Článek 52 - Rozsah a výklad práv a zásad

  1. Každé omezení výkonu práv a svobod uznaných touto listinou musí být stanoveno zákonem a respektovat podstatu těchto práv a svobod. Při dodržení zásady proporcionality mohou být omezení zavedena pouze tehdy, pokud jsou nezbytná a pokud skutečně odpovídají cílům obecného zájmu, které uznává Unie, nebo potřebě ochrany práv a svobod druhého.
  2. Práva uznaná touto listinou, jež jsou podrobněji upravena ve Smlouvách, jsou vykonávána za podmínek a v mezích v nich stanovených.
  3. Pokud tato listina obsahuje práva odpovídající právům zaručeným Úmluvou o ochraně lidských práv a základních svobod, jsou smysl a rozsah těchto práv stejné jako ty, které jim přikládá uvedená úmluva. Toto ustanovení nebrání tomu, aby právo Unie poskytovalo širší ochranu.
  4. Pokud tato listina uznává základní práva, která vyplývají z ústavních tradic společných členským státům, musí být tato práva vykládána v souladu s těmito tradicemi.
  5. Ustanovení této listiny, která obsahují zásady, mohou být prováděna legislativními a exekutivními akty přijímanými orgány, institucemi a jinými subjekty Unie a akty členských států, provádějí-li právo Unie, při výkonu jejich pravomocí. Před soudem se jich lze dovolávat pouze pro účely výkladu a kontroly zákonnosti těchto aktů.
  6. K vnitrostátním právním předpisům a zvyklostem musí být plně přihlíženo tak, jak je stanoveno v této listině.
  7. Soudy Unie a členských států náležitě přihlížejí k vysvětlením vypracovaným jako pomůcka pro výklad této listiny.
  • Text:

    Účelem článku 52 je stanovit rozsah práv a zásad obsažených v Listině a stanovit pravidla pro jejich výklad. Odstavec 1 se zabývá omezením práv. Znění je založeno na judikatuře Soudního dvora: „... v judikatuře je jasně stanoveno, že na výkon základních práv je možné uvalit omezení, mimo jiné v rámci společné organizace trhu, pokud tato omezení skutečně odpovídají cílům obecného zájmu sledovaným Společenstvím a nepředstavují vzhledem ke sledovanému cíli nepřiměřené a neopodstatněné omezování ohrožující samu podstatu těchto práv“ (rozsudek ze dne 13. dubna 2000 ve věci C-292/97, 45. bod). Odkaz na obecné zájmy uznávané Unií zahrnuje jak cíle uvedené v článku 3 Smlouvy o Evropské unii, tak další zájmy chráněné zvláštními ustanoveními Smluv, jako čl. 4 odst. 1 Smlouvy o Evropské unii, čl. 35 odst. 3 Smlouvy o fungování Evropské unie a články 36 a 346 uvedené smlouvy.

    Odstavec 2 odkazuje na práva, která již byla výslovně zaručena Smlouvou o založení Evropského společenství a uznána Listinou a která jsou nyní obsahem Smluv (zejména práva vyplývající z občanství Unie). Stanoví, že taková práva nadále podléhají podmínkám a omezením stanoveným ve Smlouvách a platným pro právo Unie, na kterém jsou založena. Tato Listina nemění systém práv svěřených Smlouvou o ES a přejatých Smlouvami.
    Odstavec 3 má zajistit nezbytný soulad mezi Listinou a EÚLP stanovením pravidla, že pokud práva zaručená Listinou odpovídají právům zaručeným EÚLP, je jejich smysl a rozsah včetně povolených omezení stejný jako stanoví EÚLP. To zejména znamená, že zákonodárce při stanovování omezení těchto práv musí splňovat stejné normy, které jsou stanoveny v ustanoveních o omezeních EÚLP a které se tak činí použitelnými na práva zahrnutá tímto odstavcem, aniž by narušily autonomii práva Unie a Soudního dvora Evropské unie.
    Odkaz na EÚLP zahrnuje jak úmluvu, tak její protokoly. Smysl a rozsah zaručených práv jsou určeny nejen zněním těchto aktů, ale též judikaturou Evropského soudu pro lidská práva a Soudního dvora Evropské unie. Poslední věta odstavce umožňuje Unii zaručit širší ochranu. Úroveň ochrany poskytovaná Listinou nesmí být v žádném případě nižší než úroveň zaručená EÚLP.
    Listina neovlivňuje možnost členských států využít článku 15 EÚLP, který v případě války nebo jiného veřejného ohrožení státní existence umožňuje odchylky od práv zaručených EÚLP v oblasti národní obrany v případě války a zachování práva a pořádku, v souladu s jejich povinnostmi stanovenými v čl. 4 odst. 1 Smlouvy o Evropské unii a článcích 72 a 347 Smlouvy o fungování Evropské unie. Seznam práv, která mohou být považována za odpovídající právům v EÚLP ve smyslu tohoto odstavce, aniž je dotčen budoucí vývoj práva, právních předpisů a smluv, je uveden níže. Nezahrnuje práva doplňující práva v EÚLP.

