2022Anyone arriving in a prison must be asked to express any fears they may have for their safety or respect for their dignity, in particular because of their gender identity. A procedure must be formalised for this purpose, and implemented in a benevolent, confidential way. Transgender people must be free to reveal their trans identity or otherwise. Report details
2022When a transgender person is identified by the administration or the court, they must be placed in an single cell as soon as they arrive in a prison. They should be asked to indicate the title and first name by which they want to be referred to, both verbally and in writing, including in procedural documents and medical records, in addition to the information given in their identification document. Any preferences expressed in this way must be respected, and the person in question must be able to change them at any time. If the detention is to last for some time, they must be received by a member of management or supervision for a more detailed examination of their situation, and additional, durable measures must then be decided on. The initial training of professionals dealing with detainees must include in-depth modules regarding the discrimination suffered by gender minorities. Report details
