Artikel 52 - Reikwijdte en uitlegging van de gewaarborgde rechten en beginselen

1. Beperkingen op de uitoefening van de in dit Handvest erkende rechten en vrijheden moeten bij wet worden gesteld en de wezenlijke inhoud van die rechten en vrijheden eerbiedigen. Met inachtneming van het evenredigheidsbeginsel kunnen slechts beperkingen worden gesteld, indien zij noodzakelijk zijn en daadwerkelijk beantwoorden aan door de Unie erkende doelstellingen van algemeen belang of aan de eisen van de bescherming van de rechten en vrijheden van anderen. 2. De door dit Handvest erkende rechten die voorkomen in bepalingen van de Verdragen, worden uitgeoefend onder de voorwaarden en binnen de grenzen die door deze Verdragen zijn gesteld. 3. Voor zover dit Handvest rechten bevat die corresponderen met rechten welke zijn gegarandeerd door het Europees Verdrag tot bescherming van de rechten van de mens en de fundamentele vrijheden, zijn de inhoud en reikwijdte ervan dezelfde als die welke er door genoemd verdrag aan worden toegekend. Deze bepaling verhindert niet dat het recht van de Unie een ruimere bescherming biedt. 4. Voor zover dit Handvest grondrechten erkent zoals die voortvloeien uit de constitutionele tradities die de lidstaten gemeen hebben, moeten die rechten in overeenstemming met die tradities worden uitgelegd. 5. Aan de bepalingen van dit Handvest die beginselen bevatten, kan uitvoering worden gegeven door wetgevings- en uitvoeringshandelingen van de instellingen, organen en instanties van de Unie en door handelingen van de lidstaten wanneer zij het recht van de Unie ten uitvoer brengen, bij de uitoefening van hun respectieve bevoegdheden. De rechterlijke bevoegdheid ten aanzien van die bepalingen blijft beperkt tot de uitlegging van genoemde handelingen en de toetsing van de wettigheid ervan. 6. Met de nationale wetgevingen en praktijken moet ten volle rekening worden gehouden, zoals bepaald in dit Handvest. 7. De toelichting, die is opgesteld om richting te geven aan de uitlegging van dit Handvest van de grondrechten, wordt door de rechterlijke instanties van de Unie en van de lidstaten naar behoren in acht genomen.

