Penitentiary CodePrisoners are divided into categories in order to specialize their treatment according to the needs imposed by their actual or legal situation. Prisoners of each category live in special prison facilities or independent sections of prison facilities. Detainees awaiting trial (pre- trial detainees) or convicted persons serving a prison sentence which does not exceed 5 years of imprisonment (short term sentences), reside in Type A detention facilities or in separate sections of detention facilities, without communication with prisoners of other categories. On the other hand, prisoners who are serving long term prison sentences (incarceration), which includes those with a life sentence, reside in type B detention facilities or in separate sections of detention facilities, without communication with prisoners of other categories. There is no corresponding penitentiary regulation as regards the separation of first- time offenders from recidivists.