    1. Články Listiny, jejichž smysl i rozsah je stejný jako u odpovídajících článků EÚLP:
      • článek 2 odpovídá článku 2 EÚLP,  
      • článek 4 odpovídá článku 3 EÚLP,
      • čl. 5 odst. 1 a 2 odpovídá článku 4 EÚLP,
      • článek 6 odpovídá článku 5 EÚLP,
      • článek 7 odpovídá článku 8 EÚLP,
      • čl. 10 odst. 1 odpovídá článku 9 EÚLP,
      • článek 11 odpovídá článku 10 EÚLP, aniž jsou dotčena jakákoliv omezení, která může Unie uvalit na právo členských států zavést povolení uvedená ve třetí větě čl. 10 odst. 1 EÚLP,
      • článek 17 odpovídá článku 1 protokolu k EÚLP,
      • čl. 19 odst. 1 odpovídá článku 4 protokolu č. 4,
      • čl. 19 odst. 2 odpovídá článku 3 EÚLP, jak je vykládán Evropským soudem pro lidská práva,
      • článek 48 odpovídá čl. 6 odst. 2 a 3 EÚLP,
      • čl. 49 odst. 1 (s výjimkou poslední věty) a 2 odpovídají článku 7 EÚLP.
    2. Články, které mají stejný smysl jako odpovídající články EÚLP, ale které mají širší rozsah:
      • článek 9 zahrnuje stejnou oblast jako článek 12 EÚLP, ale jeho rozsah může být rozšířen na jiné formy sňatku, jsou-li vnitrostátními právními předpisy zavedeny,
      • čl. 12 odst. 1 odpovídá článku 11 EÚLP, ale jeho rozsah je rozšířen na úroveň Evropské unie,
      • čl. 14 odst. 1 odpovídá článku 2 protokolu k EÚLP, ale jeho rozsah je rozšířen, aby zahrnoval přístup k odbornému a dalšímu vzdělání,
      • čl. 14 odst. 3 odpovídá článku 2 protokolu k EÚLP, pokud jde o práva rodičů,
      • čl. 47 odst. 2 a 3 odpovídá čl. 6 odst. 1 EÚLP, ale omezení na určení občanských práv a závazků nebo trestního obvinění neplatí pro právo Unie a jeho uplatňování,
      • článek 50 odpovídá článku 4 protokolu č. 7 k EÚLP, ale jeho rozsah je rozšířen na úroveň Evropské unie mezi soudy členských států,
      • konečně, občané Evropské unie nesmějí být v oblasti působnosti práva Evropské unie považováni za cizince z důvodu zákazu jakékoliv diskriminace na základě státní příslušnosti. Omezení podle článku 16 EÚLP, pokud jde o práva cizinců, se na ně tedy v této souvislosti nevztahují.

    Pravidlo výkladu obsažené v odstavci 4 je založeno na znění čl. 6 odst. odst. 3 Smlouvy o Evropské unii a bere řádně v úvahu přístup ke společným ústavním tradicím, který zvolil Soudní dvůr (například rozsudek ze dne 13. prosince 1979 ve věci 44/79 Hauer, Sb. rozh. 1979, s. 3727; rozsudek ze dne 18. května 1982 ve věci 155/79, AM&S, Sb. rozh. 1982, s. 1575). Podle tohoto pravidla, spíše než zvolením postupu „nejnižšího společného jmenovatele`, by se měla dotčená práva Listiny vykládat způsobem, který nabízí vysoký standard ochrany, dostatečný pro právo Unie a v souladu se společnými ústavními tradicemi.
    Odstavec 5 vyjasňuje rozdíl mezi „právy“ a „zásadami“ stanovenými v Listině. Podle tohoto rozlišení musí být subjektivní práva respektována, zatímco zásady musí být dodržovány (čl. 51 odst. 1). Zásady mohou být prováděny prostřednictvím legislativních nebo výkonných aktů (přijatých Unií v souladu s jejími pravomocemi a členskými státy, pouze provádějí-li právo Unie); v souladu s tím získávají zvláštní význam pro soudy, pouze když jsou takové akty vykládány nebo přezkoumávány. Na jejich základě však nelze podávat přímé žaloby požadující činnost orgánů Unie nebo orgánů členských států, což odpovídá jak judikatuře Soudního dvora (viz zejména judikatura o „zásadě předběžné opatrnosti“ v čl. 191 odst. 2 Smlouvy o fungování Evropské unie: rozsudek Soudu prvního stupně ze dne 11. září 2002 ve věci T-13/99 Pfizer v. Rada, s mnoha odkazy na dřívější judikaturu, a řada rozsudků o článku 33 (dříve 39) o zásadách zemědělského práva: například rozsudek Soudního dvora 265/85 ve věci Van den Berg, Sb. rozh. 1987, s. 1155: přezkum zásady stabilizace trhu a oprávněných očekávání), tak přístupu ústavních systémů členských států k „zásadám“, zejména v oblasti sociálního práva. Příklady zásad uznaných Listinou obsahují například články 25, 26 a 37. V některých případech může článek Listiny obsahovat prvky práva i zásady, například články 23, 33, a 34.
    Odstavec 6 odkazuje na různé články Listiny, které v duchu subsidiarity odkazují na vnitrostátní právní předpisy a zvyklosti.

