52. pants - Tiesību un principu piemērošana un interpretēšana

1. Visiem šajā Hartā atzīto tiesību un brīvību izmantošanas ierobežojumiem ir jābūt noteiktiem tiesību aktos, un tajos jārespektē šo tiesību un brīvību būtība. Ievērojot proporcionalitātes principu, ierobežojumus drīkst uzlikt tikai tad, ja tie ir nepieciešami un patiešām atbilst vispārējas nozīmes mērķiem, ko atzinusi Savienība, vai vajadzībai aizsargāt citu personu tiesības un brīvības. 2. Šajā Hartā atzītās tiesības, kuras ir paredzētas Līgumos, izmanto saskaņā ar noteiktajiem nosacījumiem un ierobežojumiem. 3. Ciktāl Hartā ir ietvertas tiesības, kuras atbilst Eiropas Cilvēktiesību un pamatbrīvību aizsardzības konvencijā garantētajām tiesībām, šo tiesību nozīme un apjoms ir tāds pats kā minētajā Konvencijā noteiktajām tiesībām. Šis noteikums neliedz Savienības tiesībās paredzēt plašāku aizsardzību. 4. Ciktāl šajā Hartā ir atzītas pamattiesības, kuru pamatā ir dalībvalstu kopējas konstitucionālās tradīcijas, šīs tiesības interpretē saskaņā ar minētajām tradīcijām. 5. Šīs Hartas noteikumus, kas ietver principus, var ieviest ar likumdevējas varas un izpildvaras aktiem, kurus pieņem Savienības iestādes un struktūras, un ar dalībvalstu aktiem, kad tās, izmantojot attiecīgās pilnvaras, īsteno Savienības tiesību aktus. Hartas noteikumi ir piemērojami tiesā tikai šādu aktu interpretācijā un pieņemot lēmumu par to likumību. 6. Pilnībā ņem vērā valstu tiesību aktus un praksi, kā noteikts šajā Hartā. 7. Savienības un dalībvalstu tiesas pienācīgi ievēro skaidrojumus, kas izstrādāti, lai sniegtu norādes šīs Hartas interpretācijai.