Toelichtingen

    Artikel 52 stelt de reikwijdte van de rechten en beginselen van het Handvest vast, alsmede de regels voor de uitlegging daarvan. Lid 1 gaat over de beperkingsregeling. De gebruikte formulering is geïnspireerd op de jurisprudentie van het Hof van Justitie: `... Volgens vaste rechtspraak kan de uitoefening van deze fundamentele rechten, met name in het kader van een gemeenschappelijke marktordening, evenwel aan beperkingen worden onderworpen, voor zover die beperkingen werkelijk beantwoorden aan de doeleinden van algemeen belang die de Gemeenschap nastreeft en, het nagestreefde doel in aanmerking genomen, niet zijn te beschouwen als een onevenredige en onduldbare ingreep, waardoor de gewaarborgde rechten in hun kern worden aangetast.` (Arrest van 13 april 2000, zaak C-292/97, r.o. 45). Met de door de Unie erkende doelstellingen van algemeen belang worden zowel de in artikel 3 van het Verdrag betreffende de Europese Unie genoemde doelen bedoeld als de andere belangen die beschermd worden door specifieke bepalingen van de Verdragen, zoals artikel 4, lid 1, van het Verdrag betreffende de Europese Unie, artikel 35, lid 3, van het Verdrag betreffende de werking van de Europese Unie en de artikelen 36 en 346 van dat Verdrag.
    Lid 2 verwijst naar rechten die reeds uitdrukkelijk waren gewaarborgd in het Verdrag tot oprichting van de Europese Gemeenschap en die in het Handvest zijn erkend en nu zijn ondergebracht in de Verdragen (met name de rechten die voortkomen uit het burgerschap van de Unie). Tevens wordt verduidelijkt dat dergelijke rechten onderworpen blijven aan de voorwaarden en grenzen die van toepassing zijn op het recht van de Unie waarop zij zijn gebaseerd en die worden omschreven in de Verdragen. Het Handvest brengt geen wijziging aan in de regeling van de rechten die bij het EG-Verdrag werden verleend en die zijn overgenomen in de Verdragen.
    Lid 3 beoogt te zorgen voor de nodige samenhang tussen het Handvest en het EVRM door de regel te vestigen dat, voor zover de rechten in het Handvest corresponderen met door het EVRM gewaarborgde rechten, de inhoud en reikwijdte ervan, inclusief de toegestane beperkingen, dezelfde zijn als die waarin het EVRM voorziet. Dit heeft met name tot gevolg dat de wetgever, bij de vaststelling van beperkingen van die rechten, gebonden is door dezelfde normen als die welke zijn vastgelegd in de gedetailleerde regeling inzake beperkingen in het EVRM, die dus toepasselijk wordt voor de door dit lid bestreken rechten, zonder dat dit evenwel de autonomie van het recht van de Unie of van het Hof van Justitie van de Europese Unie aantast.
    De verwijzing naar het EVRM geldt zowel voor het Verdrag als voor de eraan gehechte protocollen. De inhoud en reikwijdte van de gewaarborgde rechten worden niet alleen bepaald door de tekst van die instrumenten, maar ook door de jurisprudentie van het Europees Hof voor de rechten van de mens en door het Hof van Justitie van de Europese Unie. De laatste zin van dit lid strekt ertoe te de Unie in staat te stellen ruimere bescherming te waarborgen. Het door het Handvest geboden beschermingsniveau mag in ieder geval nooit lager zijn dan het niveau dat door het EVRM wordt gewaarborgd.
    Het Handvest laat de mogelijkheden van de lidstaten onverlet om een beroep te doen op artikel 15 van het EVRM, dat afwijkingen van het EVRM toestaat in tijd van oorlog of in geval van enig andere algemene noodtoestand die het bestaan van het land bedreigt, wanneer de lidstaten maatregelen nemen op het gebied van defensie in geval van oorlog en op het gebied van de handhaving van de openbare orde, overeenkomstig hun bevoegdheden als erkend in artikel 4, lid 1, van het Verdrag betreffende de Europese Unie en artikel 72 en 347 van het Verdrag betreffende de werking van de Europese Unie.
    De lijst van de rechten die in dit stadium, en zonder dat hiermee vooruit wordt gelopen op de ontwikkeling van het recht, de wetgeving en de Verdragen, als corresponderend met rechten van het EVRM in de zin van dit lid kunnen worden aangemerkt, volgt hierna. De rechten die toegevoegd zijn aan die van het EVRM worden niet vermeld.
    1. Artikelen van het Handvest met dezelfde inhoud en reikwijdte als de daarmee corresponderende artikelen van het EVRM:
    - artikel 2 correspondeert met artikel 2 EVRM
    - artikel 4 correspondeert met artikel 3 EVRM
    - artikel 5, leden 1 en 2, correspondeert met artikel 4 EVRM
    - artikel 6 correspondeert met artikel 5 EVRM
    - artikel 7 correspondeert met artikel 8 EVRM
    - artikel 10, lid 1, correspondeert met artikel 9 EVRM
    - artikel 11 correspondeert met artikel 10 EVRM, onverminderd de beperkingen die door het recht van de Unie kunnen worden opgelegd aan de mogelijkheid van de lidstaten om de in artikel 10, lid 1, derde zin, van het EVRM bedoelde systemen van vergunningen in te voeren
    - artikel 17 correspondeert met artikel 1 van het aanvullend protocol bij het EVRM
    - artikel 19, lid 1, correspondeert met artikel 4 van het Vierde Protocol bij het EVRM
    - artikel 19, lid 2, correspondeert met artikel 3 EVRM zoals het door het Europees Hof voor de rechten van de mens wordt geïnterpreteerd
    - artikel 48 correspondeert met artikel 6, leden 2 en 3, van het EVRM
    - artikel 49, lid 1 (behoudens de laatste zin) en lid 2, correspondeert met artikel 7 EVRM.

