    Key facts of the case:

    Ms H, a chinese citizen, is appealing the decision of the lower administrative court, which left her appeal against a notification by the chief of Migration Division (сектор „Миграция“) of Sofia Directorate of the Interior (Столична дирекция на вътрешните работи) without consideration and closed the judicial review proceedings. The notification concerned Migration Division’s negative opinion on an application for family reunification with Mr Sh, Ms H’s husband. The negative opinion allegedly violated their right to personal and family life, as the family could not be reunited. Mr Sh had previously served a prison sentence in Bulgaria and received a prohibition to enter the country.   

    Outcome of the case:

    The Court reiterates that the right to family life is a fundamental human right and looks at the domestic legal regulation of family reunification. In this sense, the Court finds that, although the right of a foreigner to enter and reside in a country is not guaranteed as such, not allowing him/her into a country where his/her family lives could be seen as violation of his/her right to family life. Thus, the right to family reunification is related to the right to family life, as seen also by the EU Family Reunification Directive. Therefore, if the right to reunification is not recognised by the competent authorities, family members should be able to protect their rights before the court. Thus, Ms H could appeal the negative opinion of migration authorities, practically barring her family reunification. SAC repealed the lower court’s refusal to consider Ms H’s appeal and returned the case to the lower court to continue proceedings.

    „As a fundamental human right, the right to family life is a matter of regulation also by EU law within the context of the right to family reunification of third country nationals, legally residing on the territory of Member States - Council Directive 2003/86/EC of 22 September 2003 on the right to family reunification (Directive 2003/86). As the right to family life of third country nationals is subject to regulation by EU law, the Charter of Fundamental Rights of the European Union (the Charter) is applicable to this right. Indeed, according to Art. 7 of the Charter, everyone has the right to respect for his or her family life...

    As noted above, the right to family reunification is an element of the right to family life under Art. 8, para. 1 of the ECHR. This subjective right belongs to each member of the family. In this regard, when this subjective right is not recognised by competent authorities, each family member is entitled to protect this right before the court. The fact that the Regulation for the Implementation of the Foreigners in the Republic of Bulgaria Act (Правилник за прилагане на Закона за чужденците в Република България) does not state that the act is subject to judicial review under the Administrative Procedure Code (Административнопроцесуален кодекс) is irrelevant, because, according to Art. 120, para. 2 of the Constitution all administrative acts, referring to a person, except those specifically stated by law, are subject to judicial review. The judicial review of the act under Art. 12, para. 3 of the Regulation is not excluded by law. But even if it was, the judicial review of such an act is guaranteed by Art. 18 of Directive 2003/86, according to which the Member States shall ensure that the sponsor and/or the members of his/her family have the right to mount a legal challenge where an application for family reunification is rejected. This is also guaranteed by Art. 47, para. 1 of the Charter. Thus, the right to judicial review of the act under Art. 12, para. 3 of the Regulation is guaranteed by EU law and, as national judges should guarantee to subjects the right, conferred to them by EU law, the judge should allow the judicial review of the act under Art. 12, para. 3 of the Regulation.“

    „Като основно човешко право, правото на семеен живот е предмет на регламентацията и от правото на Европейския съюз в контекста на упражняване на правото на събиране на семейството от граждани на трети страни, пребиваващи законно на територията на държавите членки – Директива 2003/86/ЕО на Съвета от 22.09.2003 г. относно правото на събиране на семейството (Директива 2003/86). Тъй като правото на семеен живот на гражданите на трети страни е предмет на регламентация на правото на Съюза, то приложение по отношение на това право намира и Хартата на основните права на Европейския съюз (Хартата). Съгласно чл. 7 от Хартата всеки има право на зачитане на неговия семеен живот...

    Както бе посочено по-горе правото на събиране на семейството е елемент на правото на семеен живот по смисъла на чл. 8 (1) ЕКПЧ. Това субективно право принадлежи на всеки от членовете на семейството. С оглед на това тогава, когато това субективно право не се признава от компетентния орган всеки член на семейството има право да защити правото си по съдебен ред. Факта, че в Правилника за прилагане на Закона за чужденците в Република България не е посочено, че този акт подлежи на съдебен контрол по реда на Административнопроцесуалния кодекс е ирелевантен, защото съгласно чл. 120, ал. 2 от Конституцията на обжалване по съдебен ред подлежат всички административни актове, които засягат съответното лице, освен изрично посочените със закон. Съдебното обжалване на акта по чл. 12, ал. 3 ППЗЧРБ не е изключено изрично със закон. Но дори и да беше, правото на обжалване пред съд на този акт е гарантирано на адресата му от чл. 18 Директива 2003/86, която задължава държавите членки да гарантират правото на кандидата и/или на членовете на неговото семейство да оспорят по законоустановения ред решенията, с които е отхвърлено заявлението за събиране на семейството. То е гарантирано и от чл. 47 (1) на Хартата. Следователно, правото на съдебно обжалване на акта по чл. 12 ал. 3 ППЗЧРБ е гарантирано от правото на Съюза и с оглед на задължението на националния съдия да гарантира на правните субекти предоставеното им от правото на Съюза право националният съдия е длъжен да допусне съдебен контрол на акта по чл. 12, ал. 3 ППЗЧРБ.“
