Άρθρο 21 - Απαγόρευση διακρίσεων

1. Απαγορεύεται κάθε διάκριση ιδίως λόγω φύλου, φυλής, χρώματος, εθνοτικής καταγωγής ή κοινωνικής προέλευσης, γενετικών χαρακτηριστικών, γλώσσας, θρησκείας ή πεποιθήσεων, πολιτικών φρονημάτων ή κάθε άλλης γνώμης, ιδιότητας μέλους εθνικής μειονότητας, περιουσίας, γέννησης, αναπηρίας, ηλικίας ή γενετήσιου προσανατολισμού.
2. Εντός του πεδίου εφαρμογής των Συνθηκών και με την επιφύλαξη των ειδικών διατάξεών τους, απαγορεύεται κάθε διάκριση λόγω ιθαγενείας.

Επεξηγήσεισ

    Η παράγραφος 1 πηγάζει από το άρθρο 13 της Συνθήκης ΕΚ, που πλέον έχει αντικατασταθεί από το άρθρο 19 της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης, από το άρθρο 14 της ΕΣΑΔ καθώς και από το άρθρο 11 της Σύμβασης για τα ανθρώπινα δικαιώματα και τη βιοϊατρική όσον αφορά τη γενετική κληρονομιά. Εφόσον συμπίπτει με το άρθρο 14 της ΕΣΑΔ, εφαρμόζεται σύμφωνα με το εν λόγω άρθρο.
    Δεν υπάρχει καμία αντίφαση ή ασυμβατότητα μεταξύ της παραγράφου 1 και του άρθρου 19 της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης, το οποίο έχει διαφορετικό πεδίο εφαρμογής και αντικείμενο: το άρθρο 19 απονέμει στην Ένωση την αρμοδιότητα να θεσπίζει νομοθετικές πράξεις, μεταξύ άλλων προς εναρμόνιση των νομοθετικών και κανονιστικών διατάξεων των κρατών μελών, για την καταπολέμηση ορισμένων μορφών διακρίσεων που απαριθμούνται εξαντλητικά στο εν λόγω άρθρο. Η συγκεκριμένη νομοθεσία μπορεί να καλύπτει τη δράση των αρχών κράτους μέλους (καθώς και τις σχέσεις μεταξύ ιδιωτών) σε οποιοδήποτε τομέα εντός των ορίων των αρμοδιοτήτων της Ένωσης. Αντίθετα, η διάταξη της παραγράφου 1 του άρθρου 21 δεν παρέχει καμία αρμοδιότητα θέσπισης νόμων κατά των διακρίσεων σε αυτούς τους τομείς δράσης των κρατών μελών ή ιδιωτών, ούτε καθορίζει γενικές απαγορεύσεις διακρίσεων στους εν λόγω τομείς. Αντ’ αυτού, αφορά μόνο περιπτώσεις διακρίσεων από τα θεσμικά και λοιπά όργανα της Ένωσης, κατά την άσκηση των αρμοδιοτήτων τους που τους έχουν ανατεθεί δυνάμει των Συνθηκών, καθώς και από τα κράτη μέλη μόνον όταν εφαρμόζουν το δίκαιο της Ένωσης. Επομένως, η παράγραφος 1 δεν επηρεάζει το εύρος των αρμοδιοτήτων που παρέχονται δυνάμει του άρθρου 19 ούτε την ερμηνεία που δίνεται στο άρθρο αυτό.
    Η παράγραφος 2 αντιστοιχεί στο άρθρο 18, πρώτο εδάφιο της Συνθήκης για τη λειτουργία της Ευρωπαϊκής Ένωσης και πρέπει να εφαρμόζεται σύμφωνα με το εν λόγω άρθρο.