    2. Artikelen waarvan de inhoud dezelfde is als die van de daarmee corresponderende artikelen van het EVRM, maar waarvan de reikwijdte ruimer is:
    - artikel 9 bestrijkt de werkingssfeer van artikel 12 EVRM, maar de werkingssfeer ervan kan worden uitgebreid tot andere vormen van huwelijk als de nationale wetgeving deze instelt
    - artikel 12, lid 1, correspondeert met artikel 11 EVRM, maar de werkingssfeer ervan is uitgebreid tot het niveau van de Europese Unie
    - artikel 14, lid 1, correspondeert met artikel 2 van het aanvullend protocol bij het EVRM, maar de werkingssfeer ervan is uitgebreid tot beroepsopleiding en bijscholing
    - artikel 14, lid 3, correspondeert met artikel 2 van het aanvullend protocol bij het EVRM, met betrekking tot het recht van ouders
    - artikel 47, leden 2 en 3, correspondeert met artikel 6, lid 1, van het EVRM, maar de beperking tot de betwistingen betreffende burgerlijke rechten en verplichtingen of tot strafrechtelijke vervolging geldt niet ten aanzien van het recht van de Europese Unie en de toepassing ervan
    - artikel 50 correspondeert met artikel 4 van het Zevende Protocol bij het EVRM, maar de reikwijdte ervan is uitgebreid tot het niveau van de Europese Unie in de onderlinge verhoudingen van de rechtsmacht van de lidstaten
    - tot slot kunnen de burgers van de Europese Unie, binnen het toepassingsgebied van het recht van de Unie, niet worden beschouwd als vreemdelingen, zulks wegens het verbod van elke vorm van discriminatie op grond van nationaliteit. De door artikel 16 EVRM vastgestelde beperkingen met betrekking tot de rechten van vreemdelingen zijn in dat verband dus niet op hen van toepassing.
    De uitleggingsregel in lid 4 is gebaseerd op de formulering van artikel 6, lid 3, van het Verdrag betreffende de Europese Unie en houdt rekening met de benadering van gemeenschappelijke constitutionele tradities die door het Hof van Justitie wordt gevolgd (bijv. arrest van 13 december 1979, zaak 44/79, Hauer, Jurispr. 1979, blz. 3727; arrest van 18 mei 1982, zaak 155/79, AM&S, Jurispr. 1982, blz. 1575). Volgens die regel zouden de betrokken rechten van het Handvest zodanig moeten worden uitgelegd dat een hoge beschermingsnorm wordt gegarandeerd die strookt met het recht van de Unie en die spoort met de gemeenschappelijke constitutionele tradities, in plaats van een strikte aanpak te volgen waarbij een minimale gemeenschappelijke basis wordt gezocht.
    In lid 5 wordt het onderscheid tussen in het Handvest bepaalde `rechten` en `beginselen` verduidelijkt. Volgens dat onderscheid worden subjectieve rechten geëerbiedigd en worden beginselen nageleefd (artikel 51, lid 1). Beginselen kunnen worden toegepast door middel van wetgevings- of uitvoeringshandelingen (die door de Unie worden vastgesteld op grond van haar bevoegdheden, en door de lidstaten alleen wanneer zij het recht van de Unie tot uitvoering brengen); dit betekent dat zij alleen van belang zijn voor de rechter wanneer die handelingen worden geïnterpreteerd en getoetst. Zij geven echter geen aanleiding tot directe eisen tot het nemen van positieve maatregelen door de instellingen van de Unie of de overheden van de lidstaten. Die benadering spoort met de jurisprudentie van het Hof van Justitie (zie onder meer jurisprudentie betreffende het `voorzorgsbeginsel` van artikel 191, lid 2, van het Verdrag betreffende de werking van de Europese Unie: het arrest van het GEA van 11 september 2002 in zaak T-13/99, Pfizer tegen Raad, waarin meermaals verwezen wordt naar vroegere jurisprudentie; en een reeks arresten met betrekking tot artikel 33 (ex 39) betreffende de beginselen van de landbouwwetgeving, bijvoorbeeld het arrest van het Hof van Justitie in zaak 265/85, Van den Berg, Jurispr. 1987, blz. 1155: onderzoek van het beginsel van marktstabilisatie en het vertrouwensbeginsel) en met de benadering van `beginselen` in de constitutionele stelsels van de lidstaten, met name op het gebied van sociale wetgeving. Ter illustratie: voorbeelden van beginselen die in het Handvest worden erkend, zijn onder meer de artikelen 25, 26 en 37. In sommige gevallen kan een artikel van het Handvest elementen van zowel een recht als een beginsel bevatten, zie bijvoorbeeld de artikelen 23, 33 en 34.
    Lid 6 verwijst naar de diverse artikelen in het Handvest die in de geest van de subsidiariteit verwijzen naar nationale wetgevingen en praktijken.

