    Key facts of the case: 

    The President of the Republic referred for an Opinion to the Supreme a law voted for by parliament in 2016, which had introduced a quota of one third women in the management boards of public organisations. Counsel for the President argued that the law is unconstitutional, contrary to the ECHR and the Charter of Fundamental Rights. The President argued that the quota in favour of women was unconstitutional for infringing the equality provisions of the Constitution, as it introduces positive discrimination in favour of women and this cannot be saved either by article 157(4) of the Treaty for the Functioning of the European Union, nor by the Charter of Fundamental Rights.

    The House of Representatives argued that the equality principle as provided in the Cypriot Constitution is not violated, because the law in question does not result in discrimination between equals and if it does create discrimination, this is reasonable discrimination and not arbitrary, it serves the public interest and is in line with the principle of proportionality. In support of this position, Counsel for the House cited the UN Convention on the Elimination of All types of Discrimination against Women and a number of Cypriot judgements.

     

    Outcome of the case: 

    Article 157(4) of the TFEU (former article 141 of Treaty of the European Union) cannot be used in order to check the constitutionality of a law regulating the appointment of women in management boards of public organisations because the measures foreseen in the law under question are not intended to ensure equality in employment. Instead the measure amounts to positive discrimination in other words preference of women candidates over men candidates irrespective of qualifications, which is not reasonable discrimination but an arbitrary one from a constitutional point of view which disregards objective criteria for appointment. Charter article 23 does not apply because the issue at stake does not concern Union law, as per article 51 of the Charter.  The Court unanimously concluded that the specific provision is not allowed under Cypriot law as it is measure of positive discrimination and affirmative action in favour of women in breach of basic equality provisions of the Cypriot constitution that cannot be saved with reference to EU law. The law is therefore null and void.

    According to the applicant’s submission, the Law institutionalises the introduction of positive discrimination in favor of, where appropriate, under-represented gender, which is inconsistent with Article 28 of the Constitution. In addition, the positive distinction introduced cannot be rescued either by Article 23 of the Charter of Fundamental Rights of the European Union or by Article 157 (4) of the Treaty on the Functioning of the European Union (TFEU).

    We therefore believe that the Law violates Article 28 of the Constitution. Article 157 (4) TFEU (formerly Article 141 of the EC Treaty) and Article 23 of the Charter of Fundamental Rights of the European Union do not apply. Article 157 (4) provides that, in order to ensure full equality in practice between men and women at work, the principle of equal treatment shall not prevent Member States from maintaining or adopting measures providing for specific advantages which facilitate the least represented gender to continue a professional activity or to prevent or compensate for disadvantages in the professional career. In the present case, with the main reservation of the Law, measures providing for special advantages in favour of the least represented gender with a view to ensuring gender equality at work are not maintained or adopted. The Act provides for positive discrimination, favoring the candidates of the least represented sex on the boards of certain bodies governed by public law.

    Article 23 of the Charter of Fundamental Rights of the European Union states that equality between men and women must be ensured in all areas, including employment, work and pay. The principle of equality does not exclude the maintenance or adoption of measures which provide for special advantages in favour of the less represented gender. Article 23 is not applicable in the present case, since the law does not provide for the implementation of Union law and Article 23 only applies in the case of the implementation of Union law (see Article 51 of the Charter). Therefore Article 23 of the Charter cannot rescue the Law either.

    Σύμφωνα με την εισήγηση του Αιτητή ο Νόμος θεσμοθετεί την εισαγωγή θετικής διάκρισης υπέρ του, κατά περίπτωση, υποεκπροσωπούμενου φύλου, η οποία δεν συνάδει με το Άρθρο 28 του Συντάγματος.  Επιπρόσθετα η εισαγόμενη θετική διάκριση δεν μπορεί να διασωθεί από το Άρθρο 23 του Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης αλλά ούτε και από το άρθρο 157(4) της Συνθήκης Λειτουργίας της Ευρωπαϊκής Ένωσης (ΣΛΕΕ).  

    Κρίνομε λοιπόν ότι, με το Νόμο, γίνεται παραβίαση του Άρθρου 28 του Συντάγματος.  Το άρθρο 157(4) της ΣΛΕΕ (πρώην άρθρο 141 της Συνθήκης της Ευρωπαϊκής Κοινότητας), και το άρθρο 23 του Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης δεν τυγχάνουν εφαρμογής.   Το άρθρο 157(4) προνοεί ότι, προκειμένου να εξασφαλιστεί εμπράκτως η πλήρης ισότητα μεταξύ ανδρών και γυναικών στην εργασία, η αρχή της Ίσης Μεταχείρισης δεν εμποδίζει τα Κράτη Μέλη να διατηρήσουν ή να θεσπίσουν μέτρα που προβλέπουν ειδικά πλεονεκτήματα, τα οποία διευκολύνουν το λιγότερο εκπροσωπούμενο φύλο να συνεχίσει μιαν επαγγελματική δραστηριότητα ή προλαμβάνουν ή αντισταθμίζουν τα μειονεκτήματα στην επαγγελματική σταδιοδρομία.  Στην προκείμενη περίπτωση, με την κύρια επιφύλαξη του Νόμου, δεν διατηρούνται ή θεσπίζονται μέτρα που προβλέπουν ειδικά πλεονεκτήματα υπέρ του λιγότερο εκπροσωπούμενου φύλου με σκοπό την εξασφάλιση της ισότητας μεταξύ των δύο φύλων στην εργασία.   Με το Νόμο προνοείται θετική διάκριση, εύνοια δηλαδή, υπέρ των υποψηφίων του λιγότερο εκπροσωπούμενου φύλου στα διοικητικά συμβούλια ορισμένων οργανισμών δημοσίου δικαίου.   

     

    Το άρθρο 23 του Χάρτη Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης διακηρύττει ότι η ισότητα μεταξύ ανδρών και γυναικών πρέπει να διασφαλίζεται σε όλους τους τομείς, περιλαμβανομένης της απασχόλησης, της εργασίας και της αμοιβής.   Η αρχή της Ισότητας δεν αποκλείει τη διατήρηση ή την υιοθέτηση μέτρων τα οποία προνοούν για ειδικά πλεονεκτήματα υπέρ του λιγότερου εκπροσωπούμενου φύλου.   Το άρθρο 23 δεν ισχύει στην προκείμενη περίπτωση, καθότι με το Νόμο δεν γίνεται πρόνοια για εφαρμογή ενωσιακού δικαίου και το άρθρο 23 ισχύει μόνο στις περιπτώσεις εφαρμογής του ενωσιακού δικαίου (Δέστε άρθρο 51 του Χάρτη).  Επομένως ούτε και το άρθρο 23 του Χάρτη μπορεί να διασώσει το Νόμο.