    Tato vysvětlení byla původně vyhotovena pod vedením prezídia Konventu, který vypracoval Listinu základních práv Evropské unie. Byla aktualizována pod vedením prezídia Evropského konventu s ohledem na změny návrhu znění Listiny provedené Konventem (zejména článků 51 a 52) a na vývoj práva Unie. Ačkoliv sama nemají právní závaznost, jsou cenným výkladovým nástrojem pro vyjasnění ustanovení Listiny.

    Article 11. Rights and freedoms may only be circumscribed in accordance with the Constitution. Such circumscription must be necessary in a democratic society and may not distort the nature of the rights and freedoms circumscribed.

    (24) Where an institution does not present an adequate recovery plan, competent authorities should be empowered to require that institution to take measures necessary to redress the material deficiencies of the plan. That requirement may affect the freedom to conduct a business as guaranteed by Article 16 of the Charter. The limitation of that fundamental right is however necessary to meet the objectives of financial stability. More specifically, such a limitation is necessary in order to strengthen the business of institutions and avoid institutions growing excessively or taking excessive risks without being able to tackle setbacks and losses and to restore their capital base. The limitation is proportionate because it permits preventative action to the extent that it is necessary to address the deficiencies and therefore complies with Article 52 of the Charter.

    (49) The limitations on the rights of shareholders and creditors should be in accordance with Article 52 of the Charter. The resolution tools should therefore be applied only to those institutions that are failing or likely to fail, and only when it is necessary to pursue the objective of financial stability in the general interest. In particular, resolution tools should be applied where the institution cannot be wound up under normal insolvency proceedings without destabilising the financial system and the measures are necessary in order to ensure the rapid transfer and continuation of systemically important functions and where there is no reasonable prospect for any alternative private solution, including any increase of capital by the existing shareholders or by any third party sufficient to restore the full viability of the institution. In addition, when applying resolutions tools and exercising resolution powers, the principle of proportionality and the particularities of the legal form of an institution should be taken into account.

    (88) In accordance with Article 47 of the Charter, the parties concerned have a right to due process and to an effective remedy against the measures affecting them. Therefore, the decisions taken by the resolution authorities should be subject to a right of appeal.

    Article 1

    Subject matter and scope

    1. This Regulation lays down temporary and strictly limited rules derogating from certain obligations laid down in Directive 2002/58/EC, with the sole objective of enabling providers of certain number-independent interpersonal communications services (‘providers’) to use, without prejudice to Regulation (EU) 2016/679, specific technologies for the processing of personal and other data to the extent strictly necessary to detect online child sexual abuse on their services and report it and to remove online child sexual abuse material from their services.

    2. This Regulation does not apply to the scanning of audio communications.

  • Directive (EU) 2022/2381 of the European Parliament and of the Council of 23 November 2022 on improving the gender balance among directors of listed companies and related measures

    Article 1

    Purpose

    This Directive aims to achieve a more balanced representation of women and men among the directors of listed companies by establishing effective measures that aim to accelerate progress towards gender balance, while allowing listed companies sufficient time to make the necessary arrangements for that purpose.

    (5) This Directive creates a legal framework to ensure freedom to provide electronic communications networks and services, subject only to the conditions laid down in this Directive and to any restrictions in accordance with Article 52(1) of the Treaty on the Functioning of the European Union (TFEU), in particular measures regarding public policy, public security and public health, and consistent with Article 52(1) of the Charter of Fundamental Rights of the European Union (the ‘Charter’).

    (6) This Directive is without prejudice to the possibility for each Member State to take the necessary measures to ensure the protection of its essential security interests, to safeguard public policy and public security, and to permit the investigation, detection and prosecution of criminal offences, taking into account that any limitation to the exercise of the rights and freedoms recognised by the Charter, in particular in Articles 7, 8 and 11 thereof, such as limitations regarding the processing of data, are to be provided for by law, respect the essence of those rights and freedoms and be subject to the principle of proportionality, in accordance with Article 52(1) of the Charter.
