Articolo 21 - Non discriminazione

1. È vietata qualsiasi forma di discriminazione fondata, in particolare, sul sesso, la razza, il colore della pelle o l'origine etnica o sociale, le caratteristiche genetiche, la lingua, la religione o le convinzioni personali, le opinioni politiche o di qualsiasi altra natura, l'appartenenza ad una minoranza nazionale, il patrimonio, la nascita, la disabilità, l'età o l'orientamento sessuale.
2. Nell'ambito d'applicazione dei trattati e fatte salve disposizioni specifiche in essi contenute, è vietata qualsiasi discriminazione in base alla nazionalità.

Spiegazioni

  • Text:

    Il paragrafo 1 si ispira all'articolo 13 del trattato CE, ora sostituito dall'articolo 19 del trattato sul funzionamento dell'Unione europea, e all'articolo 14 della CEDU, nonché all'articolo 11 della convenzione sui diritti dell'uomo e la biomedicina per quanto riguarda il patrimonio genetico. Nella misura in cui coincide con l'articolo 14 della CEDU, si applica in conformità dello stesso.
    Non v’è contraddizione né incompatibilità fra il paragrafo 1 e l’articolo 19 del trattato sul funzionamento dell'Unione europea, che ha campo d’applicazione e finalità diversi: l'articolo 19 conferisce all’Unione la facoltà di adottare atti legislativi, compresa l’armonizzazione delle disposizioni legislative e regolamentari degli Stati membri, per combattere alcune forme di discriminazione di cui l’articolo stesso riporta un elenco completo. La normativa in questione può regolamentare gli interventi delle autorità degli Stati membri (come pure i rapporti fra i privati) in qualsiasi settore entro i limiti delle competenze dell'Unione. La disposizione dell'articolo 21, paragrafo 1, invece, non conferisce nessuna facoltà di emanare norme contro la discriminazione in questi settori d’intervento degli Stati membri o nei rapporti fra privati né sancisce nessun divieto assoluto di discriminazione in settori così ampi. Essa infatti tratta soltanto delle discriminazioni ad opera delle istituzioni e degli organi dell’Unione stessi nell’esercizio delle competenze conferite ai sensi dei trattati e ad opera degli Stati membri soltanto quando danno attuazione al diritto dell’Unione. Il paragrafo 1 non altera quindi l’ampiezza delle facoltà conferite a norma dell’articolo 19 né l’interpretazione data a tale articolo.
    Il paragrafo 2 corrisponde all'articolo 18, primo comma, del trattato sul funzionamento dell'Unione europea e va applicato in conformità di tale articolo.

    Le presenti spiegazioni erano state elaborate, nella versione iniziale, sotto l'autorità del praesidium della Convenzione che aveva redatto la Carta dei diritti fondamentali dell’Unione europea e sono ora state aggiornate sotto la responsabilità del praesidium della Convenzione europea, sulla scorta degli adeguamenti redazionali che quest’ultima Convenzione ha apportato al testo della Carta (in particolare agli articoli 51 e 52) e dell’evoluzione del diritto dell’Unione.     Article 12 No act of law or other provision may imply the unfavourable treatment of anyone because they belong to a minority group by reason of ethnic origin, colour, or other similar circumstances or on account of their sexual orientation;

    Article 13 No act of law or other provision may imply the unfavourable treatment of anyone on grounds of gender, unless the provision forms part of efforts to promote equality between men and women or relates to compulsory military service or other equivalent official duties.