    Hartas 52. panta mērķis ir paredzēt Hartas tiesību un principu piemērošanas jomu, kā arī to interpretēšanas noteikumus. Panta 1. punktā nosaka tiesību ierobežošanas noteikumus. Formulējums ir balstīts uz Tiesas judikatūru: `…Tiesas judikatūrā skaidri paredzēts, ka pamattiesību izmantošanai drīkst uzlikt ierobežojumus, jo īpaši sakarā ar kopīgu tirgus organizāciju, ja šie ierobežojumi patiešām atbilst vispārējas nozīmes mērķiem, ko īsteno Savienība, un attiecībā uz konkrēto mērķi nav nesamērīga un nepamatota iejaukšanās, kas grauj šo tiesību būtību` ( 2000. gada 13. aprīļa spriedums lietā C-292/97, 45. punkts). Atsauce uz vispārējas nozīmes mērķiem, ko atzinusi Savienība, attiecas gan uz Līguma par Eiropas Savienību 3. pantā minētajiem mērķiem, gan uz citām interesēm, kas aizstāvētas konkrētos Līgumu noteikumos, piemēram, Līguma par Eiropas Savienību 4. panta 1. punktā, Līguma par Eiropas Savienības darbību 35. panta 3. punktā, 36. pantā un 346. pantā.
    Panta 2. punkts attiecas uz tiesībām, kas jau skaidri garantētas Eiropas Kopienas dibināšanas līgumā un atzītas Hartā, un kas tagad ir iekļautas Līgumos (īpaši tiesības, ko nosaka Savienības pilsonība). Ar šo punktu precizē to, ka uz šīm tiesībām attiecas nosacījumi un ierobežojumi, ko piemēro Savienības tiesību aktiem, kas ir to pamatā un kas paredzēti Līgumos. Harta nemaina EK līgumā noteikto tiesību sistēmu, ko pārņem Līgumos.
    Panta 3. punkta mērķis ir nodrošināt nepieciešamo Hartas atbilstību ECK, paredzot noteikumu, ka tiktāl, ciktāl pašreizējās Hartas tiesības atbilst ECK garantētajām tiesībām, šo tiesību nozīme un darbības joma, tostarp atļautie ierobežojumi, ir tāda pati kā ECK paredzētajām tiesībām. Jo īpaši tas nozīmē, ka, paredzot šo tiesību ierobežojumus, likumdevējam jāievēro tie paši standarti, kas noteikti ECK sīki izstrādātajos ierobežojumu noteikumos un kas tādējādi attiecas uz šajā pantā minētajām tiesībām, tomēr negatīvi neietekmējot Savienības tiesību aktu un Eiropas Savienības Tiesas nošķirtību.
    Atsauce uz ECK attiecas gan uz Konvenciju, gan uz tās protokoliem. Garantēto tiesību nozīmi un darbības jomu nosaka ne tikai šo divu dokumentu teksti, bet arī Eiropas Cilvēktiesību tiesas un Eiropas Savienības Tiesas judikatūra. Punkta pēdējā teikuma nolūks ir ļaut Savienībai garantēt plašāku aizsardzību. Katrā ziņā Hartā paredzētais aizsardzības līmenis nedrīkst būt zemāks par ECK garantēto līmeni.
    Harta neietekmē dalībvalstu iespējas izmantot ECK 15. pantu, kas pieļauj atkāpes no ECK tiesībām kara vai citu valsts pastāvēšanai būtisku draudu gadījumā, kad tās darbojas valsts aizsardzības jomā kara gadījumā un uztur likumību un kārtību saskaņā ar Līguma par Eiropas Savienību 4. panta 1. punktā, kā arī Līguma par Eiropas Savienības darbību 72. un 347. pantā atzītajiem pienākumiem.
    Turpmāk ir uzskaitītas tiesības, kas, neliedzot grozījumu iespējas tiesību aktos, likumdošanas procedūrā un Līgumos, pašreizējā posmā uzskatāmas par atbilstošām ECK tiesībām šā punkta nozīmē. Uzskaitījumā nav iekļautas tiesības, kuru nav ECK.
    1. Hartas panti, kuru nozīme un darbības joma ir tāda pati kā atbilstošiem ECK pantiem:
    - 2. pants atbilst ECK 2. pantam;
    - 4. pants atbilst ECK 3. pantam;
    - 5. panta 1. un 2. punkts atbilst ECK 4. pantam;
    - 6. pants atbilst ECK 5. pantam;
    - 7. pants atbilst ECK 8. pantam;
    - 10. panta 1. punkts atbilst ECK 9. pantam;
    - 11. pants atbilst ECK 10. pantam, neskarot ierobežojumus, ko Savienības tiesību akti var uzlikt dalībvalstu tiesībām ieviest licencēšanu, kas minēta ECK 10. panta 1. punkta trešajā teikumā; - 17. pants atbilst ECK protokola 1. pantam;
    - 19. panta 1. punkts atbilst ECK 4. protokola 4. pantam;
    - 19 panta 2. punkts atbilst ECK 3. pantam, kā to interpretējusi Eiropas Cilvēktiesību tiesa;
    - 48. pants atbilst ECK 6. panta 2. un 3. punktam;
    - 49. panta 1. punkts (izņemot pēdējo teikumu) un 2. punkts atbilst ECK 7. pantam.

