The Information Circular pursues the setting of interpretative guidelines for the various criminal figures encompassed in the Article 510 of the Penal Code (PC) following the reform carried out by Organic Law 1/2015 of 30 March, which entered into force on July 2015. It has not involved the inclusion of a single category of hate crimes, and expressions of it may be found disseminated throughout the PC. It entails interpretative difficulties with respect to other criminal modalities related to this matter. There is a doctrinal and jurisprudential dispute. The offences contained in Article 510 PC still present diffuse contours that make them difficult to detect and which, perhaps, do not allow the behaviors presented by the “exclusionary intolerance”, as stated by the Constitutional Court Ruling No 177/2015 of 22 July.
