Legal instruments & key provisions

Legal instrument Key provision
French Prison Code The prevention of radicalisation involves placing radicalised individuals in solitary confinement through single-cell confinement, so as to avoid any proselytising. Following an assessment by a multidisciplinary team, a detainee may be considered to be radicalised and therefore a danger to other detainees. They may then be placed in a radicalisation treatment unit. Determining whether a detainee has been radicalised is the responsibility of all those involved in detention.

NATIONAL PREVENTIVE MECHANISM RECOMMENDATIONS

Year Recommendation Report
2022Despite the CGLPL's recommendation, the decision to assign a detainee to a radicalisation assessment unit is not subject to adversarial debate, and cannot be appealed against. Moreover, the severity of the detention regime in this unit does not appear to have been called into question. Report details