    2. Panti, kuru nozīme ir tāda pati kā atbilstošiem ECK pantiem, bet kuru darbības joma ir plašāka:
    - 9. pants attiecas uz to pašu jomu, ko ECK 12. pants, bet to var attiecināt arī uz citiem laulības veidiem, ja tie paredzēti valsts tiesību aktos;
    - 12. panta 1. punkts atbilst ECK 11. pantam, bet tā piemērošanas joma attiecas arī uz visu Eiropas Savienību;
    - 14. panta 1. punkts atbilst ECK protokola 2. pantam, bet tas attiecas arī uz arodmācībām un turpmākām mācībām;
    - 14. panta 3. punkts atbilst ECK protokola 2. pantam attiecībā uz vecāku tiesībām;
    - 47. panta 2. un 3. punkts atbilst ECK 6. panta 1. punktam, bet attiecībā uz Savienības tiesību aktiem un to ieviešanu nepiemēro ierobežojumu, nosakot civilās tiesības un pienākumus vai apsūdzību krimināllietā;
    - 50. pants atbilst ECK 7. protokola 4. pantam, bet tā piemērošanas joma ir paplašināta, attiecinot to uz dalībvalstu tiesām visā Eiropas Savienībā;
    - visbeidzot, piemērojot Savienības tiesības, Eiropas Savienības pilsoņus nedrīkst uzskatīt par ārvalstniekiem, jo ir aizliegta diskriminācija pilsonības dēļ. Tāpēc ECK 16. pantā paredzētie ierobežojumi ārvalstnieku tiesībām šajā ziņā uz viņiem neattiecas.
    Interpretācijas noteikums 4. punktā ir balstīts uz Līguma par Eiropas Savienību 6. panta 3. punkta formulējumu un tajā ņem vērā Tiesas attieksmi pret kopējām konstitucionālām tradīcijām (piem., 1979. gada 13. decembra spriedums lietā 44/79 Hauer, Recueil, 1979., 3727. lpp; 1982. gada 18. maija spriedums lietā 155/79 AM&S, Recueil, 1982., 1575. lpp.). Saskaņā ar šo noteikumu nav vēlams strikti ievērot `mazākā kopsaucēja` principu, bet attiecīgās Hartas tiesības jāinterpretē tā, lai paredzētu augstu aizsardzības standartu, kas atbilstu Savienības tiesībām un būtu saskaņā ar kopējām konstitucionālām tradīcijām.
    Panta 5. punkts skaidro atšķirību starp Hartā paredzētajām `tiesībām` un `principiem`. Saskaņā ar šo atšķirību subjektīvās tiesības respektē, turpretim principus ievēro (51. panta 1. punkts). Principus var ieviest ar tiesību aktiem vai izpildvaras aktiem (kurus pieņem Savienība saskaņā ar savām kompetencēm un dalībvalstis tad, kad tās īsteno Savienības tiesību aktus); tātad tiesām tie kļūst svarīgi tikai tad, kad minētos tiesību aktus interpretē vai pārskata. Tie tomēr nedod tiesības tieši vērsties tiesā, lai panāktu Eiropas Savienības vai dalībvalstu iestāžu pozitīvu darbību, kas ir saskaņā gan ar Tiesas judikatūru (jo īpaši sk. arī judikatūru attiecībā uz `piesardzības principu`, kas iekļauts Līguma par Eiropas Savienības darbību 191. panta 2. punktā (PIT 2002. gada 11. septembra spriedums lietā T-13/99, Pfizer/Padome, kas satur daudzas atsauces uz agrāku judikatūru; un vairākus spriedumus par 33. pantu (bijušais 39. pants) attiecībā uz lauksaimniecības tiesību principiem, piem., Tiesas spriedumu lietā 265/85, Van den Berg, Recueil, 1987., 1155. lpp. – tirgus stabilizācijas principa un tiesiskās paļāvības principa izvērtēšana), gan ar dalībvalstu konstitucionālo sistēmu pieeju `principiem`, īpaši sociālo tiesību jomā. Hartā atzīto principu piemēri ir, piem., 25., 26. un 37. pants. Dažos gadījumos Hartas pants var ietvert gan tiesību, gan principa elementu, piem., 23., 33. un 34. pantā.
    Panta 6. punkts attiecas uz dažādiem Hartas pantiem, kas, respektējot subsidiaritāti, atsaucas uz valstu tiesību aktiem un praksi.

    Šie paskaidrojumi ir sagatavoti Eiropas Savienības Pamattiesību hartu izstrādājušā Konventa prezidija vadībā. Tie ir atjaunināti Eiropas Konventa prezidija vadībā, ņemot vērā Konventa izdarītos Hartas teksta (jo īpaši 51. un 52. panta) precizējumus un Savienības tiesību turpmāku attīstību. Kaut arī šiem paskaidrojumiem nav juridiska spēka, tie ir vērtīgi interpretācijas līdzekļi, kas paredzēti Hartas noteikumu izskaidrošanai.