    Preamble - Explanations relating to the Charter of Fundamental Rights:
    Deze toelichtingen werden oorspronkelijk opgesteld onder de verantwoordelijkheid van het praesidium van de Conventie die het Handvest van de grondrechten van de Europese Unie heeft opgesteld. Zij zijn bijgewerkt onder de verantwoordelijkheid van het praesidium van de Europese Conventie, in het licht van de wijzigingen die door laatstgenoemde Conventie in het Handvest zijn aangebracht (met name in artikel 51 en 52) en van verdere ontwikkelingen in het recht van de Unie. Hoewel zij op zich geen juridische waarde hebben, vormen zij een waardevol hulpmiddel voor de interpretatie, bedoeld om de bepalingen van het Handvest te verduidelijken.

    Even in cases of clear and present danger to the existence of the state, no restrictions may be imposed upon the provisions of this Constitution stipulating the right to life, prohibition of torture, cruel or unusual treatment or punishment, and concerning the legal definitions of criminal offences and punishment, and the freedom of thought, conscience and religion.

    Het voorgaande lid is niet van toepassing wanneer de wet, het decreet of de in artikel 134 bedoelde regel de rechtstreekse verkiezing organiseren van de bestendig afgevaardigden van de provincieraden, van de schepenen, van de leden van de raad voor maatschappelijk welzijn, van de leden van het vast bureau van de openbare centra voor maatschappelijk welzijn of van de leden van de uitvoerende organen van elk ander interprovinciaal, bovengemeentelijk, intercommunaal of binnengemeentelijk territoriaal orgaan. Artikel 12. De vrijheid van de persoon is gewaarborgd. Niemand kan worden vervolgd dan in de gevallen die de wet bepaalt en in de vorm die zij voorschrijft. Artikel 15. De woning is onschendbaar; geen huiszoeking kan plaats hebben dan in de gevallen die de wet bepaalt en in de vorm die zij voorschrijft. Artikel 16. Niemand kan van zijn eigendom worden ontzet dan ten algemenen nutte, in de gevallen en op de wijze bij de wet bepaald en tegen billijke en voorafgaande schadeloosstelling. Artikel 21. (...) Het burgerlijk huwelijk moet altijd aan de huwelijksinzegening voorafgaan, behoudens de uitzonderingen door de wet te stellen, indien daartoe redenen zijn. Artikel 22. Ieder heeft recht op eerbiediging van zijn privé-leven en zijn gezinsleven, behoudens in de gevallen en onder de voorwaarden door de wet bepaald. Artikel 29. Het briefgeheim is onschendbaar.
    De wet bepaalt welke agenten verantwoordelijk zijn voor de schending van het geheim der aan de post toevertrouwde brieven. Artikel 31. Geen voorafgaand verlof is nodig om vervolgingen in te stellen tegen openbare ambtenaren wegens daden van hun bestuur, behoudens wat ten opzichte van de ministers en de leden van de Gemeenschaps- en Gewestregeringen is bepaald. Artikel 32. Ieder heeft het recht elk bestuursdocument te raadplegen en er een afschrift van te krijgen, behoudens in de gevallen en onder de voorwaarden bepaald door de wet, het decreet of de regel bedoeld in artikel 134. Artikel 117. De leden van de Gemeenschaps- en Gewestparlement worden gekozen voor vijf jaar. De Raden worden om de vijf jaar geheel vernieuwd.
    De verkiezingen voor de Gemeenschaps- en Gewestparlementen vinden plaats op dezelfde dag die samenvalt met die van de verkiezingen voor het Europese Parlement.