    Οι κάτωθι παρατιθέμενες επεξηγήσεις καταρτίσθηκαν αρχικά υπ’ ευθύνη του Προεδρείου της Συνέλευσης που συνέταξε τον Χάρτη των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης. Ενημερώθηκαν με ευθύνη του Προεδρείου της Ευρωπαϊκής Συνέλευσης, κατόπιν των αναπροσαρμογών που επήλθαν στο κείμενο του Χάρτη από τη Συνέλευση αυτή (ιδίως στα άρθρα 51 και 52) και των εξελίξεων του δικαίου της Ένωσης. Αν και οι επεξηγήσεις αυτές καθαυτές δεν έχουν νομική ισχύ, αποτελούν πολύτιμο εργαλείο ερμηνείας για την εξήγηση των διατάξεων του Χάρτη.

    Article 1

    Subject matter

    This Regulation establishes the Citizens, Equality, Rights and Values Programme (the ‘Programme’) for the duration of the multiannual financial framework 2021-2027, as laid down in Regulation (EU, Euratom) 2020/2093.

    It lays down the objectives of the Programme, the budget for the period 2021–2027, the forms of Union funding and the rules for providing such funding.

    Preamble

    (103) This Regulation respects the fundamental rights and observes the principles recognised by Articles 2 and 6 TEU and by the Charter of Fundamental Rights of the European Union (‘the Charter’), in particular respect for human dignity, the right to life, the prohibition of torture and inhuman or degrading treatment or punishment, the prohibition of trafficking in human beings, the right to liberty and security, the right to the protection of personal data, the right of access to documents, the right to asylum and to protection against removal and expulsion, non-refoulement, non-discrimination and the rights of the child.

    Article 1: Subject matter

    This Regulation establishes a European Border and Coast Guard to ensure European integrated border management at the external borders with a view to managing those borders efficiently in full compliance with fundamental rights and to increasing the efficiency of the Union return policy.

    This Regulation addresses migratory challenges and potential future challenges and threats at the external borders. It ensures a high level of internal security within the Union in full respect of fundamental rights, while safeguarding the free movement of persons within the Union. It contributes to the detection, prevention and combating of cross-border crime at the external borders.

    Article 43: Instructions to the teams

    4.   Members of the teams shall, in the performance of their tasks and in the exercise of their powers, fully respect fundamental rights, including access to asylum procedures and human dignity, and shall pay particular attention to vulnerable persons. Any measures taken in the performance of their tasks and in the exercise of their powers shall be proportionate to the objectives pursued by such measures. While performing their tasks and exercising their powers, they shall not discriminate against persons on the basis of any grounds such as sex, race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or sexual orientation in line with Article 21 of the Charter.

  • Directive 2012/29/EU of the European Parliament and of the Council of 25 October 2012 establishing minimum standards on the rights, support and protection of victims of crime, and replacing Council Framework Decision 2001/220/JHA

    Preamble:

    (14) In applying this Directive, children's best interests must be a primary consideration, in accordance with the Charter of Fundamental Rights of the European Union and the United Nations Convention on the Rights of the Child adopted on 20 November 1989. Child victims should be considered and treated as the full bearers of rights set out in this Directive and should be entitled to exercise those rights in a manner that takes into account their capacity to form their own views.
    (16) Victims of terrorism have suffered attacks that are intended ultimately to harm society. They may therefore need special attention, support and protection due to the particular nature of the crime that has been committed against them. Victims of terrorism can be under significant public scrutiny and often need social recognition and respectful treatment by society. Member States should therefore take particular account of the needs of victims of terrorism, and should seek to protect their dignity and security.’
    ‘(38) [...] A main task of these services and their staff, which play an important role in supporting the victim to recover from and overcome potential harm or trauma as a result of a criminal offence, should be to inform victims about the rights set out in this Directive so that they can take decisions in a supportive environment that treats them with dignity, respect and sensitivity. The types of support that such specialist support services should offer could include providing shelter and safe accommodation, immediate medical support, referral to medical and forensic examination for evidence in cases of rape or sexual assault, short and long-term psychological counselling, trauma care, legal advice, advocacy and specific services for children as direct or indirect victims.’
    ‘(52) Measures should be available to protect the safety and dignity of victims and their family members from secondary and repeat victimisation, from intimidation and from retaliation, such as interim injunctions or protection or restraining orders.’