    Section 23 Basic rights and liberties in situations of emergency Such provisional exceptions to basic rights and liberties that are compatible with Finland's international human rights obligations and that are deemed necessary in the case of an armed attack against Finland or in the event of other situations of emergency, as provided by an Act, which pose a serious threat to the nation may be provided by an Act or by a Government Decree to be issued on the basis of authorisation given in an Act for a special reason and subject to a precisely circumscribed scope of application. The grounds for provisional exceptions shall be laid down by an Act, however. Government Decrees concerning provisional exceptions shall without delay be submitted to the Parliament for consideration. The Parliament may decide on the validity of the Decrees.

    (24) Where an institution does not present an adequate recovery plan, competent authorities should be empowered to require that institution to take measures necessary to redress the material deficiencies of the plan. That requirement may affect the freedom to conduct a business as guaranteed by Article 16 of the Charter. The limitation of that fundamental right is however necessary to meet the objectives of financial stability. More specifically, such a limitation is necessary in order to strengthen the business of institutions and avoid institutions growing excessively or taking excessive risks without being able to tackle setbacks and losses and to restore their capital base. The limitation is proportionate because it permits preventative action to the extent that it is necessary to address the deficiencies and therefore complies with Article 52 of the Charter.

    (49) The limitations on the rights of shareholders and creditors should be in accordance with Article 52 of the Charter. The resolution tools should therefore be applied only to those institutions that are failing or likely to fail, and only when it is necessary to pursue the objective of financial stability in the general interest. In particular, resolution tools should be applied where the institution cannot be wound up under normal insolvency proceedings without destabilising the financial system and the measures are necessary in order to ensure the rapid transfer and continuation of systemically important functions and where there is no reasonable prospect for any alternative private solution, including any increase of capital by the existing shareholders or by any third party sufficient to restore the full viability of the institution. In addition, when applying resolutions tools and exercising resolution powers, the principle of proportionality and the particularities of the legal form of an institution should be taken into account.

    (88) In accordance with Article 47 of the Charter, the parties concerned have a right to due process and to an effective remedy against the measures affecting them. Therefore, the decisions taken by the resolution authorities should be subject to a right of appeal.

    Article 1

    Subject matter and scope

    1. This Regulation lays down temporary and strictly limited rules derogating from certain obligations laid down in Directive 2002/58/EC, with the sole objective of enabling providers of certain number-independent interpersonal communications services (‘providers’) to use, without prejudice to Regulation (EU) 2016/679, specific technologies for the processing of personal and other data to the extent strictly necessary to detect online child sexual abuse on their services and report it and to remove online child sexual abuse material from their services.

    2. This Regulation does not apply to the scanning of audio communications.

    Article 1

    Purpose

    This Directive aims to achieve a more balanced representation of women and men among the directors of listed companies by establishing effective measures that aim to accelerate progress towards gender balance, while allowing listed companies sufficient time to make the necessary arrangements for that purpose.

    (5) This Directive creates a legal framework to ensure freedom to provide electronic communications networks and services, subject only to the conditions laid down in this Directive and to any restrictions in accordance with Article 52(1) of the Treaty on the Functioning of the European Union (TFEU), in particular measures regarding public policy, public security and public health, and consistent with Article 52(1) of the Charter of Fundamental Rights of the European Union (the ‘Charter’).

    (6) This Directive is without prejudice to the possibility for each Member State to take the necessary measures to ensure the protection of its essential security interests, to safeguard public policy and public security, and to permit the investigation, detection and prosecution of criminal offences, taking into account that any limitation to the exercise of the rights and freedoms recognised by the Charter, in particular in Articles 7, 8 and 11 thereof, such as limitations regarding the processing of data, are to be provided for by law, respect the essence of those rights and freedoms and be subject to the principle of proportionality, in accordance with Article 52(1) of the Charter.
