h) and r), of Law no. 103 of 23 June 2017, Article 1, paragraph 7, letter c).
