    Key facts of the case

    The Act of 25 December 2016 to amend the legal status of prisoners, surveillance in prisons and divers provisions concerning justice inserted a new Article in the Judicial Code. Article 81 of this Act inserts the obligation for “unnecessary costs” to be borne by the party that improperly caused these costs.

    The plaintiffs issued an action for annulment of Article 81 since this measure inserts a financial restriction on the access to justice.

    Key legal question raised by the Court

    Does allowing the judge to automatically impose the payment of certain costs upon the party that causes these costs, consist of a restriction of the right to access to justice? 

    Outcome of the case

    The Constitutional Court rejected the action for annulment. In its argumentation, the Court bases itself on the case law of the European Court of Human Rights. The right of access to justice, that is part of the right to a fair trial can be subject to limitations, even if these are of a financial nature. Such restrictions may not, however, affect the very essence of the right of access to a court. Furthermore, limitations are not compatible with the right to access to justice if they do not pursue a legitimate aim and if there is no reasonable connection between them and the proportionality between the means employed and the objective pursued. (ECHR 14 December 2006, Markovic v. Italy, §99).

    The Constitutional Court applied this case law and concluded that Article 81 pursues legal objectives by ensuring loyalty between parties. Thus the measure is not an unlawful limitation to the right to access to justice.

    B.2 The first plea is derived from an infringement of Articles 10, 11 and 13 of the Constitution,  whether or not read in conjunction with Articles 6 and 13 of the European Convention on Human Rights and Article 47 of the Charter of Fundamental Rights of the European Union. First, the contested provision would generally restrict the right of access to justice of the successful party in an unjustified manner. Secondly, specifically as regards the recovery of monetary debts, it would create an unjustified difference in treatment between, on the one hand, creditors of a disputed monetary debt and, on the other, creditors of a manifestly undisputed monetary debt or of a monetary debt which is not known or which will be disputed, since the latter would have to bear the financial risk of the costs of the proceedings and would thus have a more limited right of access to justice.

    The second plea is derived an infringement of Articles 10 and 11 of the Constitution, read together with the general principles of the rule of law and checks and balances, the principle of judicial neutrality, the right to defence, Articles 6 and 13 of the European Convention on Human Rights and Article 47 of the Charter of Fundamental Rights of the European Union, in that it provides the judge with the competence to impose the unnecessary costs automatically upon the successful party in the proceedings if it improperly caused these costs.

    B.2. Het eerste middel is afgeleid uit een schending door de bestreden bepaling van de artikelen 10, 11 en 13 van de Grondwet, al dan niet in samenhang gelezen met de artikelen 6 en 13 van het Europees Verdrag voor de rechten van de mens en met artikel 47 van het Handvest van de grondrechten van de Europese Unie. Ten eerste zou de bestreden bepaling in het algemeen het recht op toegang tot de rechter van de in het gelijk gestelde partij op een niet-verantwoorde wijze beperken. Ten tweede zou ze, specifiek wat de invordering van geldschulden betreft, een niet-verantwoord verschil in behandeling instellen tussen, enerzijds, schuldeisers van een betwiste geldschuld en, anderzijds, schuldeisers van een klaarblijkelijk onbetwiste geldschuld of van een geldschuld waarvan niet geweten is of die zal worden betwist, aangezien de laatstgenoemden het financiële risico voor de kosten van het geding zouden moeten dragen en aldus zouden beschikken over een beperkter recht op toegang tot de rechter.

    Het tweede middel is afgeleid uit een schending door de bestreden bepaling van de artikelen 10 en 11 van de Grondwet, in samenhang gelezen met de algemene beginselen van de rechtsstaat en van het evenwicht der machten, met het beschikkingsbeginsel, met de rechten van verdediging, met de artikelen 6 en 13 van het Europees Verdrag voor de rechten van de mens en met artikel 47 van het Handvest van de grondrechten van de Europese Unie, doordat aan de rechter de bevoegdheid wordt toegekend om ambtshalve de nutteloze kosten ten laste van de in het gelijk gestelde partij te leggen wanneer ze die foutief heeft veroorzaakt.