    (66) This Directive respects fundamental rights and observes the principles recognised by the Charter of Fundamental Rights of the European Union. In particular, it seeks to promote the right to dignity, life, physical and mental integrity, liberty and security, respect for private and family life, the right to property, the principle of non-discrimination, the principle of equality between women and men, the rights of the child, the elderly and persons with disabilities, and the right to a fair trial.

    Article 18 - Right to protection
    ‘Without prejudice to the rights of the defence, Member States shall ensure that measures are available to protect victims and their family members from secondary and repeat victimisation, from intimidation and from retaliation, including against the risk of emotional or psychological harm, and to protect the dignity of victims during questioning and when testifying. When necessary, such measures shall also include procedures established under national law for the physical protection of victims and their family members.’

In addition to its inclusion in article 5, freedom of opinion and expression is recognized as a fundamental right in a broad range of international instruments, including the Universal Declaration of Human Rights, which affirm that everyone has the right to hold opinions and to seek, receive and impart information and ideas of all kinds through any media and regardless of frontiers. The right to freedom of expression is not unlimited but carries with it special duties and responsibilities. It may therefore be subject to certain restrictions, but only if they are provided by law and are necessary for protection of the rights or reputations of others and for the protection of national security or of public order, or of public health or morals. Freedom of expression should not aim at the destruction of the rights and freedoms of others, including the right to equality and non-discrimination.‘

Χαίρουν του συνόλου των ανθρώπινων και θεμελιωδών δικαιωμάτων και τυγχάνουν ειδικής κανονιστικής μεταχείρισης, λόγω των ιδιαίτερων χαρακτηριστικών τους. Στο παρόν εγχειρίδιο επιχειρείται να καταδειχθεί ο τρόπος με τον οποίο η ευρωπαϊκή νομοθεσία και νομολογία επιλαμβάνεται των συγκεκριμένων συμφερόντων και των αναγκών των παιδιών. Αναδεικνύεται επίσης η σημασία του ρόλου των γονέων και επιτρόπων ή άλλων προσώπων που έχουν νόμιμα την ευθύνη για τα παιδιά, κάνοντας μνεία, όπου κρίνεται σκόπιμο, στις περιπτώσεις που τα σχετικά δικαιώματα και ευθύνες ανήκουν κατά κύριο λόγο στα πρόσωπα που έχουν τη φροντίδα των παιδιών. Αποτελεί ένα πρώτο σημείο αναφοράς για το δίκαιο τόσο της Ευρωπαϊκής Ένωσης (ΕΕ) όσο και του Συμβουλίου της Ευρώπης (ΣτΕ) αναφορικά με τα θέματα αυτά και εξηγεί πώς αντιμετωπίζεται κανονιστικά το κάθε ζήτημα στο πλαίσιο του νωσιακού δικαίου, αλλά και της Ευρωπαϊκής Σύμβασης Δικαιωμάτων του Ανθρώπου, του Ευρωπαϊκού Κοινωνικού Χάρτη και άλλων πράξεων του ΣτΕ.