    In uitvoering van een wet bedoeld in artikel 118, § 2, vierde lid, kan een decreet of een in artikel 134 bedoelde regel, aangenomen overeenkomstig artikel 118, § 2, vierde lid, afwijken van het eerste en het tweede lid. Artikel 170 (...) § 2. Geen belasting ten behoeve van de gemeenschap of het gewest kan worden ingevoerd dan door een decreet of een in artikel 134 bedoelde regel.
    De wet bepaalt ten aanzien van de in het eerste lid bedoelde belastingen, de uitzonderingen waarvan de noodzakelijkheid blijkt. § 3. Geen last of belasting kan door de provincie of het bovengemeentelijk bestuur worden ingevoerd dan door een beslissing van haar raad.

    De wet bepaalt ten aanzien van de in het eerste lid bedoelde belastingen, de uitzonderingen waarvan de noodzakelijkheid blijkt. Artikel 172. Inzake belastingen kunnen geen voorrechten worden ingevoerd.
    Geen vrijstelling of vermindering van belasting kan worden ingevoerd dan door een wet. Artikel 173. Behalve voor de provincies, de polders en wateringen en de gevallen uitdrukkelijk uitgezonderd door de wet, het decreet en de regelen bedoeld in artikel 134, kan van de burgers geen retributie worden gevorderd dan alleen als belasting ten behoeve van de Staat, de gemeenschap, het gewest, de agglomeratie, de federatie van gemeenten of de gemeente. Article 185. Vreemde troepen mogen niet dan krachtens een wet tot de dienst van de Staat worden toegelaten, het grondgebied bezetten of er doorheen trekken. Artikel 186.Militairen kunnen niet van hun graden, ererechten en pensioenen worden ontzet dan op de wijze bij de wet bepaald. Artikel 191. Iedere vreemdeling die zich op het grondgebied van België bevindt, geniet de bescherming verleend aan personen en aan goederen, behoudens de bij de wet gestelde uitzonderingen.

    (15) This Regulation does not affect the freedom of expression and information guaranteed to individuals under the Charter. The European Court of Human Rights has observed that in such a sensitive sector as the audiovisual media sector, in addition to its negative duty of non-interference, the public powers have a positive obligation to put in place an appropriate legislative and administrative framework to guarantee effective media pluralism


    (20) In order to avoid circumvention of the protection of journalistic sources and confidential communications and guarantee adequate respect for one’s private and family life, home and communications in accordance with the Charter, safeguards should also apply to persons who, because of their regular private or professional relationship with media service providers or members of their editorial staff, are likely to have information that could identify journalistic sources or confidential communications. That should include persons living in a close relationship in a joint household and on a stable and continuous basis and persons who are or have been professionally involved in the preparation, production or dissemination of programmes or press publications and who are only targeted due to their close links with media service providers, journalists or other members of the editorial staff. The protection of journalistic sources and confidential communications should also benefit the staff of media service providers, such as the technical staff, including cybersecurity experts, who could be targeted given the important support role they provide to journalists in their daily work, which requires solutions to ensure the confidentiality of journalists’ work, and the resulting likelihood that they have access to information concerning journalistic sources or confidential communications.