(5) Nothing contained in any law shall be held to be inconsistent with or in contravention of sub-article (1) of this article to the extent that it makes provision: (a) with respect to qualifications for service or conditions of service in any disciplined force; or (b) with respect to qualifications (not being qualifications specifically relating to sex) for service as a public officer or for service of a local government authority or a body corporate established for public purposes by any law. (6) Sub-article (2) of this article shall not apply to anything which is expressly or by necessary implication authorised to be done by any such provision of law as is referred to in sub-article (4) or (5) of this article. (7) Nothing contained in or done under the authority of any law shall be held to be inconsistent with or in contravention of this article to the extent that the law in question makes provision (not being provisions specifically relating to sex) whereby persons of any such description as is mentioned in sub-article (3) of this article may be subjected to any restriction on the rights and freedoms guaranteed by articles 38, 40, 41, 42 and 44 of this Constitution, being such a restriction as is authorised by article 38(2), 40(2), 41(2), 42(2) or 44(3). (8) Nothing in sub-article (2) of this article shall affect any discretion relating to the institution, conduct or discontinuance of civil or criminal proceedings in any court that is vested in any person by or under this Constitution or any other law. (9) A requirement, however made, that the Roman Catholic Apostolic Religion shall be taught by a person professing that religion shall not be held to be inconsistent with or in contravention of this article. (10) Until the expiration of a period of two years commencing on the lst July, 1991, nothing contained in any law made before the 1st July, 1991, shall be held to be inconsistent with the provisions of this article, in so far as that law provides for different treatment to different persons attributable wholly or mainly to their respective description by sex. (11) Nothing in the provisions of this article shall apply to any law or anything done under the authority of a law, or to any procedure or arrangement, in so far as such law, thing done, procedure or arrangement provides for the taking of special measures aimed at accelerating de facto equality between men and women, and in so far only as such measures, taking into account the social fabric of Malta, are shown to be reasonably justifiable in a democratic society.

    Article 1

    Subject matter

    This Regulation establishes the Citizens, Equality, Rights and Values Programme (the ‘Programme’) for the duration of the multiannual financial framework 2021-2027, as laid down in Regulation (EU, Euratom) 2020/2093.

    It lays down the objectives of the Programme, the budget for the period 2021–2027, the forms of Union funding and the rules for providing such funding.

    Preamble

    (103) This Regulation respects the fundamental rights and observes the principles recognised by Articles 2 and 6 TEU and by the Charter of Fundamental Rights of the European Union (‘the Charter’), in particular respect for human dignity, the right to life, the prohibition of torture and inhuman or degrading treatment or punishment, the prohibition of trafficking in human beings, the right to liberty and security, the right to the protection of personal data, the right of access to documents, the right to asylum and to protection against removal and expulsion, non-refoulement, non-discrimination and the rights of the child.

    Article 1: Subject matter

    This Regulation establishes a European Border and Coast Guard to ensure European integrated border management at the external borders with a view to managing those borders efficiently in full compliance with fundamental rights and to increasing the efficiency of the Union return policy.

    This Regulation addresses migratory challenges and potential future challenges and threats at the external borders. It ensures a high level of internal security within the Union in full respect of fundamental rights, while safeguarding the free movement of persons within the Union. It contributes to the detection, prevention and combating of cross-border crime at the external borders.

    Article 43: Instructions to the teams

    4.   Members of the teams shall, in the performance of their tasks and in the exercise of their powers, fully respect fundamental rights, including access to asylum procedures and human dignity, and shall pay particular attention to vulnerable persons. Any measures taken in the performance of their tasks and in the exercise of their powers shall be proportionate to the objectives pursued by such measures. While performing their tasks and exercising their powers, they shall not discriminate against persons on the basis of any grounds such as sex, race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or sexual orientation in line with Article 21 of the Charter.

  • Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 establishing minimum standards on the rights, support and protection of victims of crime, and replacing Council Framework Decision 2001/220/JHA

    Preamble:

