Law on the rights of persons suspected, arrested or in custody of 2005 (O περί των Δικαιωμάτων Υπόπτων Προσώπων, Προσώπων που Συλλαμβάνονται και Προσώπων που Τελούν υπό Κράτηση Νόμος του 2005)Persons detained in police cells who are unable, due to an intellectual or physical disability, to exercise their right of communication with a lawyer and a relative or an employer or other person of choice, are entitled to assistance from an officer of medical or social services of the state, which must be made available to him immediately or soon as possible after arrest.

2022It is understandable that prison guards are indeed not properly trained to provide specialised care to prisoners with disabilities, while this is not part of their duties, nor can another prisoner be entrusted with such a responsibility. Therefore, all available options should be considered as soon as possible, namely, whether it is appropriate for care to be provided by nurses, as recommended by the OPAA, or by specialist carers paid from the benefits paid to the person concerned, based on the recommendation of the CCEA.