    (21) Protecting journalistic sources and confidential communications is consistent with and contributes to the protection of the fundamental right enshrined in Article 11 of the Charter. It is also crucial for safeguarding the ‘public watchdog’ role of media service providers and, in particular investigative journalists in democratic societies and for upholding the rule of law. In light thereof, ensuring an adequate level of protection for journalistic sources and confidential communications requires that measures for obtaining such information be authorised by an authority that can independently and impartially assess whether it is justified by an overriding reason of public interest, such as a court, a judge, a prosecutor acting in a judicial capacity, or another such authority with competence to authorise those measures in accordance with national law. It also requires that surveillance measures be subject to regular review by such an authority to ascertain whether the conditions justifying the use of the measure in question continue to be fulfilled. That requirement is also met where the purpose of the regular review is to verify whether the conditions justifying an extension of the authorisation for the use of the measure have been fulfilled.


    (26) Intrusive surveillance software should only be deployed where it is justified by an overriding reason of public interest, it is provided for in Union or national law, it is in compliance with Article 52(1) of the Charter as interpreted by the Court of Justice and with other Union law, it has been authorised ex ante or, in exceptional and urgent cases, subsequently confirmed by a judicial authority or an independent and impartial decision-making authority, it occurs in investigations of offences listed in Article 2(2) of Council Framework Decision 2002/584/JHA (9) punishable in the Member State concerned by a custodial sentence or a detention order of a maximum period of at least three years or in investigations of other serious offences punishable in the Member State concerned by a custodial sentence or a detention order of a maximum period of at least five years, as determined by the national law of that Member State, and provided that no other less restrictive measure would be adequate and sufficient to obtain the information sought. According to the principle of proportionality, limitations can be made to an individual’s rights and freedoms only if they are necessary and genuinely meet objectives of general interest recognised by the Union. Thus, as regards specifically the deployment of intrusive surveillance software, it is necessary to ascertain whether the offence in question attains a threshold of seriousness as laid down in this Regulation, whether, following an individual assessment of all the relevant circumstances in a given case, the investigation and prosecution of that offence merit the particularly intrusive interference with fundamental rights and economic freedoms consisting in the deployment of intrusive surveillance software, whether there is sufficient evidence that the offence in question has been committed, and whether the deployment of intrusive surveillance software is relevant for the purpose of establishing the facts related to the investigation and prosecution of that offence.


    (77) This Regulation respects the fundamental rights and observes the principles recognised by the Charter, in particular Articles 7, 8, 11, 16, 47, 50 and 52 thereof. Accordingly, this Regulation should be interpreted and applied with due respect for those rights and principles. In particular, nothing in this Regulation should be interpreted as interfering with the freedom of information, editorial freedom or the freedom of the press as enshrined in national constitutional law that is consistent with the Charter or as incentivising Member States to introduce requirements for the editorial content of press publications.

    Article 4: Rights of media service providers 

    4.   By way of derogation from paragraph 3, points (a) and (b), of this Article, Member States may take a measure referred to therein, provided that it:

    (a) is provided for by Union or national law;

    (b) is in compliance with Article 52(1) of the Charter and other Union law;

    (c) is justified on a case-by-case basis by an overriding reason of public interest and is proportionate; and

    (d) is subject to prior authorisation by a judicial authority or an independent and impartial decision-making authority or, in duly justified exceptional and urgent cases, is subsequently authorised by such an authority without undue delay.