    (14) In applying this Directive, children's best interests must be a primary consideration, in accordance with the Charter of Fundamental Rights of the European Union and the United Nations Convention on the Rights of the Child adopted on 20 November 1989. Child victims should be considered and treated as the full bearers of rights set out in this Directive and should be entitled to exercise those rights in a manner that takes into account their capacity to form their own views.
    (16) Victims of terrorism have suffered attacks that are intended ultimately to harm society. They may therefore need special attention, support and protection due to the particular nature of the crime that has been committed against them. Victims of terrorism can be under significant public scrutiny and often need social recognition and respectful treatment by society. Member States should therefore take particular account of the needs of victims of terrorism, and should seek to protect their dignity and security.’
    ‘(38) [...] A main task of these services and their staff, which play an important role in supporting the victim to recover from and overcome potential harm or trauma as a result of a criminal offence, should be to inform victims about the rights set out in this Directive so that they can take decisions in a supportive environment that treats them with dignity, respect and sensitivity. The types of support that such specialist support services should offer could include providing shelter and safe accommodation, immediate medical support, referral to medical and forensic examination for evidence in cases of rape or sexual assault, short and long-term psychological counselling, trauma care, legal advice, advocacy and specific services for children as direct or indirect victims.’
    ‘(52) Measures should be available to protect the safety and dignity of victims and their family members from secondary and repeat victimisation, from intimidation and from retaliation, such as interim injunctions or protection or restraining orders.’

    (66) This Directive respects fundamental rights and observes the principles recognised by the Charter of Fundamental Rights of the European Union. In particular, it seeks to promote the right to dignity, life, physical and mental integrity, liberty and security, respect for private and family life, the right to property, the principle of non-discrimination, the principle of equality between women and men, the rights of the child, the elderly and persons with disabilities, and the right to a fair trial.

    Article 18 - Right to protection
    ‘Without prejudice to the rights of the defence, Member States shall ensure that measures are available to protect victims and their family members from secondary and repeat victimisation, from intimidation and from retaliation, including against the risk of emotional or psychological harm, and to protect the dignity of victims during questioning and when testifying. When necessary, such measures shall also include procedures established under national law for the physical protection of victims and their family members.’

The right to freedom of expression is not unlimited but carries with it special duties and responsibilities. Freedom of expression should not aim at the destruction of the rights and freedoms of others, including the right to equality and non-discrimination.‘

Il presente manuale si prefigge lo scopo di illustrare in che modo il diritto e la giurisprudenza europei tengono conto degli interessi e delle esigenze specifici dei minori. Evidenzia altresì l’importanza del ruolo svolto dai genitori e dai tutori o da altri rappresentanti legali e fa riferimento, ove opportuno, alle situazioni in cui diritti e responsabilità sono conferiti prevalentemente alle persone che si prendono cura dei minori. Il manuale mira a sensibilizzare e migliorare le conoscenze delle norme di legge che proteggono e promuovono questi diritti in Europa. Esso rappresenta un punto di riferimento per quanto concerne sia il diritto dell’Unione europea (UE) sia il diritto del Consiglio d’Europa (CdE) in materia e illustra come ciascun tema sia disciplinato dal diritto dell’UE, compresa la Carta dei diritti fondamentali dell’Unione europea, oltre che dalla Convenzione europea dei diritti dell’uomo, dalla Carta sociale europea e da altri strumenti del Consiglio d’Europa.

    La Carta dei diritti fondamentali dell’Unione europea (CDFUE) è la dichiarazione dei diritti fondamentali dell’UE ed è sempre vincolante per le istituzioni e gli Stati membri dell’Unione quando questi agiscono nell’ambito del diritto dell’UE. Tuttavia, non è affatto facile valutare se un caso concreto rientra nell’ambito di applicazione del diritto dell’Unione europea. Ecco perché è necessario fornire materiale formative ai professionisti del diritto e formarli in modo che possano comprendere il campo di applicazione della Carta come stabilito nel suo articolo 51.     This report presents findings from FRA’s 2021 survey on Roma in Croatia, Czechia, Greece, Hungary, Italy, Portugal, Romania and Spain, as well as in North Macedonia and Serbia. The survey includes interviews with more than 8,400 Roma, collecting information on more than 20,000 individuals living in their households. By focusing on Roma, the survey provides unique data and information that are not available from European general population surveys, which do not disaggregate on grounds of ethnic origin. The findings present a bleak but familiar picture of exclusion, deprivation, discrimination and racism.

    La presente relazione esamina i motivi per cui le vittime non denunciano gli episodi motivati da pregiudizi e le barriere che incontrano quando denunciano gli episodi attraverso i sistemi nazionali di denuncia dei reati.
