30. pants - Aizstāvība nepamatotas atlaišanas gadījumā

Ikvienam darba ņēmējam nepamatotas atlaišanas gadījumā ir tiesības uz aizstāvību, ievērojot Savienības tiesību aktus, kā arī valstu tiesību aktus un praksi.

    Šā panta pamatā ir pārskatītās Eiropas Sociālās hartas 24. pants. Sk. arī Direktīvu 2001/23/EK par darbinieku tiesību aizsardzību uzņēmumu, uzņēmējsabiedrību vai uzņēmumu vai uzņēmējsabiedrību daļu īpašnieka maiņas gadījumā, un Direktīvu 80/987/EEK par darba ņēmēju aizsardzību darba devēja maksātnespējas gadījumā, kas grozīta ar Direktīvu 2002/74/EK.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Šie paskaidrojumi ir sagatavoti Eiropas Savienības Pamattiesību hartu izstrādājušā Konventa prezidija vadībā. Tie ir atjaunināti Eiropas Konventa prezidija vadībā, ņemot vērā Konventa izdarītos Hartas teksta (jo īpaši 51. un 52. panta) precizējumus un Savienības tiesību turpmāku attīstību. Kaut arī šiem paskaidrojumiem nav juridiska spēka, tie ir vērtīgi interpretācijas līdzekļi, kas paredzēti Hartas noteikumu izskaidrošanai.

    7. Information about employment conditions and protection in case of dismissals
    Workers have the right to be informed in writing at the start of employment about their rights and obligations resulting from the employment relationship, including on probation period.
    Prior to any dismissal, workers have the right to be informed of the reasons and be granted a reasonable period of notice. They have the right to access to effective and impartial dispute resolution and, in case of unjustified dismissal, a right to redress, including adequate compensation.
