Článek 41 - Právo na řádnou správu

  1. Každý má právo na to, aby jeho záležitosti byly orgány, institucemi a jinými subjekty Unie řešeny nestranně, spravedlivě a v přiměřené lhůtě.
  2. Toto právo zahrnuje především:
    a) právo každého být vyslechnut před přijetím jemu určeného individuálního opatření, které by se jej mohlo nepříznivě dotknout;
    b) právo každého na přístup ke spisu, který se jej týká, při respektování oprávněných zájmů důvěrnosti a profesního a obchodního tajemství;
    c) povinnost správních orgánů odůvodňovat svá rozhodnutí.
  3. Každý má právo na to, aby mu Unie v souladu s obecnými zásadami společnými právním řádům členských států nahradila škodu způsobenou jejími orgány nebo jejími zaměstnanci při výkonu jejich funkce.
  4. Každý se může písemně obracet na orgány Unie v jednom z jazyků Smluv a musí obdržet odpověď ve stejném jazyce.

Vysvětlivky

    Článek 41 je založen na skutečnosti, že Unie je právním společenstvím, jehož znaky byly vymezeny v judikatuře, která mimo jiné zakotvila řádnou správu jako obecnou právní zásadu (viz mimo jiné rozsudek Soudního dvora ze dne 31. března 1992 ve věci C-255/90 P Burban, Sb. rozh. 1992, s. I-2253, a rozsudky Soudu prvního stupně ze dne 18. září 1995 ve věci T-167/94 Nölle, Sb. rozh. 1995, s. II-2589, a ze dne 9. července 1999 ve věci T-231/97 New Europe Consulting a další, Sb. rozh. 1999, s. II-2403). Znění tohoto práva uvedené v prvních dvou odstavcích vychází z judikatury (rozsudek Soudního dvora ze dne 15. října 1987 ve věci 222/86 Heylens, Sb. rozh. 1987, s. 4097, 15. bod, rozsudek ze dne 18. října 1989 ve věci 374/87 Orkem, Sb. rozh. 1989, s. 3283, rozsudek ze dne 21. listopadu 1991 ve věci C-269/90 TU München, Sb. rozh. 1991, s. I-5469 a rozsudky Soudu prvního stupně ze dne 6. prosince 1994 ve věci T-450/93 Lisrestal, Sb. rozh. 1994, s. II-1177 a ze dne 18. září 1995 ve věci T-167/94 Nölle, Sb. rozh. 1995, s. II-2589), a pokud jde o povinnosti podat odůvodnění, z článku 296 Smlouvy o fungování Evropské unie (viz též právní základ pro přijetí právních předpisů v zájmu otevřené, efektivní a nezávislé evropské správy v článku 298 Smlouvy o fungování Evropské unie).

    Odstavec 3 opakuje právo, které nyní zaručuje článek 340 Smlouvy o fungování Evropské unie. Odstavec 4 opakuje právo, které nyní zaručuje čl. 20 odst. 2 písm. d) a článek 25 Smlouvy o fungování Evropské unie. V souladu s čl. 52 odst. 2 Listiny jsou tato práva vykonávána za podmínek a v rámci, jež jsou vymezeny ve Smlouvách.

    Právo na účinnou soudní ochranu, které představuje důležitou součást této otázky, je zaručeno v článku 47 této listiny.

    Tato vysvětlení byla původně vyhotovena pod vedením prezídia Konventu, který vypracoval Listinu základních práv Evropské unie. Byla aktualizována pod vedením prezídia Evropského konventu s ohledem na změny návrhu znění Listiny provedené Konventem (zejména článků 51 a 52) a na vývoj práva Unie. Ačkoliv sama nemají právní závaznost, jsou cenným výkladovým nástrojem pro vyjasnění ustanovení Listiny.

    the founding treaties of the European Union and the measures undertaken pursuant to such
    treaties.
    In the Republic of Croatia, all rights guaranteed by the European Union acquis
    communautaire shall be enjoyed by all citizens of the European Union.

This right may be circumscribed pursuant to law to protect the rights and freedoms of others, to protect the confidentiality of a child’s filiation, and in the interests of preventing a criminal offence, apprehending the offender, or of ascertaining the truth in a criminal case.
    Unless otherwise provided by law, citizens of foreign states and stateless persons in Estonia enjoy the rights specified in paragraphs two and three of this section equally with citizens of Estonia.
    Article 46. Everyone has the right to address informational letters and petitions to government agencies, local authorities, and their officials. The procedure for responding to such letters and petitions is provided by law.

Citizens shall be guaranteed the right to criticise the work of State institutions or their officials, and to appeal against their decisions. Persecution for criticism shall be prohibited. Citizens shall be guaranteed the right to petition; the procedure for its implementation shall be established by law.

(3) Každý má právo na náhradu škody způsobené mu nezákonným rozhodnutím soudu, jiného státního orgánu či orgánu veřejné správy nebo nesprávným úředním postupem. Tryb udzielania informacji, o których mowa w ust. 1 i 2, określają ustawy, a w odniesieniu do Sejmu i Senatu ich regulaminy. Art. 63. Każdy ma prawo składać petycje, wnioski i skargi w interesie publicznym, własnym lub innej osoby za jej zgodą do organów władzy publicznej oraz do organizacji i instytucji społecznych w związku z wykonywanymi przez nie zadaniami zleconymi z zakresu administracji publicznej. Tryb rozpatrywania petycji, wniosków i skarg określa ustawa. Art. 77.1. Citizens also have the right to challenge administrative norms which have external force and harm those of their rights or interests that are protected by law. 6. For the purposes of paragraphs (1) and (2) the law shall lay down a maximum time limit for responses by the Administration. Article 271 (Liability of public sector staff and agents) (1) The staff and agents of the state and of other public entities are civilly and criminally liable and subject to disciplinary proceedings for their actions and omissions in the exercise of their functions, and for any such exercise that leads to a breach of those citizens’ rights or interests that are protected by law, and no phase of any action or proceedings shall be dependent on authorisation by higher authority.

    ‘1. In order to step up the fight against fraud, corruption and any other illegal activity affecting the financial interests of the European Union and of the European Atomic Energy Community (hereinafter referred to collectively, when the context so requires, as ‘the Union’), the European Anti-Fraud Office established by Decision 1999/352/EC, ECSC, Euratom (‘the Office’) shall exercise the powers of investigation conferred on the Commission by:
    (a) the relevant Union acts; and
