Artikel 54 - Verbod van misbruik van recht

Geen van de bepalingen van dit Handvest mag worden uitgelegd als zou zij het recht inhouden enige activiteit te ontplooien of enige daad te verrichten met als doel de in dit Handvest erkende rechten of vrijheden teniet te doen of de rechten en vrijheden verdergaand te beperken dan door dit Handvest is toegestaan..

    Dit artikel correspondeert met artikel 17 van het EVRM:

    `Geen der bepalingen van dit Verdrag mag worden uitgelegd als zou zij voor een staat, een groep of een persoon het recht inhouden enige activiteit aan de dag te leggen of enige daad te verrichten met als doel de rechten of vrijheden die in dit Verdrag zijn vermeld teniet te doen of deze verdergaand te beperken dan bij dit Verdrag is voorzien.`.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.