    8.   Member States shall ensure that media service providers, their editorial staff or any persons who, because of their regular or professional relationship with a media service provider or its editorial staff, might have information related to or capable of identifying journalistic sources or confidential communications have a right to effective judicial protection, in line with Article 47 of the Charter, in cases regarding breaches of paragraphs 3 to 7 of this Article.

    Article 6: Duties of media services providers

    3.   Without prejudice to national constitutional law consistent with the Charter, media service providers providing news and current affairs content shall take measures that they deem appropriate with a view to guaranteeing the independence of editorial decisions. In particular, such measures shall aim to:

    (a) guarantee that editorial decisions can be taken freely within the established editorial line of the media service provider concerned; and

    (b) ensure that any actual or potential conflicts of interest that might affect the provision of news and current affairs content are disclosed.

    (24) Where an institution does not present an adequate recovery plan, competent authorities should be empowered to require that institution to take measures necessary to redress the material deficiencies of the plan. That requirement may affect the freedom to conduct a business as guaranteed by Article 16 of the Charter. The limitation of that fundamental right is however necessary to meet the objectives of financial stability. More specifically, such a limitation is necessary in order to strengthen the business of institutions and avoid institutions growing excessively or taking excessive risks without being able to tackle setbacks and losses and to restore their capital base. The limitation is proportionate because it permits preventative action to the extent that it is necessary to address the deficiencies and therefore complies with Article 52 of the Charter.

    (49) The limitations on the rights of shareholders and creditors should be in accordance with Article 52 of the Charter. The resolution tools should therefore be applied only to those institutions that are failing or likely to fail, and only when it is necessary to pursue the objective of financial stability in the general interest. In particular, resolution tools should be applied where the institution cannot be wound up under normal insolvency proceedings without destabilising the financial system and the measures are necessary in order to ensure the rapid transfer and continuation of systemically important functions and where there is no reasonable prospect for any alternative private solution, including any increase of capital by the existing shareholders or by any third party sufficient to restore the full viability of the institution. In addition, when applying resolutions tools and exercising resolution powers, the principle of proportionality and the particularities of the legal form of an institution should be taken into account.

    (88) In accordance with Article 47 of the Charter, the parties concerned have a right to due process and to an effective remedy against the measures affecting them. Therefore, the decisions taken by the resolution authorities should be subject to a right of appeal.

    Subject matter and scope

    1. This Regulation lays down temporary and strictly limited rules derogating from certain obligations laid down in Directive 2002/58/EC, with the sole objective of enabling providers of certain number-independent interpersonal communications services (‘providers’) to use, without prejudice to Regulation (EU) 2016/679, specific technologies for the processing of personal and other data to the extent strictly necessary to detect online child sexual abuse on their services and report it and to remove online child sexual abuse material from their services.

    2. This Regulation does not apply to the scanning of audio communications.

    (6) This Directive is without prejudice to the possibility for each Member State to take the necessary measures to ensure the protection of its essential security interests, to safeguard public policy and public security, and to permit the investigation, detection and prosecution of criminal offences, taking into account that any limitation to the exercise of the rights and freedoms recognised by the Charter, in particular in Articles 7, 8 and 11 thereof, such as limitations regarding the processing of data, are to be provided for by law, respect the essence of those rights and freedoms and be subject to the principle of proportionality, in accordance with Article 52(1) of the Charter.

    In response to increased arrivals of asylum seekers, in 2015 the European Commission introduced the hotspot approach. Under this approach, the European Commission and EU agencies supported Greece and Italy in identifying, registering and fingerprinting newly arrived people. FRA regularly visited the initial reception facilities hosting them. This report looks back at the lessons learnt from 10 years of FRA visits. It identifies recurring risks to rights and highlights practical measures and promising practices to prevent or address them. These ‘lessons learnt’ can inform the implementation of the 2024 Pact on Migration and Asylum in line with the EU Charter of Fundamental Rights.