    Ο Χάρτης των Θεμελιωδών Δικαιωμάτων της Ευρωπαϊκής Ένωσης («ο Χάρτης») συνιστά τη διακήρυξη δικαιωμάτων της ΕΕ. Λειτουργεί πάντα δεσμευτικά για τα θεσμικά όργανα της ΕΕ καθώς και τα κράτη μέλη, όταν αυτά δρουν εντός του πεδίου εφαρμογής του δικαίου της Ένωσης. Ωστόσο, η εκτίμηση του εάν μια συγκεκριμένη υπόθεση εμπίπτει στο πεδίο εφαρμογής του δικαίου της Ένωσης παρουσιάζει δυσκολίες. Για αυτόν τον λόγο είναι απαραίτητη η κατάρτιση των ασκούντων νομικά επαγγέλματα και η παροχή σε αυτούς εκπαιδευτικού υλικού, ώστε να είναι σε θέση να κατανοούν το πεδίο εφαρμογής του Χάρτη όπως ορίζεται στο άρθρο 51 αυτού. Το παρόν εγχειρίδιο εκπαιδευτή έχει ως στόχο να παρέχει καθοδήγηση τόσο σε επίπεδο οργάνωσης όσο και σε επίπεδο υλοποίησης των εν λόγω προγραμμάτων κατάρτισης με βάση μια σειρά από μελέτες περίπτωσης, οι οποίες θα εμπλουτιστούν μελλοντικά.

    This report presents findings from FRA’s 2021 survey on Roma in Croatia, Czechia, Greece, Hungary, Italy, Portugal, Romania and Spain, as well as in North Macedonia and Serbia. The survey includes interviews with more than 8,400 Roma, collecting information on more than 20,000 individuals living in their households. By focusing on Roma, the survey provides unique data and information that are not available from European general population surveys, which do not disaggregate on grounds of ethnic origin. The findings present a bleak but familiar picture of exclusion, deprivation, discrimination and racism.

    Το 2021 σημειώθηκε πρόοδος, αλλά και οπισθοδρόμηση στην προστασία των θεμελιωδών δικαιωμάτων. Στην Έκθεση για τα Θεμελιώδη Δικαιώματα 2022 του FRA εξετάζονται οι σημαντικότερες εξελίξεις στον τομέα και προσδιορίζονται τόσο τα επιτεύγματα όσο και τα ζητήματα που εξακολουθούν να προκαλούν ανησυχία. Στην παρούσα έκδοση παρουσιάζονται οι γνώμες του FRA σχετικά με τις κυριότερες εξελίξεις στους εξεταζόμενους θεματικούς τομείς και συνοψίζεται η τεκμηρίωση στην οποία στηρίχθηκαν οι εν λόγω γνώμες. Με αυτόν τον τρόπο, παρέχεται συνοπτική και ταυτόχρονα κατατοπιστική επισκόπηση των βασικών προκλήσεων που αντιμετωπίζουν η ΕΕ και τα κράτη μέλη στον τομέα των θεμελιωδών δικαιωμάτων.

    Τα εγκλήματα μίσους που υποκινούνται από τον ρατσισμό, την ξενοφοβία, τη θρησκευτική μισαλλοδοξία ή την αναπηρία ενός ατόμου, τον γενετήσιο προσανατολισμό, την ταυτότητα φύλου, την έκφραση φύλου και τα χαρακτηριστικά του φύλου αποτελούν σοβαρές εκφράσεις διακρίσεων. Εκτός από την παραβίαση των δικαιωμάτων των μεμονωμένων θυμάτων, ένα τέτοιο έγκλημα αποδυναμώνει την κοινωνική συνοχή και βλάπτει το κοινωνικό σύνολο.

    Ο παρών οδηγός εξηγεί τι είναι η κατάρτιση προφίλ, τα νομικά πλαίσια που τη διέπουν και τον λόγο για τον οποίο η νόμιμη κατάρτιση προφίλ δεν είναι μόνο απαραίτητη για τη συμμόρφωση με τα θεμελιώδη δικαιώματα, αλλά και καίριας σημασίας για την αποτελεσματική αστυνόμευση και διαχείριση των συνόρων. Ο οδηγός παρέχει επίσης πρακτικές οδηγίες σχετικά με τρόπους αποφυγής της παράνομης κατάρτισης προφίλ στο πλαίσιο αστυνομικών επιχειρήσεων και επι-χειρήσεων διαχείρισης των συνόρων.
